I. Introduction
This End-User License Agreement (“this Agreement”) is a legally binding agreement between you and ThinkMore studio
(“the Developer”) regarding your use of "MOBABrawl" (“the Game”). Please read the entire contents of this Agreement carefully before installing, using, or accessing the Game. By installing, using, or accessing the Game, you hereby agree to be bound by all the terms and conditions of this Agreement. If you do not agree to any of the terms of this Agreement, please do not install, use, or access the Game, and immediately uninstall the Game (if already installed).
II. License Grant
The Developer hereby grants you a non-exclusive, non-transferable, limited license to install, use, and run one copy of the Game on a single computer device owned or controlled by you, subject to the conditions set forth in this Agreement, solely for your personal non-commercial entertainment purposes.
This license applies only to the software portion of the Game and does not cover any other intellectual property rights that the Game may contain, such as trademarks, copyrighted works, music, sound effects, etc. (“Other Intellectual Property Rights”). For the use of Other Intellectual Property Rights, you must comply with relevant laws and regulations as well as the terms and conditions that may be separately specified by the Developer.
III. Usage Restrictions
You shall not reverse engineer, decompile, disassemble, modify, translate, or otherwise attempt to obtain the source code or other unpublished technical information of the Game, unless applicable laws explicitly permit such actions and only to the extent permitted by such laws.
You shall not copy, distribute, rent, lease, sell, transfer, license the whole or any part of the Game to any third party, or use the Game for any commercial purposes without the prior written consent of the Developer, including but not limited to using the Game in commercial establishments such as internet cafes and game arcades.
You shall not use any cheating software, plug-ins, illegally modified game clients, or any other tools or technologies that are intended to disrupt the fairness of the game, interfere with the normal operation of the game, or violate the rights of other users to use the Game.
You shall not infringe upon the intellectual property rights, privacy rights, reputation rights, or any other legitimate rights and interests of any third party during the use of the Game.
You shall not create or operate any private servers or other unauthorized servers related to the Game without the prior written consent of the Developer.
IV. Accounts and Privacy
You may need to create a Steam account to use the Game. You are responsible for safeguarding your Steam account information, including your username and password, and ensuring that your account is not used without authorization. You are responsible for all activities that occur under your Steam account, regardless of whether such activities are carried out by you or not.
The Developer will collect, use, store, and protect the personal information you provide during the use of the Game in accordance with the privacy policy of the Steam platform. You agree that the Developer will handle your personal information in accordance with the privacy policy of the Steam platform and agree to share some of your personal information with the Steam platform to enable the normal operation of the Game and the provision of related services.
V. Updates and Maintenance
The Developer has the right to update, upgrade, modify, or maintain the Game from time to time at its own discretion, including but not limited to fixing bugs, adding new features, and improving game performance. You agree to promptly download and install such updates, upgrades, modifications, or maintenance after the Developer releases them to ensure that you can continue to use the Game normally.
The Developer does not guarantee that such updates, upgrades, modifications, or maintenance will not cause any damage or impact to your computer equipment or game data, nor does it guarantee that such updates, upgrades, modifications, or maintenance will meet your specific needs or expectations. You assume all risks and consequences arising from the installation or use of such updates, upgrades, modifications, or maintenance.
VI. Intellectual Property Rights
The Game and all related intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, etc., are owned by the Developer or its licensors. This Agreement does not grant you any intellectual property rights related to the Game, but only grants you a license to use the Game within the scope specified in this Agreement.
You acknowledge and agree that all other intellectual property rights contained in the Game, such as game characters, game scenes, game music, game sound effects, game plots, etc., are protected by copyright laws and other relevant laws and regulations. Without the prior written consent of the Developer, you shall not use, copy, modify, disseminate, or otherwise infringe upon these intellectual property rights.
VII. Disclaimer of Warranties and Limitation of Liability
The Game is provided to you “as is.” The Developer makes no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, compatibility, or freedom from errors. You assume the risks associated with using the Game.
Under no circumstances shall the Developer be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including but not limited to data loss, business interruption, loss of profits, damage to computer equipment, or other economic losses) resulting from your use or inability to use the Game, even if the Developer has been informed of the possibility of such damages.
Certain jurisdictions do not allow the exclusion or limitation of implied warranties or liability. Therefore, the above disclaimer of warranties and limitation of liability may not apply to you. In such jurisdictions, the Developer’s liability shall be limited to the maximum extent permitted by law.
VIII. Termination
If you violate any of the terms or conditions of this Agreement, the Developer has the right to immediately terminate this Agreement and revoke your license to use the Game without prior notice to you or any liability to you. Upon termination of this Agreement, you must immediately stop using the Game and uninstall the Game and all related files and components.
The termination of this Agreement shall not affect the rights or obligations that have already arisen prior to the termination of this Agreement, nor shall it affect any rights or remedies provided by applicable laws.
IX. Miscellaneous
This Agreement constitutes the entire agreement between you and the Developer regarding the use of the Game and supersedes any prior oral or written agreements between you and the Developer regarding the Game. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of the other provisions, which shall remain in full force and effect.
The interpretation and enforcement of this Agreement shall be governed by the laws of [Specific Jurisdiction]. You agree to submit any disputes arising out of or relating to this Agreement to the courts of competent jurisdiction in [Specific Dispute Resolution Location] for litigation.
The Developer reserves the right to modify the terms and conditions of this Agreement at any time. The modified Agreement will be published on the Steam platform and shall become effective upon publication. Your continued use of the Game shall indicate your agreement to be bound by the modified Agreement. If you do not agree to the modified Agreement, please stop using the Game and uninstall the Game in accordance with the provisions of this Agreement.
