This "User License and Service Agreement" (hereinafter referred to as "this Agreement") is jointly concluded between you and meowspirit, and this Agreement has contractual effect. Please carefully read and fully understand all terms and conditions, especially the clauses that exempt or limit liability (hereinafter referred to as "Disclaimer Clauses"), clauses that restrict user rights (hereinafter referred to as "Restriction Clauses"), clauses that stipulate dispute resolution methods and judicial jurisdiction, and separate agreements for opening or using certain services. The aforementioned disclaimer, restriction, dispute resolution and jurisdiction clauses may be highlighted in bold, color-coded, or other reasonable ways to draw your attention. Please read the aforementioned clauses again before confirming your agreement to this Agreement or before using the game services.
By clicking agree, accept, or next, or by registering, installing, logging in, actually using and accepting meowspirit game services, you are deemed to have read and understood the signing of this Agreement, and agree to be bound by this Agreement. Unless you have read and accepted all terms of this Agreement, you have no right to use meowspirit game services. Your use of meowspirit game services is deemed as having read and agreed to sign this Agreement.
Due to the constantly changing users and market conditions, meowspirit has the right to supplement and revise this Agreement from time to time. Such changes will be announced on relevant pages regarding the fact of modification, and meowspirit has the right not to notify users individually. You should check and understand these changes in real time. If you do not agree with the revised Agreement, you should stop using or actively cancel related services. Otherwise, any login, viewing or other behaviors regarding related services will be deemed as your agreement to comply with the revised Agreement.
1. Definitions
Unless otherwise specified, the following terms have the following meanings in this Agreement:
1) Game Rules: Refers to user guidelines, player regulations, game announcements and notices regarding "Monmusu Girls: Autobattler" published and revised by meowspirit from time to time.
2) Online Game: Refers to the mobile game "Monmusu Girls: Autobattler" operated by meowspirit.
3) Game Services: Refers to various online operation services related to "Monmusu Girls: Autobattler" provided by meowspirit to you, including but not limited to community services related to meowspirit games.
4) You: Also referred to as "player" or "user," refers to natural persons authorized to use "Monmusu Girls: Autobattler."
5) Game Data: Refers to various data recorded by the server generated during your use of meowspirit games, including but not limited to character data, virtual item data, game logs, security logs and other data.
6) User Data: Refers to information registered by you in the real-name registration system, game data under your game account, and other information and data that you provide to meowspirit during your use of meowspirit game services or that meowspirit needs to collect based on security, user experience optimization and other considerations.
2. Game Account
1) You understand and agree that you need to bear responsibility for all actions taken under the game account you have the right to use and/or all actions taken through that account. Therefore, you should be responsible for and properly, correctly keep, use, and maintain your account and password, and take necessary and effective confidentiality measures for your account and password. You should bear any losses caused by loss, leakage, tampering, theft and other improper keeping, use, and maintenance that are not caused by our legal fault.
2) If you discover that someone else is impersonating or stealing your game account and password, or any other unauthorized use, you should immediately contact customer service. When contacting customer service, you should provide valid personal identity information consistent with your registered identity information. After meowspirit receives your valid request and verifies your identity, it will take corresponding measures based on specific circumstances (including but not limited to suspending the login and use of the account, etc.). You shall bear the losses caused to you and other users by meowspirit taking corresponding measures based on your request. If you do not provide valid identity information or the valid personal identity information you provide is inconsistent with the registered identity information, meowspirit has the right to refuse your request, and you shall bear the losses caused thereby.
3) The game account is the unique identifier that we authorize you to use for logging in and using meowspirit games and related services in accordance with this Agreement. Its ownership belongs to us, and you only enjoy the right to use the game account. You may not provide your game account to others for use in any way, including but not limited to not providing it to others for commercial use including but not limited to live streaming, recording, power leveling, and training through transfer, rental, lending, etc. Otherwise, you shall bear all legal consequences and responsibilities arising therefrom, and we have the right to take measures against your game account including but not limited to warnings, restricting or prohibiting the use of all or part of the functions of the game account, deleting the game account and game data and other related information, and account suspension until cancellation. All consequences caused thereby shall be borne by you.
