Regarding this agreement
This End User License Agreement (also known as "this Agreement") is a legally binding contract between you and Do Not Forget National Humiliation.
As you may know, 'Do Not Forget National Humiliation' is the name of the game development studio 'Bloody Battle Shanghai Beach'. Therefore, in this agreement, we refer to ourselves as' We 'or' Our Company '.
This agreement applies to our electronic game 'Blood Battle Shanghai Beach', including game copies/code (all of which are included when we refer to 'Blood Battle Shanghai Beach' or 'game').
Once you download, install, or use 'Blood Battle on Shanghai Beach' (whichever is earlier), this agreement becomes binding on you and us. If you do not agree, you are not allowed to download, install, or use 'Blood Battle Shanghai Beach'.
2 licenses
We grant you a revocable, non exclusive, non transferable, and non transferable personal limited license to use on personal computers, game consoles, and/or other devices that we have expressly authorized (depending on the specific device/system/platform on which you purchased the game)
Display, view, download, install, use, and play 'Blood Battle Shanghai Beach'. This license is for your personal use only (therefore, you may not give, "sell," lend, gift, assign, sublicense, or otherwise transfer it to anyone else), and this license does not grant you any ownership of "Bloody Battle on Shanghai Beach".

4 Minimum Requirements and Monitoring

7 Rules for Using 'Bloody Battle on Shanghai Beach'
If you want to play 'Blood Battle on Shanghai Beach', there are more rules to follow. Please read the following rules carefully, as failure to comply with these regulations will be considered a "serious violation" of this agreement and may result in the suspension and/or termination of your access to "Blood Battle Shanghai Beach". In particularly serious cases, we reserve the right to prohibit you from accessing 'Blood Battle Shanghai Beach' and our other games and services in the future.
The rules are as follows:
a) Personal enjoyment. Blood Battle on Shanghai Beach is only for personal entertainment and cannot be used for any commercial purposes

g) Do not intentionally or maliciously interfere with, destroy, or access the restricted areas of Do Not Forget National Humiliation or third-party network software or servers, including by digging tunnels, injecting or inserting code, denying services, modifying or altering software, using Do Not Forget National Humiliation software in conjunction with other similar software, or by simulating, creating, or using private servers or similar services related to 'Blood Battle Shanghai Beach' through protocols for interference, destruction, or access.
h) Data mining. Do not intercept, mine, or otherwise collect personal or confidential data/information from 'Bloody Battle on Shanghai Beach'.
i) Name. The names, logos, or trademarks of "Never Forget National Humiliation" and "Bloody Battle on Shanghai Beach" shall not be used for any unauthorized purposes.
j) Infringing content. Do not spread rumors or engage in any infringement of copyright, trademark, patent, trade secret, privacy, publicity, or other rights related to 'Bloody Battle on Shanghai Beach'.
k) Malicious code. Do not upload any files containing malicious code, including viruses, spyware, Trojan horses, worms, time bombs, intentionally damaged data, files containing malicious code, or other files that may damage or interfere with the operation of 'Blood Battle Shanghai Beach' in any way.
l) Geographical restrictions. We require you to comply with the geographical/regional/language/location-based restrictions, requirements or rules applicable to 'Bloody Battle on Shanghai Beach'.

