END USER LICENSE AGREEMENT (EULA)

INTRODUCTION
This End User License Agreement ("EULA") is a legal agreement between you ("you", "user") and Truth Arts Inc., a Delaware corporation with a principal business address at 333 SE 2ND AVE STE 2000, MIAMI, FL 33131. This EULA governs your access to and use of the software titled "Goblintown: Really Hard Driving Game" (the "Game"), whether obtained via physical copy, digital download, or through authorized platforms such as Steam or Epic Games Store.
1. LICENSE GRANT
Truth Arts Inc. grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Game for personal, non-commercial purposes only, subject to compliance with this EULA. This license does not grant ownership rights or any intellectual property rights in the Game.
2. OWNERSHIP
All rights, title, and interest in and to the Game, including all content, artwork, audio, code, and trademarks, are owned by Truth Arts Inc. or its licensors. This EULA does not convey to you any ownership interest in the Game.
3. RESTRICTIONS
You may not:
- Modify, reverse engineer, or create derivative works of the Game;
- Circumvent or disable security features;
- Distribute, sublicense, rent, lease, or publicly display the Game;
- Use the Game for commercial purposes without written consent;
- Use cheats, bots, hacks, or other unauthorized third-party tools.
4. ONLINE FEATURES AND DLC
The Game may include or support online services, downloadable content, and optional purchases. These services may be updated, suspended, or terminated at any time. Truth Arts reserves the right to modify or disable such features without notice.
5. MODDING AND USER-GENERATED CONTENT
Mods or user-generated content (UGC) may be supported in future versions of the Game. All UGC must comply with applicable laws and Truth Arts' content guidelines. Truth Arts reserves the right to approve, restrict, or remove mods at its discretion. Commercial use of UGC requires prior written approval.
6. TERMINATION
This EULA is effective until terminated. Your rights under this license will terminate automatically if you breach any terms of this EULA. Upon termination, you must uninstall and destroy all copies of the Game.
7. WARRANTY DISCLAIMER
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUTH ARTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUTH ARTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATING TO THIS EULA OR THE USE OF THE GAME.
9. GOVERNING LAW AND DISPUTE RESOLUTION
This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflicts of law principles. Any dispute arising under or related to this EULA shall be subject to the exclusive jurisdiction of the courts located in Delaware, USA.
10. UPDATES AND MODIFICATIONS
Truth Arts reserves the right to update or modify this EULA at any time. Continued use of the Game after such modifications constitutes your acceptance of the revised terms.
11. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and Truth Arts concerning the Game and supersedes all prior or contemporaneous communications and proposals.
12. ACCOUNT REQUIREMENTS
To access and play the Game, you must have a valid account on an authorized platform, such as Steam or the Epic Games Store. You agree to comply with the terms of service of the platform on which you access the Game. Truth Arts is not responsible for any issues related to platform accounts, including access restrictions, bans, or security breaches.
13. RULES OF CONDUCT
You agree to use the Game in a manner that is respectful and lawful. You shall not:
- Harass, threaten, or abuse other users;
- Impersonate any person, company, or entity;
- Use cheats, automation software, bots, or any unauthorized third-party tools;
- Upload or share content that is offensive, obscene, or unlawful;
- Attempt to gain unauthorized access to servers or services.
14. DATA COLLECTION AND PRIVACY
By playing the Game, you agree that Truth Arts may collect and use certain aggregated, anonymized data regarding your gameplay, performance metrics, and usage behavior. This information is used solely to improve the quality, stability, and features of the Game. No personally identifiable information will be collected or stored without your explicit consent, and all data will be handled in accordance with applicable privacy laws and platform policies.
15. EXPORT CONTROL COMPLIANCE
You agree to comply with all applicable U.S. and international export and re-export control laws and regulations. You represent that you are not located in a country that is subject to U.S. government embargo or designated as a 'terrorist supporting' country, and you are not listed on any U.S. government list of prohibited or restricted parties.
16. THIRD-PARTY SERVICES AND SOFTWARE
The Game may incorporate or utilize third-party software, APIs, or services. Such components are subject to their own licenses. Truth Arts is not responsible for the availability or performance of third-party services.
17. DISPUTE RESOLUTION AND ARBITRATION
Any dispute arising from or relating to this EULA shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration.
18. SEVERABILITY AND WAIVER
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any breach or default shall be deemed a waiver of any subsequent breach or default.
