End User License Agreement (EULA)
This product is created by an individual indie game enthusiast using tools such as Unreal Engine. Players are requested to comply with the following agreement:
Definitions
"Product": Refers to the software product covered by this Agreement, including any related documentation, data files, code, materials, and information.
"Unreal Engine": Refers to the Unreal® Engine and its related components, code, materials, and information (collectively referred to as "Epic Materials") developed and provided by Epic Games, Inc. ("Epic").
"Standard License": Refers to the standard license provided by Epic Games, Inc. for assets available on the Unreal Engine Marketplace. The terms and conditions of this license can be accessed through the following link: https://www.fab.com/eula.
Grant of License
This Agreement grants you ("End User") a limited license to use the Product, subject to your acceptance and compliance with all terms and conditions of this Agreement.
Disclaimer and Limitation of Liability for Unreal Engine and Related Materials
3.1 Provision of Unreal Engine "As Is"
The Product includes Unreal Engine code and other materials (collectively referred to as "Epic Materials") from Epic Games, Inc. All Epic Materials are provided "as is" and "as available," with all defects and without any form of warranty. The Licensor, Epic, and their affiliates disclaim all warranties, conditions, common law obligations, and representations (whether express, implied, oral, or written) regarding the Epic Materials, including but not limited to all express, implied, and statutory warranties and conditions, such as title, non-interference with your use, authorization, non-infringement, merchantability, fitness for any purpose (whether Epic is aware or has reason to be aware of such purpose), system integration, accuracy or completeness, results, due care, quality of work, freedom from negligence, and absence of viruses.
3.2 Operation and Functionality Disclaimer
The Licensor, Epic, and their affiliates do not warrant that:
The Epic Materials (including when integrated into the Product) will operate normally;
The Epic Materials will meet your requirements;
The operation of the Epic Materials will be uninterrupted, error-free, or fault-free in any or all circumstances;
Any defects in the Epic Materials will be or can be corrected;
The Epic Materials comply with the rules or requirements of platform manufacturers;
Platform manufacturers have approved or will approve the Product, or will not revoke approval of the Product for any or no reason.
3.3 Infringement Warranty Disclaimer
The Licensor and Epic expressly disclaim any infringement warranties that may be provided under Section 2-312 of the Uniform Commercial Code or any other similar regulations.
3.4 Continuous Operation and Security
The Licensor, Epic, and their affiliates do not warrant the continuous, error-free, virus-free, or secure operation or access of the Epic Materials.
3.5 Applicability of Law
This section applies to the fullest extent permitted by applicable law.
Limitation of Liability
4.1 General Limitation of Liability
To the fullest extent permitted by applicable law, the Licensor, Epic, Epic's licensors, and their affiliates, as well as any service providers of the Licensor or Epic, shall not be liable for any losses or damages arising from the use or inability to use the Epic Materials or in connection with this Agreement (including but not limited to loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial loss). In no event shall the Licensor, Epic, Epic's licensors, and their affiliates, or any service providers of the Licensor or Epic, be liable for any loss of profit or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages related to this Agreement or the Epic Materials, or the delay, inability to use, or malfunction of the Epic Materials, even if the Licensor, Epic, or Epic's affiliates were negligent, committed tort (including negligence), were strictly liable, had indemnity liability, product liability, breach of contract, breach of warranty, or in any other circumstances, even if the Licensor, Epic, or Epic's affiliates were informed of the possibility of such damages.
4.2 Legal Restrictions
Since some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of the Licensor, Epic, Epic's licensors, and their affiliates, as well as any service providers of the Licensor or Epic, shall be limited to the fullest extent permitted by law.
Free Assets from the Unreal Engine Marketplace
Some assets included in the Product are free assets from the Unreal Engine Marketplace, licensed under the Standard License. The terms of this license can be found at the following link: https://www.fab.com/eula.
5.1 Liability for Violation of the Standard License
The free assets included in this Product are subject to the Epic Standard License, and users must comply with its terms. Any violation of the Standard License (such as illegal resale or reverse engineering) shall be the legal responsibility of the user, and the Licensor shall not bear any joint liability.
