1. LICENSE
By receiving, opening the file package, and/or using Gloria Victis ("Software") containing this software, you agree that this End User User License Agreement(EULA) is a legally binding and valid contract and agree to be bound by it. You agree to abide by the intellectual property laws and all of the terms and conditions of this Agreement.
Unless you have a different license agreement signed by Black Eye Games Sp. z o.o. your use of Gloria Victis indicates your acceptance of this license agreement and warranty.
Subject to the terms of this Agreement, Black Eye Games Sp. z o.o. grants to you a limited, non-exclusive, non-transferable license, without right to sub-license, to use Gloria Victis in accordance with this Agreement and any other written agreement with Black Eye Games Sp. z o.o.. Black Eye Games Sp. z o.o. does not transfer the title of Gloria Victis to you; the license granted to you is not a sale. This agreement is a binding legal agreement between Black Eye Games Sp. z o.o. and the purchasers or users of Gloria Victis .
If you do not agree to be bound by this agreement, remove Gloria Victis from your computer now and, if applicable, promptly return to Black Eye Games Sp. z o.o. by mail any copies of Gloria Victis and related documentation and packaging in your possession.
2. DISTRIBUTION
Gloria Victis and the license herein granted shall not be copied, shared, distributed, re-sold, offered for re-sale, transferred or sub-licensed in whole or in part except that you may make one copy for archive purposes only. For information about redistribution of Gloria Victis contact Black Eye Games Sp. z o.o..
3. USER AGREEMENT
3.1 Use
Your license to use Gloria Victis is limited to the number of licenses purchased by you. You shall not allow others to use, copy or evaluate copies of Gloria Victis .
3.2 Use Restrictions
You shall use Gloria Victis in compliance with all applicable laws and not for any unlawful purpose. Without limiting the foregoing, use, display or distribution of Gloria Victis together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, sexual orientation or age is strictly prohibited.
Each licensed copy of Gloria Victis may be used on one single computer location by one user. Use of Gloria Victis means that you have loaded, installed, or run Gloria Victis on a computer or similar device. If you install Gloria Victis onto a multi-user platform, server or network, each and every individual user of Gloria Victis must be licensed separately.
You may make one copy of Gloria Victis for backup purposes, providing you only have one copy installed on one computer being used by one person. Other users may not use your copy of Gloria Victis . The assignment, sublicense, networking, sale, or distribution of copies of Gloria Victis are strictly forbidden without the prior written consent of Black Eye Games Sp. z o.o.. It is a violation of this agreement to assign, sell, share, loan, rent, lease, borrow, network or transfer the use of Gloria Victis . If any person other than yourself uses Gloria Victis registered in your name, regardless of whether it is at the same time or different times, then this agreement is being violated and you are responsible for that violation!
3.3 Copyright Restriction
This Software contains copyrighted material, trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile Gloria Victis . Nor can you create any derivative works or other works that are based upon or derived from Gloria Victis in whole or in part.
Black Eye Games Sp. z o.o.'s name, logo and graphics file that represents Gloria Victis shall not be used in any way to promote products developed with Gloria Victis. Black Eye Games Sp. z o.o. retains sole and exclusive ownership of all right, title and interest in and to Gloria Victis and all Intellectual Property rights relating thereto.
Copyright law and international copyright treaty provisions protect all parts of Gloria Victis , products and services. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for Black Eye Games Sp. z o.o..
3.4 Limitation of Responsibility
You will indemnify, hold harmless, and defend Black Eye Games Sp. z o.o. , its employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of Black Eye Games Sp. z o.o.'s Software.
In no event (including, without limitation, in the event of negligence) will Black Eye Games Sp. z o.o. , its employees, agents or distributors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, Gloria Victis or the use or inability to use Gloria Victis or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence.
Black Eye Games Sp. z o.o.'s entire liability, without exception, is limited to the customers' reimbursement of the purchase price of the Software (maximum being the lesser of the amount paid by you and the suggested retail price as listed by Black Eye Games Sp. z o.o. ) in exchange for the return of the product, all copies, registration papers and manuals, and all materials that constitute a transfer of license from the customer back to Black Eye Games Sp. z o.o..
