Professional Ship Simulator – End User License Agreement (EULA)
IMPORTANT – PLEASE READ CAREFULLY:
This End User License Agreement ("EULA") is a legally binding agreement between you ("User") and SWE Systems UG (haftungsbeschränkt), Germany, https://nauticxp.com/ ("Developer"), concerning your use of Professional Ship Simulator ("PSS") ("Software").
By installing, accessing, launching, using, or otherwise interacting with the Software, you agree to be bound by the terms of this EULA.
If you do not agree to these terms, you may not install, access, or use the Software.
1. License Grant
1.1 License
The Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Software for your personal, non-commercial entertainment and evaluation purposes, subject to the terms of this EULA.
1.2 No Ownership
The Software is licensed, not sold.
This EULA does not transfer any ownership rights, intellectual property rights, copyrights, trademarks, or other proprietary rights in the Software to you.
All rights not expressly granted under this EULA remain with the Developer and/or the respective rights holders.
2. Usage Restrictions
2.1 No Unauthorized Commercial Use
Unless expressly authorized by the Developer, you may not use the Software itself for commercial operations, resale, sublicensing, rental, hosting services, or other unauthorized commercial exploitation.
This restriction does not prohibit normal creation and publication of gameplay videos, livestreams, screenshots, reviews, or similar user-generated content as permitted under Section 2.3.
2.2 Modification, Reverse Engineering and Redistribution
Except where expressly permitted by applicable law, you may not:
modify, reproduce, distribute, sell, rent, sublicense, or commercially exploit the Software or substantial parts thereof;
reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software;
circumvent or interfere with technical protection mechanisms, authentication systems, online services, or security features;
distribute modified versions of the Software without the Developer's prior written consent.
2.3 Screenshots, Videos and Public Sharing
You are permitted to create and publicly share screenshots, gameplay footage, livestreams, reviews, gameplay impressions, and similar content featuring Professional Ship Simulator.
If the version being shown is a beta, demo, test, preview, Early Access, or otherwise unfinished version, the Developer may request that such content clearly identifies the version as unfinished and not necessarily representative of the final product.
3. Online Features, Steam and Leaderboards
3.1 Steam Services
Professional Ship Simulator may use services provided by Valve Corporation through Steam and Steamworks, including but not limited to achievements, statistics, cloud services, authentication, and leaderboards.
Use of Steam and Steam services is additionally subject to the agreements, terms, and privacy policies applicable to Steam.
3.2 Steam Leaderboards
The Software may submit gameplay-related scores and statistics to Steam Leaderboards.
These may include, for example:
total play time;
experience points (XP);
distance travelled;
missions completed;
credits earned;
difficulty-related XP;
weather-related XP;
other gameplay scores or statistics associated with leaderboard functionality.
3.3 Public Display of Leaderboard Information
Leaderboard information may be publicly visible through Steam Community features and may also be displayed on official Professional Ship Simulator websites or services operated by the Developer.
Public leaderboard displays may include:
your Steam display name;
your Steam profile avatar;
your leaderboard position or rank;
gameplay-related scores and statistics submitted to the respective leaderboard.
By using features of the Software that submit scores to Steam Leaderboards, you acknowledge that such leaderboard information may be publicly displayed in this manner.
The Developer does not intend to publish private information such as your email address, IP address, payment information, or other non-public account information as part of public leaderboards.
3.4 Steam Profile Information
The availability of Steam profile information, including display names and avatars, may depend on Steam functionality and the privacy settings associated with your Steam account.
Steam profile information remains subject to Valve Corporation's terms and privacy practices.
3.5 Integrity of Leaderboards
You may not intentionally manipulate, falsify, exploit, automate, cheat, or otherwise interfere with leaderboard results or gameplay statistics.
The Developer reserves the right to remove, reset, disregard, or invalidate leaderboard entries that are reasonably believed to result from cheating, exploits, manipulation, technical errors, or unauthorized software.
