End User License Agreement (EULA)

1. INTRODUCTION
This End User License Agreement ("EULA") is a legal agreement between you (the "User") and VORTEX and its affiliates ("VORTEX," "we," "us," or "our") for the use of all software, products, websites, games, and services offered or made available through vortex-gaming.net and other sites maintained by VORTEX ("Services"). By using or accessing the Services, you agree to be bound by this EULA and our Privacy Policy. If you do not agree to the terms of this EULA, you may not use or access the Services.
2. LICENSE GRANT
Subject to your compliance with this EULA, VORTEX grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial use only.
3. ACCOUNT REGISTRATION AND RESPONSIBILITIES
To access certain features, you may be required to register an account. You agree to provide truthful, accurate, and up-to-date information. You are solely responsible for maintaining the confidentiality of your login information and for all activities under your account.
a. Ownership
You acknowledge that you do not own the account, characters, or virtual items associated with your account. These are licensed to you and remain the property of VORTEX.
b. Restrictions on Selling and Sharing
You may not sell, barter, trade, or share your account, characters, or any related virtual goods or items. Any such attempt is a violation of this EULA and may result in termination of your account.
4. VIRTUAL GOODS
All virtual goods, including currencies and items within our Services, are licensed and not sold to you. These remain the sole property of VORTEX. You may not purchase virtual goods from third parties. VORTEX may remove virtual goods from your account at any time, with or without notice.
5. USER GENERATED CONTENT
By submitting or uploading any content to our Services (including forums, blogs, and chat), you grant VORTEX an irrevocable, worldwide, perpetual, royalty-free license to use, reproduce, modify, publish, and distribute such content. You waive any rights of privacy, publicity, or moral rights in such content.
6. CODE OF CONDUCT
You agree not to:
Post, share, or transmit any content that is abusive, offensive, obscene, or otherwise objectionable;
Exploit bugs or use third-party software to gain unfair advantage;
Harass, impersonate, or threaten other users or VORTEX staff;
Discuss illegal activities or violate local, national, or international laws;
Engage in trolling, spamming, or off-topic discussions.
VORTEX reserves the right to monitor, moderate, and remove content that violates this EULA.
7. TERMINATION
VORTEX reserves the right to terminate your account at any time for any reason, including violations of this EULA. Upon termination, your access to Services and virtual goods will be revoked with no entitlement to a refund.
8. REFUNDS
All purchases of virtual goods or downloadable content are final and non-refundable, except where required by law.
9. SECURITY
You are responsible for maintaining the security of your account. VORTEX is not liable for losses or damages resulting from unauthorized access to your account.
10. THIRD PARTY LINKS
The Services may contain links to third-party websites. VORTEX is not responsible for the content, policies, or practices of these websites. Your use of third-party sites is at your own risk.
11. INTELLECTUAL PROPERTY
All content within the Services is the property of VORTEX or its licensors and is protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works without express written permission.
12. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND. VORTEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. LIMITATION OF LIABILITY
IN NO EVENT SHALL VORTEX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
14. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which VORTEX is headquartered, excluding its conflict of law principles.
15. AMENDMENTS
VORTEX may revise this EULA at any time. Continued use of the Services after changes have been posted constitutes your acceptance of the updated EULA.
16. INDEMNIFICATION
You agree to indemnify and hold harmless VORTEX and its affiliates from any claims, damages, losses, and expenses arising from your use of the Services or violation of this EULA.
17. SEVERABILITY
If any provision of this EULA is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
18. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and VORTEX regarding the use of the Services and supersedes all prior agreements or communications.
19. ACKNOWLEDGEMENT
BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS EULA.
