END USER LICENSE AGREEMENT (EULA)

(hereinafter referred to as “we” or “Provider”)


1. Scope
This End User License Agreement (“EULA”) governs the use of the software Fairground Online, including all updates, patches, online features, multiplayer services, voice chat features, backend services, and related content (collectively referred to as the “Software”).
By installing, launching, or using the Software, you agree to this EULA.


2. Grant of License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Software for private, non-commercial purposes, provided that this EULA and the terms of use of the respective platform (e.g., Steam Subscriber Agreement) are complied with.


3. Ownership & Intellectual Property
All rights to the Software, including source code, graphics, sounds, music, texts, trademarks, and designs, remain with the Provider or its licensors.


4. Prohibited Conduct
The following is prohibited:
* Reverse engineering, decompilation, or modification, unless explicitly permitted by law
* Use or distribution of cheats, hacks, exploits, or bots
* Circumventing security or protection mechanisms
* Using unauthorized connections or systems (e.g., unauthorized lobbies)
* Violating the rights of third parties
* Harassing, discriminatory, or unlawful behavior in multiplayer or voice chat


5. Online Features & Multiplayer
Fairground Online includes online and multiplayer features that require an internet connection and the use of third-party platforms (especially Steam).
We reserve the right to modify, restrict, or discontinue online services at any time for technical, legal, or economic reasons.
There is no entitlement to permanent availability.


6. Network Connections & Peer-to-Peer Communication
To provide multiplayer functionality, the Software uses direct or mediated network connections between players (peer-to-peer or relay connections).
It may be technically necessary for connection data (e.g., IP addresses) to be exchanged between players.
The Provider assumes no liability for risks arising from such direct connections (e.g., network attacks by other players).


7. Backend Services & Security Systems
To provide and secure online features, the Provider operates its own backend services.
These serve in particular to:
* Authenticate players
* Manage lobbies
* Enforce game rules
* Prevent abuse, fraud, and unauthorized Access

The Provider is entitled to take measures to secure game operations, including:
* Temporary or permanent bans
* Restriction of features
* Removal of content


8. Voice Chat & User Communication
The Software includes voice chat features through which players can communicate with each other.
Players are solely responsible for:
* The content they transmit
* Compliance with applicable laws
* Respectful interaction with other players

The Provider assumes no responsibility for content transmitted by players via voice chat or other communication features.


9. Music & Audio Streaming by Players (Disclaimer – IMPORTANT)
The Software may provide features that allow players to transmit or stream audio or music to other players.

9.1 Responsibility
You are solely responsible for ensuring that you are authorized to transmit such content.

9.2 Permitted Content
Only the following may be transmitted:
* Your own content, or
* Legally licensed or royalty-free content

9.3 Disclaimer
The Provider only provides the technical infrastructure and is not responsible for any content.

9.4 Indemnification
You agree to indemnify the Provider against all third-party claims arising from any infringement caused by you.

9.5 Measures
In case of violations, we reserve the right to:
* Block content
* Restrict features
* Suspend players


10. Use of Platform Services (Steam)
The Software uses functions of the Steam platform.
The terms of use of the platform provider also apply to these services.
The Provider has no influence on the availability or functionality of these services.


11. User Conduct, Moderation & Bans
To maintain fair gameplay, the Provider may warn, restrict, or ban players.
This applies in particular in cases of:
* Cheating or manipulation
* System abuse
* Harassment of other players
* Violations of applicable law

There is no entitlement to restoration of access.

13. Updates & Changes
We may provide updates that modify, expand, or remove content where necessary.


14. Warranty
The Software is provided “as is.” Statutory warranty rights apply.


15. Limitation of Liability
We are fully liable in cases of intent, gross negligence, and injury to life, body, or health.
Otherwise, liability is excluded to the extent permitted by law.
In particular, we are not liable for:
* Player-generated content
* Voice chat content
* Transmitted audio or music data
* Network issues or connection failures
* Damage caused by other players
* Content from the Workshop or other user-generated content


16. Data Protection
Information on the processing of personal data (e.g., SteamID, connection data, backend data) can be found in our privacy policy.

17. Workshop & User Generated Content (UGC)
The Software may provide features that allow users to create, upload, share, or download their own content (e.g., via the Steam Workshop or similar systems).

17.1 Rights to Content
You may only upload content for which you have the necessary rights or permission.
In particular, it is prohibited to upload content that:
* contains copyrighted works of third parties without permission (e.g., characters, brands, logos from Disney, Nintendo, etc.)
* infringes trademarks or other intellectual property rights
* is unlawful, offensive, or inappropriate

Real-world references (e.g., ride designs) may also be legally protected.

17.2 Responsibility
You are solely responsible for the content you upload and its legality.
The Provider does not proactively review user-generated content.

17.3 License Grant
By uploading content, you grant the Provider a non-exclusive, worldwide, perpetual right to use, store, display, and make your content available to other users within the Software and its services.

17.4 Moderation & Removal
The Provider is entitled to remove or block content at any time without prior notice, especially if:
* there is a violation of this EULA
* legal risks exist
* third-party complaints are received

17.5 Reporting
Infringing content can be reported at any time (see section 12).

17.6 Measures in Case of Violations
In case of violations, we reserve the right to:
* Remove content
* Restrict Workshop features
* Suspend user accounts

17.7 Indemnification
You agree to indemnify the Provider against all third-party claims arising from content uploaded by you.


18. Termination
In case of serious violations, we may block access to online features or revoke the license.


19. Applicable Law
German law applies. Mandatory consumer protection rights remain unaffected.


20. Severability Clause
If any provision is invalid, the remainder of the agreement shall remain in effect.