3.5. No warranties
Black Eye Games Sp. z o.o. expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided ‘As Is’ without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. Black Eye Games Sp. z o.o. does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. Black Eye Games Sp. z o.o. makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. Black Eye Games Sp. z o.o. further expressly disclaims any warranty or representation to Authorized Users or to any third party.
3.6 Governing Law
This Agreement shall be governed by the law of the Poland applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Poland therefrom. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
3.7 Termination
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of Gloria Victis and destroy all copies of Gloria Victis supplied under this Agreement. The financial obligations incurred by you shall survive the expiration or termination of this license.
3.8 Rules of Conduct
The following rules govern basic interaction within the Gloria Victis game and website.
Please be aware that failure to comply with these rules of conduct may result in the termination of your Gloria Victis game account.
In addition to these rules of conduct, explicit rules affecting your account may be found in the Gloria Victis User Agreement. Despite our best efforts to detail the different sections with specific examples, there will always be areas that will ultimately be handled on a per incident basis by the Gloria Victis Customer Service Team. Even when not specified, Black Eye Games Sp. Z o.o. have the sole right and final judgment of how to interpret and apply these rules and guidelines to any specific circumstance and situation, including proper punishment or exception. We reserve the right, in our sole and absolute discretion, to change, modify, add or remove portions of these rules at any time.
– While playing Gloria Victis, you must respect the rights of others and their rights to play and enjoy the game. To this end, you may not defraud, harass, threaten, or cause distress and/or unwanted attention to other players.
– You may not post or communicate any player's real-world information (name, address, account name, etc.) through the Gloria Victis game or on the official Gloria Victis website, or any Gloria Victis related social media.
– You may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language or graphics as your player/guild logo.
– You may not post or link or create any sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive imagery or content.
– You may not impersonate any employee of Black Eye Games Sp z o.o. or their affiliates or any other players/guilds.
– You may not violate any local, state, national, or international laws or regulations.
– You may not market, promote, advertise, or solicit within the Gloria Victis game.
– You may not modify any part of the Gloria Victis Client, Server, or any part of the official Gloria Victis website.
– You may not organize nor be a member of any pledges or groups within Gloria Victis that are based on or espouse any racist, sexist, anti-religious, anti-ethnic, anti-gay, or other hate-mongering philosophies.
– You will not attempt to interfere with, hack into, or decipher any transmissions to or from the servers or client running Gloria Victis game.
– You will not exploit any bug in Gloria Victis and you will not communicate the existence of any such exploitable bug (bugs that grant the user unnatural or unintended benefits) either directly or through public posting, to any other user of Gloria Victis. Bugs should be promptly reported via the ‘Report Bug’ tool in-game or using mail support@gloriavictisgame.com.
– You may not use alternative accounts to benefit your game rankings position, balance state on servers, and to harm the game, balance system, or other players.
– You will not create, use, or provide any server emulator or other site where Gloria Victis may be played, and you will not post or distribute any utilities, emulators or other software tools related to Gloria Victis without the express written permission of Black Eye Games Sp. Z o.o.
– You may not use any third-party program (such as a "bot") in order to automate gameplay functions, including playing, chatting, interacting, or gathering items within Gloria Victis. You may not assist, relay, or store items for other players who are using these processes.
– You may not use names/images for your characters that target other players or have offensive racial, ethnic, national, or cultural connotations, include hate speech or bigoted slurs, reference sexual acts or real-life violence, are pornographic, make inappropriate references to human anatomy or bodily functions, reference illegal drugs or activities, reference religious or historical figures and symbols, reference real-life people, reference names of copyrighted or trademarked characters, materials, or products, use misspellings or alternative spellings of names that violate any of the above rules
– You may not use the in-game features, chat, or other media, such as Discord servers and channels to harm the game, for example by asking people to leave the game or their nation or not join the official Discord server for sake of weakening the community, in-game nation or group of players.
As our game is not using any peer-to-peer connection, the usage of third-party software to obfuscate the identity (for example bypassing bans or in-game abuse prevention systems) is not supported. Using such tools can result in troubles in connection and/or in an account suspension.