4. Development Status, Risks and Disclaimer
4.1 Development and Software Status
Certain versions of Professional Ship Simulator, including demo, beta, preview, test, or Early Access versions, may still be under development.
Such versions may contain bugs, incomplete features, balancing issues, technical errors, compatibility problems, or stability issues.
Features, gameplay systems, content, statistics, progression systems, and other aspects of the Software may change during development.
Use of unfinished versions is at your own risk.
4.2 Safety Notice – Connected Hardware
⚠️ IMPORTANT SAFETY NOTICE
When launching or playing the Software, connected hardware controllers such as steering wheels, throttles, rudder pedals, force-feedback devices, motion systems, or other motorized peripherals may move automatically or unexpectedly.
Keep hands, fingers, clothing, cables, objects, and other body parts clear of moving mechanical components during startup, shutdown, configuration, calibration, and gameplay.
Always follow the safety instructions provided by the manufacturer of the connected hardware.
To the extent permitted by applicable law, the Developer shall not be responsible for injury or damage caused by misuse of third-party hardware or failure to follow applicable safety instructions.
5. Warranty Disclaimer
5.1 Software Provided "As Is"
To the extent permitted by applicable law, the Software is provided "as is" and "as available", without warranties or guarantees beyond those required by mandatory law.
The Developer does not guarantee that the Software will be uninterrupted, error-free, compatible with every hardware or software configuration, or permanently available.
Nothing in this EULA excludes warranties, remedies, or consumer rights that cannot legally be excluded under applicable law.
6. Limitation of Liability
To the extent permitted by applicable law, the Developer shall not be liable for indirect, incidental, consequential, or special damages resulting from the use of or inability to use the Software.
This may include, where legally permissible, loss of data, loss of gameplay progress, loss of profits, interruption of business, or damage resulting from software malfunction.
Nothing in this EULA limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including applicable liability for intent, gross negligence, injury to life, body, or health, or mandatory product liability.
7. Updates and Online Services
7.1 Updates
The Developer may provide updates, patches, fixes, balancing changes, content changes, or other modifications to the Software.
Certain updates may be required in order to continue using online functionality.
7.2 Changes to Online Features
Online services, statistics, leaderboards, multiplayer functionality, external integrations, or other connected services may be changed, reset, suspended, or discontinued where reasonably necessary.
This may include leaderboard resets resulting from major gameplay changes, testing phases, balancing changes, technical migrations, or the transition between development versions.
8. Termination
8.1 Termination for Breach
The Developer may terminate or restrict the license granted under this EULA if you materially violate this Agreement, subject to applicable law.
8.2 Effect of Termination
Upon effective termination of your license, you must cease using the Software and, where applicable, uninstall or delete copies of the Software in your possession.
Rights and provisions which by their nature are intended to survive termination shall remain effective.
9. Privacy and Data Processing
Professional Ship Simulator may process data necessary to provide gameplay functionality, online features, statistics, leaderboards, technical services, and related features.
Where applicable, additional information concerning the processing of personal data is provided in the Developer's Privacy Policy.
For Steam-related functionality, certain information may also be processed by Valve Corporation under Steam's own terms and privacy policies.
The Developer's public leaderboard functionality is intended to use only information reasonably necessary for displaying player rankings, such as Steam display names, Steam avatars, ranks, and gameplay statistics.
10. Miscellaneous
10.1 Governing Law
This Agreement shall be governed by the laws of the Federal Republic of Germany, to the extent that such a choice of law is legally permissible.
Mandatory consumer protection provisions applicable in the User's country of residence remain unaffected where required by law.
10.2 Severability
If any provision of this EULA is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
10.3 Changes to this EULA
The Developer may update this EULA where reasonably necessary, including due to changes in the Software, online services, legal requirements, or technical functionality.
Material changes will be communicated or made available through appropriate official channels where required.
