Hatred: Legal Rules of Use
This free downloadable titled "Hatred " ("), lets You create custom levels/gameplay elements or improve your experience by using a copy of the Hatred game purchased by you.
All results of the use of any new game elements created using the tools for your own personal, non-commercial use, solely in connection with the applicable Product, subject to the terms and conditions of this Agreement.
PLEASE READ THIS STATEMENT CAREFULLY BEFORE DOWNLOADING AND USING THE HATRED. YOUR DOWNLOAD AND USE OF THE HATRED GAME CONSTITUTE YOUR ACCEPTANCE OF THESE TERMS OF USE (IN THIS AGREEMENT). IF YOU DO NOT ACCEPT THESE TERMS OF USE, DO NOT DOWNLOAD OR USE THEM.
1. RESTRICTIONS OF USE
The permits you to use the game and custom game elements for personal (non-commercial) use in connection with the Software (Hatred game). The use of the is subject to the following additional terms, conditions, and restrictions:
a) The Hatred game software elements including all materials (trademarks, names, proprietary rights, titles, computer code, audiovisual effects, themes, characters, character names, stories, dialog, settings, artwork, sound effects, musical works) shall remain the copyrighted property of Destructive Creations and/or its designee(s), and you shall take no action inconsistent with such title or ownership.
c) Custom Game Materials shall not contain modifications to any other executable files over what is allowed by the; they shall not contain software or code that would compromise the integrity of a system or the users game; they shall not contain password-protected files, viruses, malware, spyware or adware.
d) Custom Game Materials must be used only with the commercially released retail version of the Software. Using the pirated version of the software to create Custom Game Materials is forbidden.
e) Custom Game Materials cannot contain: libelous, defamatory, or other illegal materials; they cannot contain forbidden symbols such as the swastika, and other symbols considered as generally forbidden - they cannot contain materials that are scandalous such as sexual images or references to sexual acts (with minors, animals, rape, and other); they cannot incite racial or religious hatred and violence or generally they cannot spark a negative reaction in certain demographics and go beyond what is accepted in civilized communities. Those restrictions also refer to the multi-cultural character of the gaming/modding community that will mostly not accept any kind of forbidden materials.
All Custom Game Materials created with this cannot depict and refer in any way to any REAL EVENTS known widely from history or from any other actual events, such as war and other armed conflicts, racial and religious hatred and violence, natural and unnatural disasters, mass bombings and mass shootings, terrorist attacks, suicidal terrorist attacks, political events and assassinations, tragic events connected with murderers (no matter if serial or not), sexual or racial abuse, and any events that remained as a tragic mark in the lives of various communities. All Custom Game Materials cannot depict a real person without obtaining permission first.
Custom Game Materials cannot contain any trademarks, copyright-protected work or other property of third parties (without a valid license).
You shall comply with all applicable laws (of your and other countries) in connection with the Custom Game Materials created by you.
Any breach of those restrictions shall affect with the removal of such inappropriate Custom Game Materials.
f) All Custom Game Materials must contain a note that Destructive Creations is not the author of the Custom Game Materials: "THIS CUSTOM GAME MATERIAL IS NOT CREATED, GUARANTEED OR SUPPORTED BY THE DEVELOPER OF THE SOFTWARE AND ITS AFFILIATES."
g) If you are under 18 years old, you cannot use the to produce Custom Game Materials, as well as you cannot play the Hatred game.
All Custom Game Materials have to contain proper credits to the authors of the Custom Game Materials.
NOTE:
If you breach any of the above terms, conditions, and restrictions of use of The Hatred, and if you also breach the Steam Subscriber Agreement (or Terms and Conditions and Restrictions of other modding networks), then your Custom Game Materials will be removed immediately without notice, and your Steam account (or another modding account) may be blocked if the breach is very radical (that will depend on modding network owners decision).
2. GRANT OF LICENSE & WAIVER
If you distribute or otherwise make available Custom Game Materials, you automatically grant to Destructive Creations the irrevocable, perpetual, royalty free, non-exclusive, sublicensable right and license (under all applicable copyrights and intellectual property rights laws) to use, reproduce, modify, adapt, perform, display, distribute and otherwise exploit and/or dispose of the Custom Game Materials (or any part of the Custom Materials) in any way Destructive Creations, or its respective designee(s), sees fit.
You also waive and agree never to assert against Destructive Creations or its affiliates, distributors or licensors any moral rights or similar rights, however designated, that you may have in or to any of the Custom Game Materials.
3. WARRANTY DISCLAIMER
Hatred is provided "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FIT FOR A PARTICULAR PURPOSE AND INFRINGEMENT. USE OF THE HATRED AND ANY CUSTOM GAME MATERIALS IS AT YOUR SOLE RISK AND YOU ASSUME ALL RISKS ASSOCIATED WITH THE PERFORMANCE OF THE ON YOUR MACHINE.
4. INDEMNIFY
You agree to indemnify, defend and hold Destructive Creations, its partners, licensees, affiliates, contractors, officers, directors, employees, and agents harmless from all damages, losses, and expenses arising directly or indirectly from your acts and omissions to act in using the Hatred pursuant to the terms of this Agreement.
5. INCORPORATION OF ADDITIONAL TERMS
In addition to the terms of this Agreement, any use of the Hatred is also governed by the terms and conditions of the Steam network available at: http://store.steampowered.com/subscriber_agreement
If you use other external modding platforms, You should also be aware that use of the is based on the same rules as stated in this Hatred EULA. You should also comply with the terms, conditions, and restrictions of external modding platforms before using the Hatred in them.
If you make Custom Game Material available to others through your use of the Steam Workshop (or other external modding platforms) as a Workshop Contribution, You may participate in any applicable Steam (or another external modding platform) programs for commercial distribution of your Workshop Contribution, subject to all the terms and conditions of the Steam Workshop and external modding platforms.
6. DIVISIBILITY
If any of the conditions or terms in this Agreement is considered illegal, invalid, or inapplicable, the condition or term shall be deleted without prejudice to the application of the other provisions.
7. AMENDMENT OF THE TERMS AND CONDITIONS AND RESTRICTIONS OF HATRED USE:
Destructive Creations reserves the right, at any time, to amend the contents of the General Conditions of use of Hatred to keep them up to date. The date of the last update at the bottom of these Terms and Conditions and Restrictions will indicate whether there have been any recent amendments. Amendments to the General Conditions of Hatred use apply by right from the date of their publication on the Website.
If you commit any breach of this Agreement, your right to use the under this Agreement shall automatically be terminated, without notice.