4.Ownership By Black Eye Games Sp. z o.o. Black Eye Games Sp. z o.o. is the owner or licensee of all right, title, and interest in and to the Gloria Victis, gloriavictisgame.com, accounts, and all of the features and components thereof. Gloria Victis may contain materials licensed by third-parties to Black Eye Games Sp. z o.o., and these third-parties may enforce their ownership rights against you in the event that you violate this Agreement. Black Eye Games Sp. z o.o. owns and/or licences the following:
All virtual content appearing within Gloria Victis, such as Visual Components, locations, artwork, structural or landscape designs, animations, audio-visual effects, narrations themes, concepts, stories, storylines, characters and their names, likenesses, inventories, catch phrases of characters, items including virtual goods, currency, potions, wearable items, mounts, etc.;
All data and communications generated by, or occurring through, Gloria Victis including all sounds, musical compositions, recordings, sound effects, game replays, or reenactments of in-game events, battles, duels, etc.;
Computer code, including but not limited to source code;
Titles, methods of operation, software, related documentation, and all other original works of authorship contained in Gloria Victis;
All Accounts. Note that Black Eye Games Sp. z o.o. owns all Accounts, and that all use of an Account shall inure to Black Eye Games Sp. z o.o. benefit. Black Eye Games Sp. z o.o. does not recognize the transfer of Accounts. You may not purchase, sell, gift or trade any Account, or offer to purchase, sell, gift, or trade any Account, and any such attempt shall be null and void and may result in the forfeiture of the Account;
4.1 Users are prohibited from selling, purchasing, renting, leasing, offering, accepting, disseminating or copying Virtual Benefits, including Virtual Currency, within and/or outside the Game - in whatever form – to/from third parties. An in game-system provided by the Game or by Black Eye Games sp. z o. o. to trade Virtual Benefits of the Game constitutes such an exception. In this case, the transfer of Virtual Benefits from one User to the other is only permitted if the transfer takes place - no matter if within or outside the Game – either without any form of consideration or with consideration if the consideration consists solely of Virtual Property or Virtual Currency of the Game and such is transferred within the Game itself or via a function provided by the Game. The acquisition of Virtual Benefits in exchange for any form of consideration other than Virtual Property or Virtual Currency of the Game is expressly prohibited. If the User trades or exchanges Virtual Benefits on a large scale without a comparable value obtained within the Game, then it is assumed that the User violates this rule. The User is entitled to provide counter-evidence.
5. DISCLAIMER OF WARRANTY
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. THIS DISCLAIMER CONCERNS ALL FILES GENERATED AND EDITED BY Gloria Victis AS WELL.
6. CONSENT OF USE OF DATA
You agree that Black Eye Games Sp. z o.o. may collect and use information gathered in any manner as part of the product support services provided to you, if any, related to Gloria Victis .Black Eye Games Sp. z o.o. may also use this information to provide notices to you which may be of use or interest to you.
7 WARNING.
A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. Exposure to certain patterns or backgrounds when playing may trigger epileptic seizures or blackouts in these individuals. These conditions may trigger previously undetected epileptic symptoms or seizures in persons who have no history of prior seizures or epilepsy. If you, or anyone in your family has an epileptic condition or has had seizures of any kind, consult your physician before playing. IMMEDIATELY DISCONTINUE use and consult your physician before resuming gameplay.

You may not purchase, sell, gift or trade any Account, or offer to purchase, sell, gift, or trade any Account, and any such attempt shall be null and void and may result in the forfeiture of the Account;
4.1 Users are prohibited from selling, purchasing, renting, leasing, offering, accepting, disseminating or copying Virtual Benefits, including Virtual Currency, within and/or outside the Game - in whatever form – to/from third parties. An in game-system provided by the Game or by Black Eye Games sp. z o. o. to trade Virtual Benefits of the Game constitutes such an exception. In this case, the transfer of Virtual Benefits from one User to the other is only permitted if the transfer takes place - no matter if within or outside the Game – either without any form of consideration or with consideration if the consideration consists solely of Virtual Property or Virtual Currency of the Game and such is transferred within the Game itself or via a function provided by the Game. The acquisition of Virtual Benefits in exchange for any form of consideration other than Virtual Property or Virtual Currency of the Game is expressly prohibited. If the User trades or exchanges Virtual Benefits on a large scale without a comparable value obtained within the Game, then it is assumed that the User violates this rule. The User is entitled to provide counter-evidence.
