END USER LICENSE AGREEMENT (EULA) For Lunar Corps
IMPORTANT: This End User License Agreement ("Agreement") is a legal contract between you (the "User") and Flare Gun Studios LTD ("Company"), the developer and owner of Lunar Corps, a video game protected by copyright and trademark laws. By installing, playing, or otherwise using Lunar Corps (the "Game"), you agree to be bound by the terms and conditions of this Agreement.
1. LICENSE GRANT
The Company grants you a non-exclusive, non-transferable, limited license to install and use the Game on your personal device(s) solely for your own personal, non-commercial use. This license does not allow you to distribute, sell, or share the Game or any of its components in any form without prior written consent from Flare Gun Studios LTD.
2. RESTRICTIONS
You may not:
• Modify, adapt, reverse-engineer, decompile, disassemble, or create derivative works based on the Game.
• Use the Game for any illegal or unauthorized purpose.
• Use the Game in a manner that violates any applicable laws or regulations.
• Rent, lease, lend, or sublicense the Game.
• Circumvent or disable any copy protection or security mechanisms in the Game.
3. INTELLECTUAL PROPERTY RIGHTS
The Game, including but not limited to all content, graphics, code, music, and trademarks associated with Lunar Corps are protected by intellectual property laws and are the sole property of Flare Gun Studios LTD. The Lunar Corps name and logo are registered trademarks of Flare Gun Studios LTD. All rights not explicitly granted in this Agreement are reserved by the Company.
4. UPDATES AND PATCHES
The Company may, at its sole discretion, release updates, patches, or additional content for the Game. These updates may modify or enhance the Game and are considered part of the Game under this Agreement. By continuing to use the Game, you consent to such updates.
5. DISCLAIMER OF WARRANTY
The Game is provided "as is" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. The Company does not guarantee that the Game will be free from errors, bugs, or interruptions, or that the Game will meet your specific requirements.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Flare Gun Studios LTD shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use the Game, even if the Company has been advised of the possibility of such damages.
7. TERMINATION
This Agreement is effective until terminated. You may terminate it at any time by uninstalling the Game. The Company may terminate this Agreement if you fail to comply with any of the terms and conditions set forth herein. Upon termination, you must immediately cease all use of the Game and delete it from your devices.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Flare Gun Studios LTD is registered, without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of the courts located in that jurisdiction for any disputes arising out of or relating to this Agreement.
9. PRIVACY
By using the Game, you consent to the collection and use of certain data as outlined in the Privacy Policy provided by the Company. The Privacy Policy governs how your personal information is collected, used, and shared.
10. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the Company regarding the Game and supersedes any prior agreements or understandings, whether written or oral, relating to the Game.
12. MULTIPLAYER USAGE
As the Game includes multiplayer features / online services, the following terms apply:
• Account and Access: In order to participate in multiplayer gameplay, you may need to create an account with Flare Gun Studios LTD or a third-party service. You are solely responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
• Conduct: You agree to abide by the code of conduct and any community guidelines set forth by Flare Gun Studios LTD or the platform hosting the multiplayer services. Any abusive, harassing, or otherwise inappropriate behavior towards other players, including cheating, exploiting bugs, or otherwise disrupting the gameplay experience, may result in temporary or permanent suspension of your account or access to multiplayer features.
• Cheating and Exploits: The use of cheats, mods, hacks, or other software designed to alter the game’s functionality or provide an unfair advantage is strictly prohibited. Flare Gun Studios LTD reserves the right to monitor and enforce a fair gaming environment and may take action against accounts engaging in these practices.
• Server Access: The Company may, at its discretion, shut down or alter multiplayer servers, or suspend or terminate online services at any time. You acknowledge that access to multiplayer features may be temporarily or permanently unavailable due to maintenance, updates, or other reasons beyond the Company's control. Flare Gun Studios LTD will not be liable for any loss of gameplay, data, or experience related to such downtime.
• Data Collection and Use: In multiplayer modes, the Company may collect certain data, including your in-game actions, performance, and interactions with other players. This data will be used to improve the multiplayer experience, enforce the code of conduct, and detect cheating. By participating in multiplayer features, you consent to the collection and use of such data as described in the Company’s Privacy Policy.
