HORIZON WALKER - END USER LICENSE AGREEMENT (EULA)
This agreement was originally written in Korean. If there is any conflict between the contents of a non-Korean version and the Korean version, the Korean version shall prevail.
Please read this End User License Agreement (this "License Agreement" or "this Agreement") carefully before playing Horizon Walker (the "Game Software"), as it contains essential information.
By installing, copying or using the Company's game or game software or services in any way, you are deemed to have agreed to be bound by the terms and conditions of this Agreement and the Privacy Policy specified by GENTLEMANIAC Co., Ltd. ("GENTLEMANIAC" or the "Company"). Purchase and use are subject to the Valve Corporation Service Terms and User Agreements.
Article 1 [END USER LICENSE AGREEMENT]
This Agreement sets forth the basic terms and conditions regarding the use of the Game Services between the Company and the users of the GENTLEMANIAC game services (hereinafter referred to as "Users" or "Members") who use the Game Software provided by GENTLEMANIAC.
You may not use this Game Software unless you agree to this End User License Agreement (this "Agreement") and the platform terms. In addition, your use of the Game Software is subject to the STEAM Subscriber Agreement and/or other terms and conditions set by Valve, as specified in the STEAM.
If you agree to the terms and conditions outlined in this Agreement, select "Agree" to install the Game Software, indicating that you understand and agree to the terms and conditions for using the Game Software.
If you do not agree to the terms and conditions outlined in this Agreement, select "Cancel," and GENTLEMANIAC will not grant you a license (as defined below) to this Game Software.
Article 2 [OWNERSHIP]
GENTLEMANIAC retains ownership, intellectual property rights, and all rights to the Game Software and services, including all related materials (titles, computer code, themes, objects, characters, character names, stories, dialogues, slogans, locations, concepts, art, character inventories, structural or scenic designs, animations, sounds, musical compositions and recordings, audiovisual effects, storylines, character likeness, methods of operation, moral rights, and other related documents).
The GENTLEMANIAC and Horizon Walker logos are trademarks that GENTLEMANIAC has applied for or registered in Korea and other countries. GENTLEMANIAC retains all rights, titles, and interests in and to such trademarks.
The Game and all materials, information, and data included in or displayed within the Game, including documents, services, site design, text, graphics, logos, images, and icons, and all other items and their arrangement appearing on the website, are the property of GENTLEMANIAC.
You agree to the above, as well as to the copyright laws of all countries worldwide, international copyright treaties and conventions, and other laws protecting GENTLEMANIAC's rights.
Article 3 [LIMITED LICENSE TO USE]
Conditional upon your agreement to and continuing compliance with this Agreement and the Terms of Service displayed by GENTLEMANIAC within the Game, GENTLEMANIAC hereby grants you a limited, non-exclusive, non-transferable, revocable end-user license to use the Game Software for your gameplay purposes.
This license grant does not constitute a transfer of ownership of the Game Software to you, and no sale or assignment of any intellectual property rights or other rights in or to the Game Software is implied.
Except for the rights or licenses expressly granted in this Agreement, all rights in and to the Game Software and related services are reserved by GENTLEMANIAC or GENTLEMANIAC's licensors.
Article 4 [CONDITIONS AND RESTRICTIONS ON LICENSE]
You agree to use the Game Software, or any part thereof, only in a manner consistent with this License, and you shall NOT, under any circumstances:
Copy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, or create derivative works based on the Game Software, in whole or in part (except where expressly permitted by applicable law, all legal modifications, improvements, etc., and all copyrights and moral rights shall, in any event, belong exclusively to GENTLEMANIAC and its licensors).
Use cheats, automation programs (bots), hacks, and other unauthorized programs, macros, devices, or apparatus (hereinafter referred to as "Unauthorized Programs") designed to turn off technical protection measures of the services provided by GENTLEMANIAC or to interfere with regular operation or play the game abnormally.
Remove, disable, or circumvent any security software or technical measures that control access to the Game Software.
Sell, pledge, assign, rent, lease, sublicense, or otherwise transfer the Game Software or services to any other person in any manner not expressly authorized in this Agreement.
