IMPORTANT – READ CAREFULLY
This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Nuclear Kitty Games (“Licensor,” “we,” or “us”) regarding your use of the video game software product, including all related documentation, updates, and supplemental content (collectively, the “Software”).
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.
1. Grant of License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for your own personal, non-commercial entertainment purposes on a compatible device. You do not acquire any ownership rights in the Software.
2. Restrictions
You may not:
Modify, adapt, translate, reverse engineer, decompile, or disassemble the Software except as permitted by applicable law.
Sell, rent, lease, sublicense, distribute, or otherwise exploit the Software for commercial purposes.
Remove, alter, or obscure copyright, trademark, or other proprietary notices.
Use the Software for any unlawful purpose.
3. Ownership
The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all copyrights, trademarks, and intellectual property, remain with Nuclear Kitty Games or its licensors.
4. Updates and Patches
We may provide updates, patches, or modifications to the Software that must be installed for continued use. We may update the Software automatically without notice through Steam or other distribution platforms.
5. User-Generated Content (if applicable)
If the Software allows you to create, upload, or share content (“UGC”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such UGC in connection with the Software. You are solely responsible for your UGC and must not infringe the rights of others.
6. Termination
This Agreement is effective until terminated. It will automatically terminate without notice if you fail to comply with its terms. Upon termination, you must cease all use of the Software and destroy all copies.
7. Disclaimers
THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE SOFTWARE.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts located in London, United Kingdom.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and us concerning the Software and supersedes all prior or contemporaneous understandings.
