PLEASE READ THIS END USER LICENCE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE. BY INSTALLING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE.

Welcome to the public demo of "Macabre" ("Software") developed by WEFORGE STUDIO PTY LTD ("Licensor," "we," "us," or "our"). This EULA governs your use of the Software and outlines the terms and conditions under which you may access and play the public demo of "Macabre".

WEFORGE STUDIO PTY LTD grants you ("Licensee") a non-exclusive, non-transferable, revocable licence to install and use the Software solely for the purpose of playing the public demo. This licence is granted to all users who download or otherwise lawfully acquire access to the Software.


3.1 General Restrictions
You may not:

• Reproduce, duplicate, copy, sell, resell, distribute, or otherwise exploit the Software for any commercial purposes.
  
• Modify, adapt, translate, or create derivative works based on the Software.
  
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software.
  
• Remove, alter, or obscure any proprietary notices or labels on the Software.

Note: Since this is a public demo, there are no non-disclosure or limited-participation restrictions. You are free to share your gameplay experiences, footage, and screenshots as you see fit.

To ensure optimal performance of "Macabre", your device should meet or exceed the following system requirements:

5.1 Conduct Guidelines
While using "Macabre", you may have access to in-game communication features such as text or voice chat. You agree to adhere to the following conduct guidelines:

• Respectful Behaviour: Do not use abusive, threatening, obscene, defamatory, or discriminatory language.
  
• No Harassment: Refrain from harassing, bullying, or intimidating other players.
  
• Protect Privacy: Do not share personal information, including your own or others’ real-world details.
  
• No Spam: Avoid spamming messages, advertisements, or unsolicited content.
  
• Prohibited Content: Do not share content that is illegal, offensive, or infringes on intellectual property rights.

5.2 Consequences of Misconduct
Violations of these conduct guidelines may result in:

• Warning messages.
  
• Temporary suspension of communication features.
  
• Termination or restriction of your user account.
  
• Permanent banning from the public demo.

5.3 Company Liability
WEFORGE STUDIO PTY LTD is not responsible for any content, messages, or interactions between users within the game. All user communications are the sole responsibility of the individuals involved.


6.1 Grant of Rights
If you provide WEFORGE STUDIO PTY LTD with any feedback, suggestions, or ideas regarding "Macabre" ("Feedback"), you hereby grant us a non-exclusive, royalty-free, irrevocable, perpetual licence to use, reproduce, modify, distribute, and incorporate such Feedback into "Macabre" or any other products or services.

6.2 No Obligation
WEFORGE STUDIO PTY LTD is not obligated to use any Feedback provided and may choose to implement it at our sole discretion.

"Macabre" may be accessible worldwide via the Steam platform. However, WEFORGE STUDIO PTY LTD does not warrant that the Software is lawful in every jurisdiction. It is the user's responsibility to ensure that accessing and using "Macabre" complies with all applicable local laws and regulations in their region.


8.1 Crash Logs
To improve the quality and performance of "Macabre", the Software may collect crash logs via the Unreal Crash Log Reporter. These crash logs may include details such as hardware specifications, system configurations, Steam ID, and other relevant data. This information is used solely for diagnosing and resolving technical issues related to the Software.

8.2 Crash Log Reporting to Third Parties
The collected crash logs are shared with Bugsplat, a third-party platform used to track and manage crash reports. By using the public demo, you consent to the transmission of your crash data to Bugsplat in accordance with their Privacy Policy and Terms of Service.

8.3 Analytics Tracking
Analytics tracking in "Macabre" is mandatory and cannot be disabled. By using the Software, you consent to the collection and analysis of usage data, which includes but is not limited to gameplay behaviour, feature usage, session durations, and other interaction metrics. This information helps us understand how players interact with "Macabre" and is used to inform game development decisions and improve overall functionality.

8.4 Consent to Data Collection
By installing and using "Macabre", you acknowledge and agree to the collection, use, and sharing of your data as described in this EULA and our Privacy Policy. If you do not agree to these terms, you must not install or use the Software.


9.1 Bugsplat Integration
"Macabre" integrates with Bugsplat for crash reporting purposes. By participating in the public demo, you agree to Bugsplat’s Privacy Policy and Terms of Service. Bugsplat may collect, store, and process the data as outlined in their policies.

9.2 Other Third-Party Services
The Software may incorporate additional third-party services and tools. Your use of these services is subject to their respective terms and privacy policies. The Licensor is not responsible for the practices or content of such third parties.


10.1 Account Creation and Security
To access certain features of the public demo, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

10.2 Prohibited Account Activities
You may not share, sell, transfer, or assign your account to any third party. Any attempt to do so may result in the suspension or termination of your account.


11.1 Payments
Access to the public demo of "Macabre" may be free or offered under specific promotional events. If the demo is offered at a cost or bundled with other purchases in the future, you agree to abide by any stated payment terms or refund policies at that time. Any paid access to "Macabre" on Steam is subject to Steam’s official refund policy.

11.2 Promotional Codes
If you receive any promotional codes or discounts related to this public demo, these are subject to specific terms and conditions outlined separately. Promotional codes may not be redeemed for cash or other forms of compensation unless explicitly stated.


12.1 Violation Warning System
WeForge Studio uses a tiered warning system to enforce this EULA fairly. Players who violate these terms may face the following actions:

• First Violation (Warning): A formal warning will be issued via in-game notifications or email.
  
