Welcome to the Starcom: Unknown Space End User License Agreement (this “EULA”)!
This agreement is between you and Wx3 Labs, LLC ("Wx3"). It covers your use of the Starcom: Unknown Space video game software (the "Game") and related materials.
We've tried to make this EULA clear and straightforward, but it's still a legal document. By using Starcom: Unknown Space, you're agreeing to these terms, so please read them carefully.
1. Accepting the Terms. By using the Game, you're agreeing to this EULA. You understand that this is a legally binding agreement, and you'll use the Game in accordance with these terms. If you don't agree, please don't use the Game.
2. Your License. Wx3 grants you a personal, non-exclusive, non-transferable license to use the Game. This license is conditional on you following this EULA.
3. Your Content. Any content you create or share through the Game or otherwise transfer to us is known as your "Content." This can mean messages, chats, images, mods, designs, and other materials you share with us or through the Game. You keep ownership of your Content, but by sharing it, you give us the right to use, copy, modify, adapt, distribute, and publicly display that Content for commercial and non-commercial purposes, including in the Game’s advertising and to share with other Game users.
You agree that any feedback, suggestions, and ideas you provide about the Game, as well as any content you submit to the Steam Workshop or otherwise to Wx3, can be used by us for any purpose, including improving the Game. By submitting any such content to the Steam Workshop or otherwise to us, you assert that you have the right to do so and are not violating any copyright or other intellectual property rights.
4. Content Creation License. We encourage anyone who owns a legal copy of the Game to create and distribute videos and screenshots of gameplay, with or without commentary, for commercial or non-commercial purposes.
5. Your Behavior. When using the Game and related forums, you agree to behave responsibly and respectfully. Specifically, you must not:
- Harass, abuse, threaten, or bully others
- Direct hate speech or discriminatory language toward other players or Wx3 staff
- Impersonate others, especially Wx3 staff
- Interfere with the Game's operation or other users' experiences
- Violate laws or third-party rights (including intellectual property rights)
- Share explicit or inappropriate content
- Spam or flood communication channels
We reserve the right to moderate user behavior and content, which may include removing content, or banning users who violate these rules from the forums and/or Steam Workshop. We may also cooperate with legal authorities if we believe that you've violated the law.
6. Support Services. We may provide support for the Game, but you agree that we're not required to. Any additional software we provide as part of support is considered part of the Game and subject to this EULA.
7. Messages from Wx3. We may send you game-related communications through the Game, email, or other communication methods you provide us with. These aren't considered spam, and you agree to receive them. Marketing emails will include opt-out instructions.
8. Modifying the Game. We may update or change the Game at any time.
9. Intellectual Property. The Game is protected by copyright, trademark, and other intellectual property laws. You agree that you can't use our trademarks or copyrighted material without our permission. Content Creators, see section 4.
10. Copyright Complaints. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide Wx3's Copyright Agent with a compliant notice under the Digital Millenium Copyright Act, including the following information:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed;
- A description of where the material that you claim is infringing is located on the Service;
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

11. Disclaimer of Warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WX3 AND ITS THIRD-PARTY PLATFORM PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Wx3 doesn't warrant that the Game will function without error, that defects will be corrected, or that the Game is free of harmful components. Wx3 doesn't warrant or make any representations regarding the use or the results of the use of the Game in terms of its correctness, accuracy, reliability, or otherwise.
You also acknowledge and agree that we are not responsible for any user-created content, including content submitted to Steam Workshop. You agree to use such content at your own risk.
Some jurisdictions don't allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WX3 AND ITS THIRD-PARTY PLATFORM PROVIDERS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT WILL WX3'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED USD $100.00.
You acknowledge that use of the Game may involve risks, including potential health risks such as seizures. You agree that Wx3 is not liable for any damages, including health risks or injuries resulting from your use of the Game.
13. Indemnification. You agree to indemnify and hold harmless Wx3, its affiliates, officers, employees, agents, partners and licensors from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit, modify or otherwise make available through the Game, your use of the Game, your connection to the Game, your violation of this EULA, or your violation of any rights of another.
14. Your Personal Information. The Game does not collect any personally identifiable information. We may collect anonymous analytics data to improve the Game and identify errors, which does not include any personal information.
15. Governing Law. This EULA is governed by the laws of Massachusetts, USA. Any disputes will be resolved in the courts of Watertown, Massachusetts.
16. General Terms This EULA is the entire agreement between us regarding the Game. We can assign our rights under this EULA, but you can't without our permission. If we fail to enforce any provision of this EULA, that doesn't mean we've waived our right to do so later. If any part of this EULA is found to be unenforceable, the rest will remain in full force and effect. This EULA doesn't create any partnership, joint venture, employment, or agency relationship between you and Wx3.
