END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“User”, “you”) and Amped Horizon e.U. (“Company”, “we”, “us”, “our”) governing your use of AI Pals Engine (“Software”).
By installing, accessing, or using the Software through the Steam platform, you agree to be bound by this EULA, the Acceptable Use Policy (“AUP”) set forth below, and the Steam Subscriber Agreement. If you do not agree, do not install or use the Software.
1. License Grant
Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for personal use only, in accordance with this EULA and applicable law.
All rights not expressly granted are reserved by the Company.
2. Restrictions
You may not:
- Copy, modify, distribute, sublicense, sell, lease, or reverse engineer the Software, except where permitted by applicable law;
- Use the Software for any unlawful purpose;
- Circumvent, disable, or interfere with security features or access controls;
- Use the Software in violation of the Acceptable Use Policy.
3. Acceptable Use Policy (AUP)
You agree to use the Software responsibly and in compliance with all applicable laws.
I. Respect for the Rights of Others
You may not use the Software to create, upload, generate, share, or distribute any content that infringes, misappropriates, or otherwise violates the intellectual property, privacy, publicity, or other legal rights of any third party, including copyright, trademark, and database rights.
This includes, without limitation, reproducing or generating content derived from copyrighted works without the necessary rights or permissions, except where such use is permitted by applicable law.
II. Illegal, Harmful, or Malicious Activities
You may not use the Software to engage in, promote, or facilitate:
- Sexual exploitation or abuse of minors;
- Criminal activity, fraud, scams, phishing, malware, or spam;
- Terrorism, violent extremism, or incitement to violence;
- Harassment, hate, threats, or intimidation;
- Encouragement or facilitation of self-harm;
- Tracking, surveillance, or monitoring of individuals without lawful authority or consent;
- Unauthorized collection, use, or disclosure of personal or sensitive data.
III. Deceptive or Misleading Conduct
You may not use the Software to:
- Impersonate another person or entity without clear and explicit disclosure;
- Misrepresent AI-generated content as human-created for the purpose of deception;
- Generate defamatory or knowingly false statements;
- Make misleading claims of professional expertise, particularly in legal, medical, financial, or governmental contexts;
- Use automated outputs to make decisions that materially affect legal rights or access to essential services (e.g. employment, healthcare, housing, finance).
IV. Safety and System Integrity
You may not attempt to bypass, disable, manipulate, or exploit any safeguards, guardrails, access controls, or security mechanisms of the Software, nor assist others in doing so.
V. AI Models and External Endpoints
Where the Software allows Users to connect to user-configured external services, APIs, endpoints, or AI models, you acknowledge and agree that:
- Any data transmitted to such external services is done solely at your direction;
- The Company does not operate, control, monitor, or receive data from those endpoints;
- You are responsible for ensuring that your use of external services complies with applicable laws, third-party terms, and data protection requirements;
- You may not knowingly connect the Software to AI models or services that are primarily trained on illegal content or that lack reasonable safeguards against harmful or unlawful use.
Responsibility is limited to matters reasonably within your knowledge and control.

4. Data Collection and Privacy
The Company does not collect, store, sell, analyze, or otherwise process personal data, usage analytics, telemetry, or user-generated content through the Software.
The Software operates locally on the User’s device, except where the User voluntarily configures external endpoints or services, in which case data transmission occurs directly between the User and the selected third party.
The Company does not act as a data controller or processor for such external services and does not have access to data transmitted to them.
Use of the Software through the Steam platform remains subject to Valve’s privacy practices under the Steam Subscriber Agreement and Steam Privacy Policy.
5. Termination
This EULA remains effective until terminated.
The Company may suspend or terminate your license immediately if you materially breach this EULA or use the Software unlawfully. Where required by law, notice will be provided.
Upon termination, you must cease use of the Software and uninstall all copies in your possession.
6. Updates and Changes
The Company may update the Software or this EULA from time to time.
If changes materially reduce your rights, you may stop using the Software without penalty. Continued use after changes constitutes acceptance of the updated EULA.
7. Intellectual Property
The Software, including all software code, visual assets, audio, characters, documentation, and related materials, is owned by the Company or its licensors and is protected by applicable intellectual property laws.
This EULA grants no ownership interest. Any user-generated content must comply with this EULA and the Acceptable Use Policy.
8. Disclaimer of Warranties
The Software is provided “as is” and “as available”.
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Nothing in this EULA limits statutory warranties or consumer rights that cannot be excluded under applicable law.
9. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or profits.
10. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Company from third-party claims arising from your unlawful or intentional misuse of the Software or violation of this EULA.
11. Governing Law and Jurisdiction
This EULA is governed by the laws of Austria, excluding conflict-of-law rules.
If you are a consumer in the European Union, this does not affect mandatory rights under applicable consumer protection laws.
12. Severability
If any provision of this EULA is held unenforceable, the remaining provisions remain in effect.
13. Waiver
Failure to enforce any provision is not a waiver of that provision.
