DECK COLLECTOR End-User License Agreement (“EULA”)

1. INTRODUCTION
1.1. Hello fellow collectors! This is AEROBORN Games’ rules on what You may and may not do with the Game, DECK COLLECTOR.
1.2. Firstly, You must be at least 18 years old, or at least the minimum legal adult age in Your country of residence to approve these Terms. If You are younger than the preceding age limits, You must ask Your parent or guardian to review and approve these Terms.
1.3. This EULA is a legal agreement between You and AEROBORN Games regarding Your usage of DECK COLLECTOR. Please carefully read the entirety of this Agreement to completion before agreeing.
1.4. By downloading, installing, or using DECK COLLECTOR, You acknowledge that You have read the entirety of this Agreement, understood it, and agree to be bound by the Terms and conditions of this EULA.
2. GLOSSARY
2.1. “Agreement” refers to this EULA.
2.2. “Content” refers to images, videos, Mods, or publications.
2.3. “Game” refers to the game DECK COLLECTOR.
2.4. “Mods” refers to adding, creating, or modifying new or preexisting 3D models, images or textures to be used in DECK COLLECTOR.
2.5. “Terms” refers to the individual conditions, obligations, and rules outlined in this legally binding Agreement.
2.6. “Us”, “We” or “Our(s)” refers to AEROBORN Games, the developer and owner of DECK COLLECTOR.
2.7. “User” refers to the individual who downloaded this Game.
2.8. “You” or “Your(s)” refers to the User that is playing the Game and using the software in a way outlined in this Agreement.
3. USAGE OF THE GAME
3.1. Subject to Your agreement and compliance with this EULA, AEROBORN Games grants You a non-exclusive, non-transferable, revocable license to use DECK COLLECTOR subject to the Terms of this Agreement. We own the Game, and We are giving You the right (license) to use it. The license cannot be exclusive since We can grant it to others.
3.2. You may record video and audio from DECK COLLECTOR and use it for streaming or create pre-recorded videos to share online and receive monetized ad revenue. Your Content is Your sole responsibility, not Ours.
3.3. You may develop Mods subject to the Terms outlined in section 5.
3.4. Seizure Warning. There is an effect within the Game where if a card deemed as high value is revealed, a quick exposure effect is played. If You or anyone in Your household has a history of epilepsy, please consult a doctor before playing DECK COLLECTOR. If You experience dizziness,loss of awareness, disorientation, blurred vision, eye or muscle twitching, involuntary movements, or seizures while playing, stop immediately and seek medical advice from a doctor. The exposure effect is toggled off by default when initially installed and may be toggled on in the settings page within the Game.
3.5. Although DECK COLLECTOR isn’t a large open world game with exotic mountains, animations, and thousands of detailed 3D models within a scene, there are minimum system requirements You must adhere to in order to use the Game. Ensure Your desired device or platform meets those requirements outlined on the DECK COLLECTOR Steam store page.
4. RESTRICTIONS
4.1. There are some strict rules We must outline. You may not:
4.1.1. Decompile, disassemble, reverse engineer, translate, derive source code, or modify the base files of the Game, or attempt to perform the foregoing in any way;
4.1.2. create or redistribute Mods that breach the Terms of this Agreement in section 5;
4.1.3. copy, reproduce, gift, sub-license, rent, or loan portions or the entirety of the Game;
4.1.4. use intellectual property from within the Game to create derivatives of it without the explicit and written approval from Us;
4.1.5. create Content that looks or is deemed “official” or endorsed by AEROBORN Games;
4.1.6. create Content that is blatantly offensive or harmful to any users (for example, but not limited to, Content that contains racism, homophobia, terrorism, bigotry, hate speech, pornography, defamation, abuse, discrimination);
4.1.7. create Content that infringes on the intellectual property of third parties without their explicit and written approval;
4.1.8. transfer, assign, or sub-license this license, or attempt to perform the foregoing, to any other party unless We provide prior written consent.
5. MODDING
5.1. We permit Mods and are generally easy-going with regards to Mods as long as You don’t:
5.1.1. create or redistribute Mods that look or are deemed as “official” or endorsed by AEROBORN Games;
5.1.2. create or redistribute Mods that infringe on the intellectual property rights of its respective owners without their explicit and written permission;
5.1.3. create or redistribute Mods that are harmful to the User (for example, but not limited to, Mods that incorporate racism, homophobia, terrorism, bigotry, hate speech, pornography, defamation, abuse, discrimination);
5.1.4. create or redistribute Mods for commercial purposes or exchange for compensation (for example, but not limited to, exchange Your Mods for money, gift cards, lottery tickets, football tickets, opera tickets).
5.2. There are a few more things We must outline regarding Mods:
5.2.1 What Mods You create, are Yours.
5.2.2. Any Mods You develop or Your usage of Mods within the Game are Your sole responsibility. AEROBORN Games takes no responsibility for Your Mods, whether created by You or others - We do not review or endorse any Mods, nor do We guarantee their safety or functionality.
5.2.3. The Game will have frequent updates to further enhance the Game and to add new features. This means that any future update may cause current or previously made Mods to become incompatible with the updated version. This is unfortunate, however We cannot be held responsible for Mods that become unstable or unusable as an outcome due to the updates.
5.2.4. Mods are considered derivative works, and if You desire to develop Mods, You agree that they are subject to the Terms of this Agreement.
5.2.5. AEROBORN Games reserves the right to remove or disable any Mods that violate this EULA, harm the Game’s integrity, or otherwise pose a legal or safety risk.
5.2.6. There are no official Mods for AEROBORN Games.
6. TERMINATION
6.1. This EULA is effective until terminated by either You or Us.
6.2. AEROBORN Games may terminate Your access to DECK COLLECTOR at any time if You violate any provision within this EULA. If a violation occurs, We will make a reasonable effort to contact You and thoroughly explain the violation before taking any action. However, in cases of severe or repeated violations, We reserve the right to take immediate action without prior notice. Upon termination, You must cease using the Game and delete all files that were installed by the Game.
6.3. You may also terminate this Agreement on Your own behalf at anytime for any reason by stopping Your usage of the Game, and deleting all files that were installed by the Game. In this situation, by You terminating the Agreement Yourself, it will not affect Your preexisting rights or obligations to Us or You.
7. AMENDMENT
7.1. We may amend this EULA occasionally if deemed necessary or appropriate (improvements or legal changes due to applicable law), as We reserve that right. It is recommended You return to this EULA to view any updates or changes. Insignificant and minor changes should not impact You. More in-depth and significant changes to this EULA will be made readily available and will take effect within a reasonable time frame. You will be notified within a reasonable time frame by either a notification within the Game or on the Game’s Steam page.
7.2. If any changes to this EULA occur, and You consider the change unacceptable or You cannot comply with the updated Agreement, You must terminate this Agreement subject to section 6.3.
7.3. Your continued use of the Game constitutes acceptance of the updated Terms.

