This End User License Agreement ("Agreement") governs your use of the software application Azmar Quest ("Licensed Application"). The Licensed Application is licensed to You (End-User) by Sevan Soukiassian, located and registered at Viale Repubblica, 160, Sacile, PN 33077, Italy ("Licensor"). Our VAT number is 01975920933.

This license is granted for use only under the terms of this Agreement, specifically for the version of the Licensed Application distributed via the Steam platform operated by Valve Corporation ("Steam").

By installing, copying, or otherwise using the Licensed Application obtained through Steam, You indicate that You agree to be bound by all of the terms and conditions of this Agreement, and that You accept this Agreement. You also acknowledge that your use of the Steam platform is governed by the Steam Subscriber Agreement.

The parties of this Agreement acknowledge that Steam (Valve Corporation) is not a Party to this Agreement (between You and Licensor) and is not bound by any provisions or obligations with regard to the Licensed Application itself, such as application-specific warranty, liability, maintenance, and support thereof, beyond its role as a distribution platform and subject to the Steam Subscriber Agreement. Sevan Soukiassian (Licensor), not Steam, is solely responsible for the Licensed Application and the content thereof.

This Agreement may not provide for usage rules for the Licensed Application that are in conflict with the Steam Subscriber Agreement or other applicable Steam policies ("Steam Terms"). Licensor acknowledges that it had the opportunity to review the Steam Terms and this Agreement is not intended to conflict with them. Where a conflict exists, the Steam Terms may supersede this Agreement regarding platform usage.

Azmar Quest, when purchased or downloaded through Steam, is licensed to You for use only under the terms of this Agreement. The Licensor reserves all rights not expressly granted to You. Azmar Quest is intended for use on personal computers that operate with supported operating systems as specified on the Steam store page.

Azmar Quest ("Licensed Application") is a piece of software created to Provide a text-based RPG experience with turn-based battles and old-school vibes, allowing players to immerse themselves in a rich story, fight in PvP, explore dungeons, and enjoy hours of additional content. — designed for personal computers ("Computers"). It is used to Offer a single-player RPG adventure lasting at least 20 hours, featuring turn-based combat, character progression, and additional content like PvP and dungeon exploration.

The Licensed Application is not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use this Licensed Application. You may not use the Licensed Application in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

2.1 You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on Computers that You (End-User) own or control, as permitted by this Agreement and the Steam Terms, including features like Steam Family Library Sharing where applicable and allowed by Licensor and Steam.

2.2 This license will also govern any updates or patches for the Licensed Application provided by Licensor that replace, repair, and/or supplement the original Licensed Application, unless a separate license is provided for such update, in which case the terms of that new license will govern.

2.3 You may not share or make the Licensed Application available to third parties (except as permitted by Steam Terms like Family Library Sharing, if applicable, and with Sevan Soukiassian's explicit allowance for such features), sell, rent, lend, lease, or otherwise redistribute the Licensed Application outside the mechanisms provided by Steam.

2.4 You may not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Licensed Application, or any part thereof (except as permitted by applicable law or with Sevan Soukiassian's prior written consent).

2.5 You may not copy (excluding installation onto your authorized Computers and one backup copy expressly permitted by this license and the Steam Terms) or alter the Licensed Application or portions thereof. You may create and store backup copies only on devices that You own or control under the terms of this license and applicable Steam Terms. You may not remove any intellectual property notices. You acknowledge that no unauthorized third parties may gain access to these copies at any time. If you transfer ownership of your Computer(s) to a third party, you must uninstall the Licensed Application before doing so.

2.6 Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.

2.7 Licensor reserves the right to modify the terms and conditions of this license agreement for future updates or versions of the Licensed Application.

2.8 Nothing in this license should be interpreted to restrict third-party terms. When using the Licensed Application, You must ensure that You comply with applicable third-party terms and conditions, including the Steam Subscriber Agreement.

3.1 Licensor attempts to keep the Licensed Application updated so that it functions with supported operating systems and hardware configurations as listed on the Steam store page. You are not granted rights to demand updates for compatibility with future, unlisted operating systems or hardware.

3.2 You acknowledge that it is Your responsibility to confirm and determine that the Computer on which You intend to use the Licensed Application satisfies the minimum technical specifications published on the Steam store page.

