So Far Up ( “Software Product” )

IMPORTANT - Please read the End User Licence Agreement (“EULA”) carefully before installing this Software Product. By installing, copying, and/or otherwise using the Software Product you agree to the terms of EULA that pertain to its use. Before installing this Software Product please make sure that your computer meets the minimum technical specifications for the proper operation of this Software Product. Refer to the software product’s store page on STEAM™ for minimum technical specifications.

This Software Product may contain flashing lights, bright lights, and fast-moving visuals that could potentially trigger seizures or discomfort for individuals with photosensitivity or other related conditions. If you experience any discomfort or health issues while using this Software Product, you should discontinue using this Software Product immediately and consult a doctor.

1. Legal Agreement

This EULA is a legal agreement between you and CLEANPIXELS, a trade name used by the developer of this Software Product, ("CLEANPIXELS" or "we") which governs your use of the Software Product. For the purposes of this EULA, references to the Software Product includes computer software owned by CLEANPIXELS and any associated media, any on-line or other documentation together with, to the extent not distributed with a separate licence agreement, any updates or patches to the original game software which are provided to you or which you may download. The terms and conditions of this EULA are without prejudice to any terms and conditions governing your use of any third party proprietary software product including without limitation any STEAM™ software, any Unreal® software, or any open source software that may be incorporated into any separate plugins, delivery systems or other software programs. Such third party proprietary software may be downloaded within the software package containing the Software Product and may be required in order to use certain features of this Software Product, which use may be subject to and conditional upon your acceptance and observance of their respective third party end user licence agreements.

Copyright and other intellectual property laws and treaties protect this Software Product. The Software Product is licensed, not sold.

2. Grant of Limited Non-Exclusive Licence

For so long as you are in compliance with the provisions of this EULA, CLEANPIXELS grants you the non-exclusive limited right and license to use this software. This license allows you to install and use the software only for your personal use. You may install and use it on multiple devices, provided that you own and control those devices.
You may not share, distribute, or make the software available to others, including through piracy or unauthorized copying. Any violation of these terms may result in the termination of this license.
This license does not grant you any ownership rights to the software. All rights not expressly granted remain with CLEANPIXELS and its licensors.

3. Restrictions

You are not permitted to :

(a) install or use the Software Product on a network server, multi-user setup, or remote access system for the purpose of distributing it to one or more computers on that network. Additionally, you may not share, copy, or make the Software Product available in any way that allows multiple users to access or use it simultaneously

(b) remove, bypass, or interfere with any security features or technical measures that regulate access to the Software Product or are intended to prevent copyright infringement or the violation of intellectual property rights

(c) alter, remove, obscure, or bypass any proprietary notices or labels embedded in or displayed by the Software Product

Additionally, you agree to follow all of the safety information, or other relevant notices included with the Software Product and in this EULA.

4. Termination

Without prejudice to any other rights, CLEANPIXELS may terminate this EULA immediately without notice if you fail to comply with the terms and conditions of this EULA. In the event of termination, you must destroy all copies of the Software Product and all of its component parts including any Software Product stored on the hard disk of any computer. You may also terminate the EULA at any time by uninstalling it from your hard drive or other applicable hardware. All provisions of this EULA relating to disclaimers or warranties and CLEANPIXELS’s proprietary rights shall survive termination.

5. Ownership

You own only the physical or digital copy of the Software Product, not the Software Product itself. CLEANPIXELS and/or its licensors shall at all times retain the ownership of their respective Software Products regardless of the format.

6. Limited Warranty

THIS SOFTWARE PRODUCT IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. CLEANPIXELS HAS MADE REASONABLE EFFORTS TO THE BEST OF THEIR ABILITY TO DEVELOP AND TEST THE SOFTWARE PRODUCT TO ENSURE IT FUNCTIONS AS INTENDED. THE SOFTWARE PRODUCT HAS BEEN TESTED ON THE DEVELOPER'S HARDWARE CONFIGURATION, BUT CLEANPIXELS DOES NOT GUARANTEE THAT IT WILL FUNCTION ERROR-FREE OR OPERATE WITHOUT INTERRUPTION ON ALL SYSTEMS DUE TO THE VARIABILITY OF HARDWARE AND SOFTWARE CONFIGURATIONS ACROSS DIFFERENT DEVICES. USE AT YOUR OWN RISK. USERS ARE RESPONSIBLE FOR ENSURING THEIR SYSTEM MEETS THE MINIMUM TECHNICAL SPECIFICATIONS PROVIDED ON THE SOFTWARE PRODUCT’S STORE PAGE ON STEAM™. CLEANPIXELS DOES NOT GUARANTEE THAT ANY ERRORS IN THE SOFTWARE PRODUCT WILL BE CORRECTED. HOWEVER, REASONABLE EFFORTS MAY BE MADE TO ADDRESS CRITICAL ISSUES WHERE POSSIBLE.

WITHOUT EXCEEDING IN WHAT IS JUST AND REASONABLE,

(a) CLEANPIXELS IS NOT LIABLE FOR ANY UNINTENDED DAMAGE TO YOUR COMPUTER, DATA, OR SOFTWARE RESULTING FROM THE USE OF THIS SOFTWARE PRODUCT, AS REASONABLE EFFORTS HAVE BEEN MADE TO ENSURE ITS PROPER FUNCTIONING.

(b) CLEANPIXELS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE INABILITY TO USE THIS SOFTWARE PRODUCT, WHICH INCLUDES, BUT IS NOT LIMITED TO, USER ERROR.

Refunds for this Software Product are subject to STEAM™’s refund policy, which generally allows refunds within 14 days of purchase and with less than 2 hours of playtime. Please check Steam™’s official refund policy for full details.


7. Miscellaneous

[7.1] Technical Support

For technical support, you may search for the Software Product on the Support page of STEAM™ to obtain the developer’s support email. CLEANPIXELS does not guarantee a response to any inquiries. Support is provided at CLEANPIXELS’s discretion.

[7.2] Amendments to EULA

CLEANPIXELS reserves the right to amend this EULA at any time, at its sole discretion, as necessary to comply with legal requirements, address security concerns, improve user experience, or reflect changes in the Software Product. However, such changes will not take effect for you until you have been notified of them through announcements on the Software Product’s STEAM™ page or other relevant channels. CLEANPIXELS will make reasonable efforts to notify you of such changes through the aforementioned channels, allowing sufficient time for you to review and consider them before they take effect.
If any such future changes to this EULA are unacceptable to you or cause you to no longer be in compliance with it, you may terminate this EULA in accordance with the Termination provisions outlined earlier. Your continued use of the Software Product after being notified of the changes to this EULA, having had the opportunity to review them, and after a reasonable period before they take effect, will constitute your acceptance of all such changes.


The following is an Epic Games disclaimer, required by Epic Games for Unreal® Engine use.


This Software Product includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Software Product, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Software Product, or will not revoke approval of this Software Product for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Epic. Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Epic, Epic’s licensors, nor its or their affiliates, nor any of Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Software Product, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Epic, Epic’s licensors, nor its or their affiliates, nor any of Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Software Product or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Epic, Epic’s licensors, its and their affiliates, and any of Epic’s service providers shall be limited to the full extent permitted by law.