12 Responsibilities
If you reside in an EU member state or a country/region where the following liability limitations are explicitly prohibited by law, Article 12 does not apply to you, but if you reside elsewhere (including the United States), Article 12 applies to you.
12.1 Our Disclaimer. You are at your own risk when using 'Bloody Battle on Shanghai Beach'. Unless otherwise specified in this agreement, neither Forget the National Humiliation nor its affiliates, partners, and licensors make any implied or express warranties or statements regarding 'Bloody Battle on Shanghai Beach'. Blood Battle Shanghai Beach provides you with "as is" and "as is" without any express or implied warranties or representations, and we are not responsible for any form of loss, damage or injury caused by (inability to) use Blood Battle Shanghai Beach. To the maximum extent permitted by applicable law, we reject all express or implied warranties that may apply to 'Blood Battle Shanghai Beach', including but not limited to: implied warranties of ownership, non infringement, merchantability, satisfactory quality or suitability for a particular purpose, or any warranties that may arise in the course of transaction, performance or trade use, or warranties of absence of viruses, errors or defects, and/or warranties of accuracy, legality, reliability or quality of the content/information contained in 'Blood Battle Shanghai Beach'. We do not guarantee that Blood Battle Shanghai Beach will not be interrupted or error free, that defects will be corrected, or that the game will not have viruses or other harmful components.
12.2 Limitation of our liability. To the maximum extent permitted by applicable law, in no event shall Forget National Humiliation and its affiliates, partners, and licensors be liable to you for any loss of profits, costs or expenses, data loss, information damage/loss, loss of business opportunities, or any type of special, indirect, punitive, exemplary, or consequential loss, damage, or destruction, regardless of whether such damages arise from breach of contract, tort (including negligence, breach of statutory duty, breach of contract, breach of warranty or strict liability), false statement or compensation, or for any other reason, regardless of whether the relevant party knew that such damages may occur.
12.3 Our liability limit. To the maximum extent permitted by applicable law, in any case, with respect to the "Bloody Battle on Shanghai Beach" or this Agreement, the total liability of the "Never Forget National Humiliation" and its affiliates, partners, and licensors to you shall not exceed the amount (if any) actually paid by you to us for the claim matter. The above is the only exclusive remedy related to this agreement.
12.4 Your compensation to us. You agree to protect and indemnify, as necessary, Do Not Forget National Humiliation and its affiliates, licensors, and partners from all damages, liabilities, claims, and expenses (including legal fees) related to: (a) Your alleged or actual violation of this Agreement; (b) You or anyone representing you use 'Blood Battle on Shanghai Beach'; And (c) infringe upon the intellectual property rights of Do Not Forget National Humiliation and its affiliates, licensors, and partners. If there are any claims against us, you should fully cooperate with us, and at the same time, we have the right to take over and defend. Without our prior written consent, you may not resolve all or part of such claims without authorization.
12.5 Injunction relief. You agree that the loss, damage, or injury suffered by you is compensable and other remedies are sufficient, therefore you have no right to seek injunctive or other equitable relief against Do Not Forget National Humiliation, its affiliates, partners, and licensors.
13 Termination
13.1 Your right to terminate. You may terminate this agreement at any time by permanently disabling 'Blood Battle Shanghai Beach'. Termination will not affect our or your existing rights or obligations.
13.2 Our right to terminate. If you seriously violate this agreement (including serious breaches and/or breaches that may cause actual harm to Blood Battle Shanghai Beach, Blood Battle Shanghai Beach users, us and our affiliates, licensors, and partners), we may suspend or terminate your access to Blood Battle Shanghai Beach and terminate this agreement. Especially, it applies to the rules of 'Bloody Battle on Shanghai Beach' as stated in Article 7 above. Where reasonably possible, we will contact you to explain the reasons for our actions and what you can do (if any). If we suspend or terminate your access to 'Blood Battle Shanghai Beach' and terminate this agreement in accordance with this provision, we will have no obligation or responsibility towards you.
13.3 Discontinuation of 'Bloody Battle on Shanghai Beach'. Although it may seem unlikely, if we have to permanently suspend access to 'Blood Battle Shanghai Beach' (in whole or in part, such as on a specific platform) for reasons other than your violation, we will notify you at least 120 days in advance by posting a notice on our website. In this case, we do not assume any future obligations or responsibilities towards you (but this does not affect any pre-existing obligations or responsibilities).
14 Force Majeure
Neither party shall be liable to the other party for all or part of the performance, non performance, or delayed performance caused by force majeure.
"Force majeure" refers to any reason that prevents a party from performing any or all of its obligations, which is caused by acts, events, negligence or accidents beyond the reasonable control of the party, including strikes, blockades or other labor disputes (except for such disputes related to the labor force of the party), nuclear accidents or acts of God, war or terrorist activities, riots, civil unrest, malicious damage (excluding malicious damage related to employees of the affected party or its subcontractors), compliance with laws or government orders, rules, regulations or instructions, strikes by employees of power suppliers, technical facility failures, hacker attacks, denial of service or other information technology attacks, use of information technology viruses, malicious software or similar technologies, pandemics (such as COVID-19), fire, flood, storm, or supplier/subcontractor default.
15 Complete Agreement
This agreement and other documents referred to in this agreement constitute the entire agreement between you and us regarding the subject matter of this agreement and supersede any prior oral or written agreements.
16 Changes to this Agreement
We may modify this agreement as deemed necessary, such as for legal reasons or in response to changes in 'Bloody Battle on Shanghai Beach'. If this agreement is changed, we will provide the updated agreement online and make reasonable efforts to inform you (such as sending notifications to you in the game).
17 Effective date of legal binding force
Once we make changes to this agreement, it will become legally binding on you one day (1) after we publish the revised agreement online.

