End User License Agreement (EULA)
IMPORTANT: This End User License Agreement ("Agreement") is a legal contract between you (either an individual or a single entity) ("Licensee") and the owning entity of "Void Observation" ("Licensor"), the creator of the software ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.
1. Grant of License Licensor grants Licensee a non-exclusive, non-transferable, limited license to use the Software for personal or internal business purposes only, subject to the terms of this Agreement.
2. Warranty Disclaimer THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE UNINTERRUPTED, OR BE ERROR-FREE.
3. Limitation of Liability IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSEE AGREES NOT TO MAKE ANY CLAIMS AGAINST LICENSOR ARISING FROM THE USE OF THE SOFTWARE.
4. No Claims LICENSEE AGREES NOT TO MAKE, AND HEREBY WAIVES, ANY CLAIMS AGAINST LICENSOR, WHETHER IN TORT, CONTRACT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS AGREEMENT.
5. Jurisdictional Restrictions If the jurisdiction in which you reside does not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, then you may not use the Software in such jurisdiction. By installing or using the Software, you confirm that you are not located in a jurisdiction where such use is prohibited.
6. Termination Licensor may terminate this Agreement if Licensee breaches any of its terms. Upon termination, Licensee must cease all use of the Software and destroy all copies of the Software.
7. Miscellaneous This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral, relating to such subject matter. This Agreement may only be amended in writing by Licensor.
If any part of this Agreement is held to be invalid or unenforceable, the remainder shall continue in full force and effect.
8. Governing Law This Agreement shall be governed by and construed in accordance with the laws supplied by the Licensee, without regard to its conflict of laws principles.
By using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