8. DISCLAIMERS AND LIMITATION OF LIABILITY
8.1. DECK COLLECTOR is provided “as is,” without warranties of any kind, either expressed or implied, and not for a future update of the finalized stable version.
8.2. The Game is currently, and until further notice, in “Early Release Mode.” This allows Us to release the Game as a playable state for You to use and to test its features and performance. This also means that the stable final version has not yet been completed and released, and that there may be bugs or errors that haven’t been found yet in the Early Release Mode version. AEROBORN Games does not guarantee that the Game will be free of bugs or errors;
8.3. AEROBORN Games is not liable for any damages arising from Your use or inability to use the Game, including loss of data, game progress, in-game items, or any other disruptions to the player's experience.
8.4. AEROBORN Games is not responsible or liable for anything affecting DECK COLLECTOR that is beyond Our reasonable control.
8.5. We would like to hear about any bugs or issues You are experiencing within the Game. Please get in touch with Us at aeroborngames@gmail.com and We may be able to assist You.
9. INDEMNIFICATION
9.1. You agree to indemnify, defend, and hold harmless AEROBORN Games, its licensors, agents, affiliates, and partners from and against any and all claims, suits, liabilities, damages, losses, costs, or expenses (for example, but not limited to, reasonable court fees, attorneys' fees, and expert witness’ fees) arising out of or related to:
9.1.1. Your use or misuse of the Game;
9.1.2. Any breach or violation of this EULA by You;
9.1.3. Any infringement or misappropriation of intellectual property, privacy rights, trademarks, copyrights, or any other rights of a third party caused by Your actions within or related to the Game;
9.1.4. Any modifications, distributions, or unauthorized alterations made by You to the Game, including, but not limited to, any Content that results in harm to other users or AEROBORN Games’ reputation;
9.1.5. Any disputes or conflicts between You and other users arising from interactions relating to the Game.
9.2. You acknowledge that AEROBORN Games is not responsible for the actions of third parties and that You will not hold Us liable for any claims or damages arising from Content created or shared by other users. This indemnification obligation will survive the termination of this Agreement and Your use of the Game.
10. GOVERNING LAW
10.1. We love the fact that video games can be shared around the world. We understand that some countries have different laws when compared to DECK COLLECTOR’s place of origin. Your local laws may grant You rights that override certain Terms of this EULA. The length of the legal limit outlined in this EULA applies to the length of Your countries laws.
10.2. To the extent permitted by applicable law, this Agreement will be governed by and construed in accordance with the laws of the United States of America and the State of Indiana, without reference to principles of conflicts of law. Any disputes or legal claims arising from this Agreement will be resolved through arbitration or the courts of Indianapolis, Indiana, United States of America.
11. SEVERABILITY
11.1. If any provision of this EULA is to be held unenforceable, that provision will be severed from this Agreement, and the remainder of this EULA will remain in full effect. The failure of any provision will not affect the validity and enforceability of the remainder of this Agreement.

12.1. That’s it! We are not a fan of long, sleep-inducing rules. However, We are a fan of protecting ourselves, players, and Our community. These rules exist for a purpose!
