END USER LICENSE AGREEMENT (EULA)

IMPORTANT — PLEASE READ CAREFULLY: This End User License Agreement ("Agreement") is a legal contract between you (either an individual or a single entity) and DIOXER ("Company," "we," "our," or "us") governing your use of the video game titled ISLE OF FINBARI (the "Game") and any related documentation, updates, downloadable content, and online services provided or made available by Company (collectively, the "Software").

By clicking "I Agree," installing, copying, or otherwise using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

1. GRANT OF LICENSE

1. Subject to your ongoing compliance with this Agreement, Company grants you a limited, revocable, non‑exclusive, non‑transferable, and non‑sublicensable license to:

(a) download and install one copy of the Software via your Steam account on a device you own or control; and

(b) use the Software for your personal, non‑commercial entertainment purposes only.

2. All rights not expressly granted herein are reserved by Company. The Software is licensed, not sold, to you.

2. STEAM PLATFORM TERMS

The Software is distributed through the Steam® platform operated by Valve Corporation. Your use of Steam and related services is additionally governed by the Steam Subscriber Agreement and other Valve policies. Nothing in this Agreement limits or supersedes your obligations under the Steam Subscriber Agreement.

3. RESTRICTIONS

You may NOT:

(a) copy, reproduce, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law without the possibility of contractual waiver;

(b) modify, translate, or create derivative works of the Software, except as expressly permitted in Section 5 (Modding & Workshop);

(c) remove, alter, or obscure any proprietary notices or labels on the Software;

(d) sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or any copies thereof;

(e) use the Software for any commercial purpose without Company’s prior written consent;

(f) use cheats, automation software, bots, hacks, mods (except as permitted in Section 5), or any unauthorized third‑party software designed to modify or interfere with the Software;

(g) violate any applicable law or regulation in connection with your use of the Software.

4. OWNERSHIP

Company and its licensors retain all right, title, and interest in and to the Software, including all intellectual‑property rights therein. The Software is protected by copyright laws, international treaties, and other intellectual‑property laws.

5. MODDING & STEAM WORKSHOP

1. User‑Generated Content ("UGC"). Company may, in its discretion, provide official mod tools and/or enable Steam Workshop functionality that allows you to create and share user‑generated content for the Game.

2. License to Company. By creating, uploading, or distributing UGC, you grant Company and its affiliates a perpetual, irrevocable, royalty‑free, worldwide license (with the right to sublicense) to host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such UGC in connection with the Game and Company’s business.

3. UGC Standards. You represent and warrant that your UGC (i) does not infringe any third‑party rights; (ii) is not unlawful, offensive, or otherwise objectionable; and (iii) complies with Steam Workshop rules and this Agreement.

4. Company reserves the right to remove or disable access to any UGC at any time, for any reason, without notice.

6. ONLINE SERVICES & ACCOUNTS

1. Some features of the Software may require an internet connection and a valid Steam account. You are responsible for all internet fees.

2. Company may suspend or discontinue online services at any time. Reasonable advance notice will be provided where practicable.

7. UPDATES

Company may deploy patches, updates, or other modifications to the Software that must be installed for continued use. You consent to such updates being automatically applied via Steam.

8. TERM & TERMINATION

1. This Agreement is effective until terminated.

2. You may terminate it at any time by uninstalling and deleting all copies of the Software.

3. Company may terminate this Agreement immediately if you breach any term. Upon termination, your license automatically terminates and you must cease all use of the Software.

9. LIMITED WARRANTY & DISCLAIMER

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR‑FREE OR UNINTERRUPTED.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL COMPANY, ITS AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. COMPANY’S TOTAL LIABILITY IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.

11. INDEMNITY

You agree to indemnify, defend, and hold harmless Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this Agreement or use of the Software.

12. GOVERNING LAW & JURISDICTION

This Agreement and any dispute or claim (including non‑contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of England and Wales. You and Company agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement.

13. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Company regarding the Software and supersedes all prior or contemporaneous understandings.

15. CHANGES TO THIS AGREEMENT

Company may amend this Agreement at any time. Any changes will be posted on the Steam store page for the Game or within the Software. Your continued use of the Software after such changes constitutes your acceptance.
