End User License Agreement (EULA) – MindViz
Version: 1.0 – Date: April 18, 2025
This End User License Agreement (EULA) governs the use of the MindViz software, an interactive network visualization and creation tool, developed by CreepyCat ("the Publisher"). By installing, accessing, or using MindViz, you agree to the terms and conditions of this EULA. If you do not agree to these terms, please do not use the software.
1. Definitions
"Software": MindViz, including its updates, documentation, and associated features.
"User": Any individual or legal entity using the software.
"User Content": Diagrams, networks, or other data created by the User through MindViz.
"Export": Functionality allowing the saving or transfer of networks in XML, JSON, or other supported formats.
2. Acceptance of Terms
By installing, accessing, or using MindViz, you accept this EULA in its entirety. The Publisher reserves the right to modify this EULA at any time. Continued use of the software after such modifications constitutes acceptance of the updated terms.
3. Grant of License
3.1. License Granted: The Publisher grants the User a non-exclusive, non-transferable, and revocable license to use MindViz for personal or professional purposes, in accordance with this EULA.
3.2. Restrictions: Unless expressly authorized in writing by the Publisher, the User shall not: Modify, disassemble, decompile, or reverse-engineer the software. Redistribute, rent, lease, or sell the software or access to it. Use the software for illegal purposes or in violation of this EULA.
4. Intellectual Property
4.1. Ownership of MindViz: The software, including its code, interface, icons, algorithms, and documentation, is the exclusive property of the Publisher or its licensors.
4.2. User Content: Diagrams and networks created by the User belong to the User. The User is solely responsible for managing and backing up their User Content.
5. No Data Collection : MindViz does not collect any data, whether personal (e.g., name, email) or anonymous - anonymized (e.g., usage statistics). No User Content is transmitted, stored, or processed by the Publisher. The User is responsible for managing and securing their data, including during export or local storage.
6. Export and Integration
6.1. XML and JSON Export: MindViz allows networks to be exported as XML or JSON files for integration into games, applications, or databases. This functionality is limited in the demo version.
6.2. Responsibility: The User is responsible for the use of exported files and must ensure their integration complies with applicable laws and third-party rights.
6.3. Compatibility: The Publisher does not guarantee the compatibility of exported files with all third-party systems.
7. Updates and Support
7.1. Updates: The Publisher may provide automatic or manual updates to fix bugs, add features, or improve security.
7.2. Support: Technical support is available for paid users via black.creepy.cat@gmail.com. Free version users may access online documentation.
8. Limitation of Liability
8.1. Software "As Is": MindViz is provided "as is," without any express or implied warranties, including regarding error-free operation or compatibility with all systems.
8.2. Non-Liability: The Publisher shall not be liable for any direct or indirect damages (e.g., data loss, business interruption) resulting from the use or inability to use the software, except in cases of proven gross negligence.
8.3. Backup: The User is responsible for backing up their User Content. The Publisher has no obligation to restore lost data.
9. Termination
9.1. By the User: The User may stop using MindViz at any time by uninstalling the software.
9.2. By the Publisher: The license may be terminated if the User breaches this EULA. In such cases, the User must cease all use of the software and destroy all copies in their possession.
10. Governing Law and Dispute Resolution
10.1. Governing Law: This EULA is governed by the laws of France.
10.2. Amicable Resolution: The parties agree to attempt to resolve any disputes amicably before resorting to litigation.
11. Miscellaneous
11.1. Language: The English version of this EULA prevails in case of discrepancies with other translations.
11.2. Severability: If any provision of this EULA is deemed invalid, the remaining provisions remain enforceable.
11.3. Non-Waiver: The Publisher’s failure to enforce any right does not constitute a waiver of that right.
