**End User License Agreement (hereinafter the “License” or “Agreement”)**

Sergio Tengattini, Mapello (BG), Italy (hereinafter “Sgriusoft”)
**End User:**
The adult individual who purchases the license to use the Game (hereinafter the “User” or “End User”)

### Recitals
1. The User declares to understand the language in which this Agreement is drafted.
2. The User declares to be of legal adult age according to the laws of their country of residence and to have the legal capacity to enter into binding agreements.
3. The User acknowledges that the Game is intended exclusively for adults with full legal capacity; accordingly, use by minors or persons with limited capacity is expressly prohibited.
4. The User expressly agrees not to allow the use of the Game by minors or persons with limited capacity.

### Acceptance of the License
Prior to purchasing the license and installing the Game, the User must read, understand, and fully accept this Agreement. Installation, copying, or use of the Game constitutes full and unconditional acceptance of this Agreement. If the User does not agree, they must not install, copy, or use the Game.
If dissatisfied with the Game, the User may only cease its use and uninstall the product. The User agrees to waive any refund claims related to the Game.

### 1) Personal Use License
Sgriusoft grants the User a non-exclusive, non-transferable license limited to personal use of the Game. Duplication, copying, or reproduction of the Game or its contents (images, videos, audio, code, texts, trademarks, etc.) is prohibited. The license does not confer any ownership rights to the User.

### 2) Ownership of the Game
The Game remains the exclusive property of Sgriusoft. The User acquires only a personal use license, with no rights to sell, rent, distribute, or transfer it. Any violation of these rights constitutes economic damage to Sgriusoft, who may pursue legal remedies to protect its rights.

### 3) Terms of Use
The User agrees to use the Game in compliance with this Agreement, including but not limited to:
a) Commercial use is prohibited without written authorization.
b) The license is valid for a single device.
c) Sale, rental, distribution, or transfer of the Game is prohibited.
d) Any modification, reverse engineering, decompilation, removal of protections, notices, or trademarks is prohibited.
e) Unauthorized export of the software is prohibited.
f) Creation of software that imitates the Game’s content is prohibited.
g) Use of software that interacts with or modifies the Game without authorization is prohibited.
h) Use of the content for illegal, defamatory, obscene, or rights-infringing purposes is prohibited.
The User assumes full responsibility for any damages resulting from violations and agrees to indemnify Sgriusoft and third parties.

### 4) Limited Liability and Warranties
The Game is provided “as is,” without any express or implied warranties. Sgriusoft does not guarantee that the Game is error-free, satisfactory, compatible with devices or software, or free from offensive content.
Use of the Game is at the User’s sole risk, who releases Sgriusoft from any liability for direct or indirect damages, including malfunctions, data loss, or interruptions.
The User acknowledges that the Game may receive updates or become obsolete, and that the sole remedy in case of disputes is discontinuation of use.

### 5) Indemnification
The User agrees to defend, indemnify, and hold harmless Sgriusoft from any claims, costs, or damages arising from misuse of the Game or violation of this Agreement.

### 6) International Use
The Game may be accessible globally, but the User is responsible for verifying the legality of its use in their country of residence. Illegal use is strictly prohibited, and the User holds Sgriusoft harmless from any liability.
The User also declares not to reside in, nor export the Game to, countries subject to embargo by the USA or EU.
In case of doubt regarding legality, the User is invited to contact Sgriusoft by email before purchase.

### 7) Termination of the Agreement
This Agreement takes effect upon acceptance and license grant. The User may terminate it at any time by ceasing use and deleting all copies of the Game.
Violation of any clause results in immediate termination and obligation to cease use and destroy all copies.
Sgriusoft may terminate the Agreement at its discretion, requesting removal of the Game.
Clauses 2, 3, 4, 5, 6, 8, and 9 survive termination.

### 8) License Violations
Violations constitute economic damage and entail indemnification obligations in favor of Sgriusoft.

### 9) Legal Disputes and Mediation
The User agrees to mandatory preliminary mediation attempts before initiating legal proceedings.
Any disputes shall be governed by Italian law, with exclusive jurisdiction of Italian courts.
Claims and communications must be sent to sgriusoft@gmail.com in Italian or English.

### 10) Data Collection
The Game may collect anonymous technical data to ensure proper functioning or for statistical purposes.
The User is informed and consents to such data collection, which complies with applicable privacy laws (see the available privacy policy).
Please consult in advance the privacy policies of UNITY (https://unity.com/legal/privacy-policy) and STEAM (https://store.steampowered.com/privacy/_agreement/).

### 11) Language and Versions
This Agreement is drafted in Italian, with additional courtesy translations. In case of discrepancies, the Italian version prevails.

### 12) License Amendments
Sgriusoft reserves the right to unilaterally modify this Agreement, applying changes to new licenses or updates. Licenses already granted remain governed by the version in effect at the time of purchase.

### 13) Severability
If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be modified or excluded without affecting the validity of the remaining clauses.