Commercially use, advertise, or exploit the Game Software or any parts without GENTLEMANIAC's prior written consent (including, but not limited to, use in cyber (internet) cafes, computer game centers, or other location-based sites).
Engage in collecting in-game currency, items, or resources for sale or perform in-game services for payment outside the game, such as power-leveling, without GENTLEMANIAC's express written consent.
Intercept information of others, the game, or the Company through the Game or services, engage in data mining, or use unauthorized third-party software.
Modify any files of the Game Software or provide the cause for modification in any manner not expressly authorized by GENTLEMANIAC.
Intercept, copy, or retransmit any communication protocol used by GENTLEMANIAC in any way, for any purpose, or unfairly use the Game to host, provide, or develop specific services.
Imitate, copy the Game Software or services, access unauthorized emulated servers, and distribute/promote or maintain such emulated servers.
Create data or executable programs that mimic the data or functionality of the Game Software.
Sell, rent, lease, sublicense, distribute, upload, or otherwise transfer any part of this Game Software or any copy thereof on any internet server or website without GENTLEMANIAC's prior written consent.
Remove, alter, deface, or circumvent any proprietary notices or labels in the Game Software.
Export or re-export the Game Software or any copies or adaptations thereof in violation of this Agreement or the laws or regulations of the country where the Game Software and services are being provided.
You also agree to comply with other relevant notices, including the agreements contained within the Game Software.
Article 5 [GENERAL]
Installation, execution, and use of this Game Software require you to create an account with "Steam" and download, install, and use the Steam software/platform. "Steam is an online service and platform provided by Valve Corporation, not GENTLEMANIAC.
Your use of your Steam account is subject to Valve Corporation's mandatory terms and conditions of use (including, but not limited to, accepting the Steam Subscriber Agreement and other policies), and such terms and conditions of use may or may not restrict the rights granted to you. Certain services and in-game features may also be provided through Steam in connection with the Game Software product under this Agreement, and such services and features are subject to Valve Corporation's mandatory terms and conditions of use.
GENTLEMANIAC is also not responsible for your Steam account or any other services or features provided by Valve Corporation or third parties.
Article 6 [GAME SOFTWARE UPDATES AND PATCHES]
GENTLEMANIAC may provide updates, patches, and other modifications to the Game Software that users must install to play the Game. GENTLEMANIAC may remotely update, patch, or modify the Game Software and may access the Game Software installed on your computer for such purposes. You hereby grant GENTLEMANIAC the right to deploy and apply such patches, updates, and modifications to the Game Software installed on your computer. The term "Game Software" used in this Agreement includes patches, updates, and modifications.
Article 7 [DISCLAIMER OF WARRANTIES]
THE GAME SOFTWARE AND RELATED SERVICES ARE PROVIDED TO YOU ON AN "AS IS" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GENTLEMANIAC DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO:
ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (INCLUDING THE SUITABILITY OF THE GAME TO YOUR OR ANY OTHER PERSON'S NEEDS OR REQUIREMENTS).
ANY WARRANTIES AGAINST INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS OR PROPRIETARY RIGHTS.
ANY WARRANTIES REGARDING THE PRECISION, RELIABILITY, ACCURACY, OR COMPLETENESS OF THE GAME SOFTWARE.
ANY WARRANTIES REGARDING THE OPERATION OF THE GAME SOFTWARE (INCLUDING ANY DELAYS, INTERRUPTIONS, ERRORS, VIRUSES, DEFECTS, OR OMISSIONS).
ANY WARRANTIES REGARDING PERFORMANCE/NON-PERFORMANCE OR OTHER ACTS OR OMISSIONS BY THIRD PARTIES.
WARRANTIES THAT MAY ARISE OUT OF THE COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
Some states or jurisdictions do not allow the exclusion of the above warranties, so the above exclusions may not apply to you. In this case, you may have different legal rights depending on your state or jurisdiction.
Article 8 [LIMITATION OF LIABILITY]
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GENTLEMAN
