END USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING “BORN IN WAR” ("THE GAME").
By downloading, installing, or using The Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use The Game.
1. LICENSE
Quell Studios grants you a personal, non-exclusive, non-transferable, revocable license to use The Game on compatible devices solely for personal entertainment purposes.
2. OWNERSHIP
All content, assets, code, artwork, and related materials within The Game are owned by Quell Studios and are protected by copyright and other intellectual property laws. This Agreement does not transfer ownership.
3. ONLINE FUNCTIONALITY
The Game is played online worldwide. To operate online services, The Game may collect temporary or persistent data such as IP address, login information, device identifiers, and gameplay statistics. By using The Game, you consent to this processing as described in the Privacy Policy.
4. DATA COLLECTION
The Game may store certain data temporarily or permanently to provide online features, security, matchmaking, and gameplay functionality. No user-generated external content can be uploaded into The Game.
5. IN-APP PURCHASES
The Game includes optional micro-transactions. All purchases are final and non-refundable except where required by local law. Additional content or boosts purchased through platform services remain licensed, not owned.
6. RESTRICTIONS
You may NOT:
• modify, reverse engineer, decompile, or disassemble The Game;
• exploit bugs or vulnerabilities;
• distribute or resell The Game;
• use The Game for illegal or commercial hosting purposes.
7. TERMINATION
This license is effective until terminated. Quell Studios may suspend or terminate access if you violate this Agreement. You may terminate by uninstalling The Game and ceasing all use.
8. DISCLAIMER OF WARRANTY
The Game is provided “AS IS” without warranties of any kind. Quell Studios does not guarantee uninterrupted service, error-free operation, or compatibility with all devices.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Quell Studios is not liable for data loss, damages, or losses resulting from the use of The Game, online services, or third-party failures.
10. GOVERNING LAW
This Agreement is governed by the laws applicable in your region unless overridden by mandatory consumer protection laws. Any disputes shall be resolved under those laws.
11. CHANGES TO THIS AGREEMENT
Quell Studios may update this Agreement at any time. Continued use of The Game after such updates constitutes acceptance of the revised terms.