3.3 Licensor reserves the right to modify the minimum technical specifications as it sees appropriate for future updates of the Licensed Application.

4.1 The Licensor is solely responsible for providing any maintenance and support services specific to the Licensed Application itself. You can reach the Licensor for application support at the email address listed in the Contact Information section below.

4.2 Sevan Soukiassian and the End-User acknowledge that Steam has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application itself. Support for the Steam platform is governed by the Steam Subscriber Agreement and Steam's support channels.

You acknowledge that Licensor will be able to access and adjust Your downloaded Licensed Application content and Your personal information as related to the game (e.g., save files, profile data), and that Licensor's use of such material and information is subject to Your legal agreements with Licensor and Licensor's privacy policy: https://azmar-online-eu.web.app/privacy-policy.html.

You acknowledge that the Licensor may periodically collect and use technical data and related information about your device, system (including operating system), application software, and peripherals, to offer product support, facilitate software updates, and provide other services (if any) related to the Licensed Application. Licensor may also use this information, in a form that does not personally identify you, to improve its products or provide services or technologies.

The Licensed Application invites you to communicate and share content through features including, but not limited to, a global chat and a friend system. It may also invite you to contribute to, or participate in blogs, message boards, online forums, and other functionality (including potentially through Steam Community features linked to the Application). These features may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or within the Licensed Application, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Licensed Application and potentially through third-party websites or applications (like the Steam Community). As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

1. The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
2. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Licensed Application, and other users of the Licensed Application to use your Contributions in any manner contemplated by the Licensed Application and this Agreement.
3. You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness or each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Licensed Application and this Agreement.
4. Your Contributions are not false, inaccurate, or misleading.
5. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
6. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us or as prohibited by Steam Community guidelines if applicable).
7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
8. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
9. Your Contributions do not violate any applicable law, regulation, or rule.
10. Your Contributions do not violate the privacy or publicity rights of any third party.
11. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
12. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
13. Your Contributions do not otherwise violate, or link to material that violates, any provision of this Agreement, the Steam Subscriber Agreement, Steam Community Guidelines, or any applicable law or regulation.

Any use of the Licensed Application, including its chat and social features, in violation of the foregoing violates this Agreement and may result in, among other things, the suspension or termination of specific rights within the Licensed Application (such as the right to chat or participate in online features), or the termination or suspension of all your rights to use the Licensed Application, and potential reporting to Steam or relevant authorities if applicable.

By posting your Contributions to any part of the Licensed Application (or related services like forums managed by Licensor, or Steam Community Hubs linked to the Application subject to Steam's own terms) or making Contributions accessible by linking your account, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice if included) for any purpose related to the Licensed Application, commercial advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels. (Note: Contributions made solely through Steam features like Workshop or Community Hubs may also be subject to Steam's own licensing terms outlined in the Steam Subscriber Agreement).

This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions to the extent permitted by law, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions beyond the license granted above. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions, subject to the license granted herein and any applicable Steam terms. We are not liable for any statements or representations in your Contributions provided by you. You are solely responsible for your Contributions and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to recategorize any Contributions; and (3) to prescreen or delete any Contributions at any time and for any reason, without notice, particularly if they violate this Agreement or applicable laws/guidelines. We have no obligation to monitor your Contributions.

8.1 Licensor's responsibility in the case of violation of obligations and tort shall be limited to intent and gross negligence under the applicable law governing this Agreement. Only in case of a breach of essential contractual duties (cardinal obligations), Licensor shall also be liable in case of slight negligence. In any case, liability shall be limited to the foreseeable, contractually typical damages. The limitation mentioned above does not apply to injuries to life, limb, or health, or where liability cannot be limited under applicable mandatory law.

8.2 Licensor takes no accountability or responsibility for any damages caused due to a breach of duties according to Section 2 of this Agreement by You. To avoid data loss, You are encouraged to make use of backup functions if provided by the Licensed Application or your system. You are aware that in case of unauthorized alterations or manipulations of the Licensed Application, You may lose access to or impair the functionality of the Licensed Application.

