END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal contract between you, the end user (“You” or “User”), and BAX Digital GmbH, the owner and developer of the VR game Cosmic Star Lounge (“Game”), available on the Steam platform (“Steam” or “Platform”). By purchasing, downloading, or using the Game, you agree to be bound by this Agreement.
1. LICENSE GRANT

BAX Digital GmbH grants you a non-exclusive, non-transferable, revocable license to use the Game solely for personal, non-commercial use on your virtual reality platform. You may install the Game only on devices that you own or control, and it may be played only by you.
2. OWNERSHIP AND RIGHTS

The Game and all related intellectual property rights, including but not limited to copyrights, trademarks, and patents, are owned by BAX Digital GmbH or the respective rights holders. You acquire no ownership rights to the Game under this Agreement.
3. USE RESTRICTIONS

You may not:
Copy, distribute, sell, rent, lease, or sublicense the Game.
Decompile, disassemble, reverse-engineer, or otherwise attempt to extract the source code from the Game.
Use the Game in any way that violates applicable laws or regulations.
Use the Game in a manner that disrupts or harms the experience of other players, including but not limited to hacking, modifying, or creating cheats or exploits.
4. UPDATES AND PATCHES

BAX Digital GmbH reserves the right to update, patch, or make changes to the Game at any time. You agree that the Game may receive regular updates or patches through Steam.
5. DISCLAIMER OF WARRANTY

This disclaimer of warranty does not affect your statutory rights as a consumer. The Game is provided 'as is' without any warranties of any kind, except for those that cannot be legally excluded under applicable law. BAX Digital GmbH does not assume any responsibility for any damage resulting from the use of the Game, including but not limited to data loss, hardware damage, or loss of profile data.
6. PRIVACY AND DATA PROTECTION (GDPR/DSGVO Compliance)

6.1. Data Controller and Processor
For personal data processed through the Steamworks API (such as playtime, achievements, and leaderboard scores), BAX Digital GmbH is the Data Controller regarding the purposes and means of processing this data. Valve Corporation ("Steam") acts as a Data Processor on our behalf for the storage and transmission of this data. 6.2. Types of Data We Process via Steam
We collect and process the following minimal data through Steam's services solely for the purpose of providing core gameplay functionality:

Steam User ID: A unique numeric identifier provided by Steam.

Public Steam Profile Information: Such as your publicly set Steam persona name (username) and avatar.

Gameplay Data: This includes your in-game high scores, achievements, playtime, and other statistics necessary for leaderboards and matchmaking in our peer-to-peer (P2P) game.

6.3. Legal Basis for Processing (Article 6 GDPR)
Our legal basis for processing this data under the GDPR is:

Point (b): Processing is necessary for the performance of the contract (this EULA) to provide you with the Game's online features, including leaderboards and P2P connectivity.

Point (f): Our legitimate interest in analyzing game performance, balancing gameplay, and preventing cheating and fraud.

6.4. Your Data Subject Rights (Chapter 3 GDPR)
Under the GDPR, you have the right to:

Access the personal data we hold about you.

Rectify inaccurate data we hold about you.

Request the Erasure of your personal data ("Right to be Forgotten").

Restrict or Object to our processing of your personal data.

Data Portability.

To exercise any of these rights, please contact us at info@bax-digital.com. We will respond to all legitimate requests within one month. Please note that because we rely on Steam's infrastructure, we may need to forward certain requests (like erasure) to Valve to action on their systems.

6.5. Data Retention
We will retain your gameplay data associated with your Steam ID for as long as your account is active or as needed to provide you services. You can request deletion of this data by contacting us at the email above. We may retain certain anonymized data for statistical purposes, which can no longer be linked to your person.

6.6. International Data Transfers
The data collected through Steam is processed by Valve Corporation in the United States. The European Commission has not issued an adequacy decision for the United States. Valve relies on the European Commission's Standard Contractual Clauses (SCCs) to ensure an adequate level of data protection for the transfer of your data to a country outside the EEA. 7. TERMINATION

This license agreement is effective when you install the Game and will automatically terminate if you violate any provision of this Agreement. Upon termination, you must uninstall the Game and delete all copies of the Game.
8. GOVERNING LAW AND JURISTICTION

This Agreement shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in this Agreement affects your rights as a consumer to rely on such mandatory provisions.

Any disputes between the user and BAX Digital GmbH shall be finally settled in the competent courts of Munich, Germany. However, if you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence. We will bring any proceedings against you only in the courts of your country of residence.
9. CHANGES TO THE AGREEMENT

BAX Digital GmbH reserves the right to modify this Agreement at any time. You will be notified of any material changes, and your continued use of the Game after changes constitutes your acceptance of the new terms.
