End User License Agreement (EULA) for "Iron Cauldron - Guess the Colorblock"
Version 1.0 – Effective Date: 07.10.2024
This End User License Agreement ("EULA") is a legally binding agreement between you ("User," "You," or "Your") and Iron Cauldron (hereinafter referred to as the "Company" or "Iron Cauldron"), a company based in Germany, regarding the use of the software application “Iron Cauldron - Guess the Colorblock” (hereinafter referred to as the "Application," "Game," or "Software").
By installing, accessing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you must not install, access, or use the Software.
1. Grant of License
Iron Cauldron grants you a non-exclusive, non-transferable, limited, and revocable license to use the Software solely for personal, non-commercial purposes, in accordance with the terms of this EULA.
1.1. Usage Restrictions
The license to use the Software is subject to the following restrictions:
You may only use the Software on supported platforms and devices for which the Application is intended.
You may not copy the Software except for purposes of installation and usage on your personal device.
You may not modify, adapt, or alter the Software.
You are expressly prohibited from distributing, renting, leasing, or lending the Software.
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except as expressly permitted by law.
The Software must only be used in compliance with applicable laws, especially copyright law.
2. Ownership
Iron Cauldron retains all rights, title, and interest in the Software, including all intellectual property rights. The Software is protected by copyright and international treaties. All rights not expressly granted in this EULA are reserved by Iron Cauldron.
3. Use of Content
The Software may contain various content, such as graphics, text, audio, and other multimedia materials (collectively referred to as “Content”), which are protected by intellectual property rights. Iron Cauldron and/or its licensors own all rights to this Content.
3.1. User-Generated Content
Should the Software provide features allowing the creation or sharing of user-generated content, all rights to such content remain with the user. However, you grant Iron Cauldron a non-exclusive, worldwide, royalty-free right to use, modify, and publish such content in connection with the provision of the Software.
4. Updates and Changes
Iron Cauldron reserves the right, at its sole discretion, to provide updates, bug fixes, enhancements, or modifications to the Software from time to time. These updates may be installed automatically, and you agree that Iron Cauldron may implement such updates without further notification or consent.
5. Privacy
Iron Cauldron respects your privacy and is committed to protecting your personal data in accordance with applicable data protection laws. Data collection and processing are governed by our Privacy Policy, which is accessible on our website.
6. Disclaimer of Warranties
The Software is provided to you on an "as-is" and "as-available" basis. Iron Cauldron makes no express or implied warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
Iron Cauldron does not warrant that:
The Software will be uninterrupted, error-free, or free of security vulnerabilities or harmful software.
Any defects or errors in the Software will be corrected.
7. Limitation of Liability
To the fullest extent permitted by law, Iron Cauldron shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to lost profits, data loss, business interruption, or other financial losses) arising out of the use of or inability to use the Software, even if Iron Cauldron has been advised of the possibility of such damages. In any case, Iron Cauldron's liability is limited to the amount you paid for using the Software.
8. Termination of License
This EULA is effective until terminated by Iron Cauldron or the user. Your rights under this license will automatically terminate, without notice from Iron Cauldron, if you fail to comply with any of the terms of this EULA.
Upon termination of this EULA, you must immediately cease all use of the Software and delete all copies of the Software from your device.
9. Changes to the EULA
Iron Cauldron reserves the right to modify or update this EULA at its discretion at any time. Such changes will be posted on the Iron Cauldron website or displayed upon the next start of the Software. By continuing to use the Software after such changes, you agree to the modified terms.
10. Governing Law and Jurisdiction
This EULA is governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with this EULA or the use of the Software shall be subject to the exclusive jurisdiction of the courts located at Iron Cauldron's registered office.
11. Severability Clause
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The parties agree to replace any invalid or unenforceable provision with a valid provision that most closely approximates the economic intent of the invalid provision.