9.1 Licensor warrants that the Licensed Application, at the time of Your download from Steam, is free of spyware, trojan horses, viruses, or any other malware known to the Licensor. Licensor warrants that the Licensed Application will perform substantially as described in the user documentation or Steam store page description under normal use on a compatible system.

9.2 No warranty is provided for the Licensed Application if it has been unauthorizedly modified, handled inappropriately or culpably, combined or installed with incompatible hardware or software not meeting minimum requirements, used improperly, or if defects arise from reasons outside of Sevan Soukiassian's reasonable sphere of influence.

9.3 You are encouraged to inspect/test the Licensed Application promptly after installation and notify Sevan Soukiassian about substantial defects discovered without undue delay via the email provided in Contact Information. The defect report will be considered and investigated if reported within a reasonable period after discovery (e.g., within any statutory warranty period applicable under governing law or specific period stated here if applicable: (Specify period if needed, e.g., 30 days, or rely on statutory default)).

9.4 If Licensor confirms that the Licensed Application is defective according to the warranty, Sevan Soukiassian reserves the choice, subject to applicable consumer laws, to remedy the situation either by providing a patch or update to solve the defect, or by providing substitute delivery (e.g., a corrected version).

9.5 Refunds: In the event of any failure of the Licensed Application to conform to any applicable warranty for which a remedy is not provided as above, or for other reasons, You may seek a refund directly from Steam. All refunds are handled exclusively by Steam according to the terms of the Steam Refund Policy. To the maximum extent permitted by applicable law, Steam will have no other warranty obligation whatsoever with respect to the Licensed Application beyond its refund policy. Any other losses, claims, damages, liabilities, expenses, and costs attributable to any failure to adhere to any warranty not covered by a Steam refund are the responsibility of the Licensor as outlined in this Agreement.

9.6 If the user is an entrepreneur/business entity, any claim based on defects may be subject to a shorter statutory period of limitation (e.g., twelve (12) months) after the Licensed Application was made available, as permitted by applicable law. The statutory periods of limitation provided by law apply for users who are consumers.

Sevan Soukiassian and the End-User acknowledge that Sevan Soukiassian (Licensor), and not Steam, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User’s possession and/or use of that Licensed Application, including, but not limited to:
(i) product liability claims related to the Licensed Application itself;
(ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and
(iii) claims arising under consumer protection, privacy, or similar legislation related specifically to the Licensed Application's content or function provided by Licensor.
(This does not include claims related to the operation of the Steam platform itself, billing, or delivery through Steam, which are Valve's responsibility under the Steam Subscriber Agreement).

You represent and warrant that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and that You are not listed on any U.S. Government list of prohibited or restricted parties.

The license granted by this Agreement is effective until terminated by Sevan Soukiassian or by You. Your rights under this license will terminate automatically and without notice from Sevan Soukiassian if You fail to adhere to any term(s) of this Agreement or the Steam Subscriber Agreement leading to revocation of access. Upon termination of the license, You shall cease all use of the Licensed Application and destroy all copies, full or partial, of the Licensed Application in your possession or control. Termination of this Agreement does not entitle you to a refund except as provided by the Steam Refund Policy.

Sevan Soukiassian represents and warrants that Licensor will comply with applicable third-party terms of agreement (including Steam Distribution Agreement terms) when providing the Licensed Application. You acknowledge that your use of the Licensed Application via Steam requires compliance with the Steam Subscriber Agreement and other applicable Steam policies, which govern your relationship with Valve Corporation regarding the use of the Steam platform.

Sevan Soukiassian and the End-User acknowledge that, in the event of any third-party claim that the Licensed Application or the End-User's possession and use of that Licensed Application infringes that third party's intellectual property rights, Sevan Soukiassian (Licensor), and not Steam, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claims related to the Licensed Application itself.

This Agreement is governed by the laws of Italy, excluding its conflicts of law rules. Mandatory consumer protection laws in your country of residence may also apply.

17.1 If any of the terms of this agreement should be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. Invalid or unenforceable terms will be replaced by valid, enforceable ones formulated in a way that achieves the primary purpose of the original term, or interpreted to the maximum extent enforceable under law.
17.2 Collateral agreements, changes, and amendments to this Agreement are only valid if laid down in writing (which may include digital acceptance of updated terms for future versions). The preceding clause regarding written form can only be waived in writing.
