PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THIS SOFTWARE.
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and AlwaysPrettyStore LLC ("Licensor"), the developer and publisher of the video game titled Breaking Point: Operation Exodus ("Software"). By installing, copying, or otherwise using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms of this Agreement, do not install or use the Software.
1. LICENSE GRANT
Licensor grants You a non-exclusive, non-transferable, revocable license to use the Software solely for personal, non-commercial purposes in accordance with the terms of this Agreement.
2. OWNERSHIP
The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including but not limited to all copyrights, trademarks, trade secrets, and other intellectual property rights.
3. RESTRICTIONS
You shall not:
Copy, modify, or distribute the Software or any part of it without prior written consent from Licensor.
Reverse engineer, decompile, or disassemble the Software, except as expressly permitted by applicable law.
Use the Software for any commercial purpose without Licensor's written authorization.
Remove or alter any proprietary notices or labels on the Software.
4. USER-GENERATED CONTENT
If the Software allows You to create or upload content ("User-Generated Content"), You grant Licensor a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute such content as part of the Software or its promotional activities.
5. TERMINATION
This Agreement is effective until terminated. Licensor may terminate this Agreement immediately if You fail to comply with its terms. Upon termination, You must delete all copies of the Software.
6. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Licensor shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the Software.
7. DISCLAIMER OF WARRANTY
The Software is provided "AS IS" without warranty of any kind. Licensor expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. UPDATES AND PATCHES
Licensor may provide updates, patches, or modifications to the Software at its sole discretion. You agree that the Software may automatically download and install such updates without further notice.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws principles.