If you reside in an EU member state or a country/region where the following liability limitations are explicitly prohibited by law, Article 12 does not apply to you, but if you reside elsewhere (including the United States), Article 12 applies to you.
12.1 Our Disclaimer. You are at your own risk when using 'Bloody Battle on Shanghai Beach'. Unless otherwise specified in this agreement, neither Forget the National Humiliation nor its affiliates, partners, and licensors make any implied or express warranties or statements regarding 'Bloody Battle on Shanghai Beach'. Blood Battle Shanghai Beach provides you with "as is" and "as is" without any express or implied warranties or representations, and we are not responsible for any form of loss, damage or injury caused by (inability to) use Blood Battle Shanghai Beach. To the maximum extent permitted by applicable law, we reject all express or implied warranties that may apply to 'Blood Battle Shanghai Beach', including but not limited to: implied warranties of ownership, non infringement, merchantability, satisfactory quality or suitability for a particular purpose, or any warranties that may arise in the course of transaction, performance or trade use, or warranties of absence of viruses, errors or defects, and/or warranties of accuracy, legality, reliability or quality of the content/information contained in 'Blood Battle Shanghai Beach'. We do not guarantee that Blood Battle Shanghai Beach will not be interrupted or error free, that defects will be corrected, or that the game will not have viruses or other harmful components.
12.2 Limitation of our liability. To the maximum extent permitted by applicable law, in no event shall Forget National Humiliation and its affiliates, partners, and licensors be liable to you for any loss of profits, costs or expenses, data loss, information damage/loss, loss of business opportunities, or any type of special, indirect, punitive, exemplary, or consequential loss, damage, or destruction, regardless of whether such damages arise from breach of contract, tort (including negligence, breach of statutory duty, breach of contract, breach of warranty or strict liability), false statement or compensation, or for any other reason, regardless of whether the relevant party knew that such damages may occur.
12.3 Our liability limit. To the maximum extent permitted by applicable law, in any case, with respect to the "Bloody Battle on Shanghai Beach" or this Agreement, the total liability of the "Never Forget National Humiliation" and its affiliates, partners, and licensors to you shall not exceed the amount (if any) actually paid by you to us for the claim matter. The above is the only exclusive remedy related to this agreement.
12.4 Your compensation to us. You agree to protect and indemnify, as necessary, Do Not Forget National Humiliation and its affiliates, licensors, and partners from all damages, liabilities, claims, and expenses (including legal fees) related to: (a) Your alleged or actual violation of this Agreement; (b) You or anyone representing you use 'Blood Battle on Shanghai Beach'; And (c) infringe upon the intellectual property rights of Do Not Forget National Humiliation and its affiliates, licensors, and partners. If there are any claims against us, you should fully cooperate with us, and at the same time, we have the right to take over and defend. Without our prior written consent, you may not resolve all or part of such claims without authorization.
12.5 Injunction relief. You agree that the loss, damage, or injury suffered by you is compensable and other remedies are sufficient, therefore you have no right to seek injunctive or other equitable relief against Do Not Forget National Humiliation, its affiliates, partners, and licensors.
13 Termination
13.1 Your right to terminate. You may terminate this agreement at any time by permanently disabling 'Blood Battle Shanghai Beach'. Termination will not affect our or your existing rights or obligations.
13.2 Our right to terminate. If you seriously violate this agreement (including serious breaches and/or breaches that may cause actual harm to Blood Battle Shanghai Beach, Blood Battle Shanghai Beach users, us and our affiliates, licensors, and partners), we may suspend or terminate your access to Blood Battle Shanghai Beach and terminate this agreement. Especially, it applies to the rules of 'Bloody Battle on Shanghai Beach' as stated in Article 7 above. Where reasonably possible, we will contact you to explain the reasons for our actions and what you can do (if any). If we suspend or terminate your access to 'Blood Battle Shanghai Beach' and terminate this agreement in accordance with this provision, we will have no obligation or responsibility towards you.
13.3 Discontinuation of 'Bloody Battle on Shanghai Beach'. Although it may seem unlikely, if we have to permanently suspend access to 'Blood Battle Shanghai Beach' (in whole or in part, such as on a specific platform) for reasons other than your violation, we will notify you at least 120 days in advance by posting a notice on our website. In this case, we do not assume any future obligations or responsibilities towards you (but this does not affect any pre-existing obligations or responsibilities).
14 Force Majeure
Neither party shall be liable to the other party for all or part of the performance, non performance, or delayed performance caused by force majeure.
"Force majeure" refers to any reason that prevents a party from performing any or all of its obligations, which is caused by acts, events, negligence or accidents beyond the reasonable control of the party, including strikes, blockades or other labor disputes (except for such disputes related to the labor force of the party), nuclear accidents or acts of God, war or terrorist activities, riots, civil unrest, malicious damage (excluding malicious damage related to employees of the affected party or its subcontractors), compliance with laws or government orders, rules, regulations or instructions, strikes by employees of power suppliers, technical facility failures, hacker attacks, denial of service or other information technology attacks, use of information technology viruses, malicious software or similar technologies, pandemics (such as COVID-19), fire, flood, storm, or supplier/subcontractor default.
15 Complete Agreement
This agreement and other documents referred to in this agreement constitute the entire agreement between you and us regarding the subject matter of this agreement and supersede any prior oral or written agreements.
16 Changes to this Agreement
We may modify this agreement as deemed necessary, such as for legal reasons or in response to changes in 'Bloody Battle on Shanghai Beach'. If this agreement is changed, we will provide the updated agreement online and make reasonable efforts to inform you (such as sending notifications to you in the game).
17 Effective date of legal binding force
Once we make changes to this agreement, it will become legally binding on you one day (1) after we publish the revised agreement online.