4) If you need to cancel your game account, you can operate according to the account cancellation guidelines provided by the official "Monmusu Girls: Autobattler," and should ensure that you meet the relevant conditions for game account cancellation published by the official "Monmusu Girls: Autobattler," and agree to the game account cancellation agreement and other relevant rules published by the official "Monmusu Girls: Autobattler." We also particularly remind you that if you cancel your game account, the game virtual items and other value-added services under that game account (hereinafter also collectively referred to as "Game Benefits" for convenience of description) will also be cleared. Accordingly, before you cancel your game account, please ensure that you have properly handled the game benefits under that game account or that the relevant game benefits have been settled. Once you cancel your game account, if there are still game benefits under that game account at that time (including but not limited to game virtual items and other game value-added services that have been generated during the use of this game but have not yet expired or been used, and game benefits that may be generated in the future), you are deemed to voluntarily give up such game benefits, and meowspirit has the right to clear all game benefits under that game account. All consequences arising therefrom shall be borne by you.
3. Game Service Content
1) The specific content of the game services is provided by meowspirit based on the actual situation, including but not limited to: character setting, scene props, sound effects, graphics, various data values and their changing rules in the game, as well as other information content. The game may also include advertising services provided by meowspirit or third parties.
2) meowspirit may change the game service content, and you understand and agree that such changes may cause inconvenience or loss to your game experience, but as long as such changes do not substantially affect your core game experience, you should accept such changes.
3) You understand and agree that meowspirit needs to conduct regular or irregular maintenance of the game servers, and if such maintenance causes interruption of game services within a reasonable time, meowspirit does not need to bear any responsibility for this, but should try to give prior notice.
4. User Conduct Standards
1) You promise to use the game services in accordance with the law and this Agreement, and not to use the game services for any illegal or improper purposes.
2) You shall not engage in the following behaviors:
- Using plug-ins, cheats, automation software, bots, or other unauthorized third-party tools or services;
- Exploiting game vulnerabilities or errors for improper gain;
- Engaging in real money trading of virtual items;
- Publishing or transmitting illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable information;
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with any person or entity;
- Interfering with or disrupting the game services or servers;
- Attempting to gain unauthorized access to other users' accounts or any computer systems or networks;
- Engaging in any other conduct that may damage the game environment or other users' gaming experience.
3) If you violate the above provisions, meowspirit has the right to take measures including but not limited to warnings, temporary restrictions, permanent bans, account deletion, and legal action.
5. Intellectual Property Rights
1) All intellectual property rights in the game services, including but not limited to copyrights, trademark rights, patent rights, trade secrets, and other proprietary rights, belong to meowspirit or its licensors.
2) You may not copy, modify, distribute, sell, or create derivative works based on any part of the game services without authorization.
3) You retain ownership of any content you create and submit through the game services, but you grant meowspirit a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content.
6. Privacy Protection
1) meowspirit respects and protects your privacy. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal information.
2) You agree that meowspirit may collect and use your information in accordance with the Privacy Policy.
7. Virtual Items and Payment Services
1) The game may include virtual currencies, virtual items, or other virtual goods (collectively "Virtual Items"). Virtual Items have no real-world value and cannot be exchanged for real money or items of value.
2) When you purchase Virtual Items, you are purchasing a limited license to use such Virtual Items in the game. You do not own the Virtual Items.
3) All payments for Virtual Items are final and non-refundable, except as required by applicable law.
4) meowspirit reserves the right to modify, suspend, or terminate Virtual Items at any time.
8. Service Modifications and Termination
1) meowspirit reserves the right to modify, suspend, or terminate the game services at any time, with or without notice.
2) You may terminate your use of the game services at any time by ceasing to use the services and deleting your account.
3) Upon termination of the services or your account, your right to use the game services will immediately cease, and any Virtual Items associated with your account may be lost.
9. Disclaimer and Limitation of Liability
1) The game services are provided "as is" and "as available." meowspirit makes no warranties, express or implied, regarding the game services.
2) meowspirit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the game services.
3) meowspirit's total liability to you for all claims arising from or relating to the game services shall not exceed the amount you have paid to meowspirit for the game services in the twelve months preceding the claim.
4) Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless meowspirit and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the game services or violation of this Agreement.
11. Dispute Resolution
1) This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles.
2) Any disputes arising from or relating to this Agreement or the game services shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization].
3) You waive any right to participate in class action lawsuits or class-wide arbitration against meowspirit.
12. Miscellaneous
1) This Agreement constitutes the entire agreement between you and meowspirit regarding the game services and supersedes all prior agreements and understandings.
2) If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
3) meowspirit's failure to enforce any provision of this Agreement shall not constitute a waiver of such provision.
4) This Agreement may not be assigned by you without meowspirit's prior written consent, but may be assigned by meowspirit without restriction.