• Second Violation (Temporary Restrictions): Temporary access restrictions (e.g., suspension of chat features, matchmaking limits, or temporary bans for up to 7 days).
  
• Repeated or Severe Violations (Permanent Restriction): Permanent restriction from the Macabre public demo.

12.2 Immediate Termination for Severe Violations
WeForge Studio reserves the right to immediately restrict or revoke your access to "Macabre" on Steam without prior warnings for severe infractions, including but not limited to:

• Cheating, hacking, or using third-party software to manipulate gameplay.
  
• Severe harassment, hate speech, threats, or abuse toward other players or developers.
  
• Exploiting game-breaking bugs for personal gain and refusing to report them.

12.3 Appeal Process
If you believe an enforcement action was incorrect or unfair, you may contact us at hello@weforgestudio.com to request a review.

12.4 Steam Account vs. Macabre Access
All restrictions or terminations apply solely to your access to "Macabre". WeForge Studio cannot terminate your overall Steam account, which remains subject to Steam’s separate terms and policies.

The Licensor may, from time to time, provide updates or upgrades to enhance the functionality of the Software. These updates or upgrades are subject to the terms of this EULA unless accompanied by a separate licence agreement.

The Licensor warrants that the Software will perform substantially in accordance with the accompanying documentation for a period of 30 days from the date of receipt. EXCEPT FOR THE FOREGOING WARRANTY, THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

In no event shall WEFORGE STUDIO PTY LTD be liable for any incidental, consequential, indirect, special, or punitive damages whatsoever arising out of or related to your use of the Software, even if advised of the possibility of such damages. WEFORGE STUDIO PTY LTD’s total liability under this EULA shall not exceed the amount you have paid, if any, for accessing the public demo.

You agree to indemnify, defend, and hold harmless WEFORGE STUDIO PTY LTD and its affiliates, officers, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Software or violation of this EULA.


17.1 Governing Law
This EULA shall be governed by and construed in accordance with the laws of Queensland, Australia. However, this agreement remains subject to mandatory consumer protection laws applicable in your jurisdiction, where required by law.

17.2 Informal Resolution
You agree that in the event of any dispute, controversy, or claim (collectively, "Claim") between you and the Licensor, you will first contact the Licensor at hello@weforgestudio.com and make a good-faith effort to resolve the dispute before resorting to more formal means of resolution, such as court action.


18.1 Ownership
All rights, title, and interest in and to "Macabre", including all related intellectual property rights, are owned by WEFORGE STUDIO PTY LTD. The Software is protected by international intellectual property laws.

18.2 Trade Mark Usage
You may not use any of our trade marks, service marks, or logos without our prior written consent.

18.3 DMCA Compliance
If you believe that any content within "Macabre" infringes upon your copyrighted work, please submit a DMCA notice to our designated agent:

20.1 Entire Agreement
This EULA constitutes the entire agreement between you and WEFORGE STUDIO PTY LTD regarding your use of "Macabre" and supersedes all prior or contemporaneous understandings, agreements, or communications, whether written or oral.

20.2 Severability
If any provision of this EULA is held to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

20.3 Non-Waiver
Our failure to enforce any provision of this EULA does not constitute a waiver of that provision or any other provision.

20.4 Assignment
WEFORGE STUDIO PTY LTD may assign or transfer its rights and obligations under this EULA without your consent. You may not assign or transfer your rights or obligations under this EULA without our prior written consent.

20.5 No Third-Party Beneficiaries
This EULA is for the sole benefit of the parties and their respective successors and permitted assigns. Nothing in this EULA is intended to confer any rights or remedies on any other person.


21.1 Licence Grant for Publicly Accessible Content
By creating, uploading, streaming, or otherwise distributing any content that features or depicts "Macabre" (including but not limited to gameplay videos, screenshots, livestreams, or clips) on publicly accessible platforms or channels (e.g., YouTube, Twitch, TikTok, Steam Community), you hereby grant WEFORGE STUDIO PTY LTD a worldwide, royalty-free, non-exclusive, sublicensable, and transferable licence to use, reproduce, distribute, modify (for formatting or length only), adapt, create derivative works from, publicly perform, and publicly display that content solely for the purpose of promoting or marketing “Macabre” or WEFORGE STUDIO PTY LTD. This licence applies only while your content remains publicly accessible, except that any promotional use already created (e.g., a trailer or social media post) may remain in circulation for a reasonable time thereafter. Where reasonably possible, WeForge Studio will credit or attribute content creators when their publicly shared content is used for promotional purposes (e.g., referencing their username or channel name in trailers or social media posts).

21.2 No Impact on Creator Monetisation
WEFORGE STUDIO PTY LTD will not interfere with your ability to monetise or otherwise earn revenue from your user-generated content under the terms of the respective platform(s). You acknowledge and agree that no additional compensation is due from WEFORGE STUDIO PTY LTD for using your publicly posted content for promotional use.

21.3 Waiver of Claims
To the maximum extent permitted by applicable law, you waive and agree not to assert any moral rights or other claims against WEFORGE STUDIO PTY LTD for using your publicly posted content in accordance with this Section.

21.4 Ownership of Underlying Intellectual Property
Except for the licence granted to us under Section 21.1, nothing in this EULA transfers ownership of any of your intellectual property rights in the content you create. However, you understand that your content may incorporate or depict elements of "Macabre", which is owned by WEFORGE STUDIO PTY LTD and is licenced to you under this EULA.
