END USER LICENSE AGREEMENT (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Lifeblood Games ("Company") for the use of the software product "Forgotten Depths" ("Game"), which includes all associated media, content, and services.
1. LICENSE GRANT
Lifeblood Games grants you a limited, non-exclusive, non-transferable, and revocable license to install and use "Forgotten Depths" on a personal computer or gaming device solely for personal, non-commercial use, subject to the terms of this Agreement. All rights not expressly granted are reserved by Lifeblood Games.
2. OWNERSHIP
The Game and all associated intellectual property, including but not limited to the software code, artwork, music, sound effects, story, and all other related assets, are the property of Lifeblood Games and are protected by copyright, trademark, and other intellectual property laws. You acknowledge that no title or ownership rights in the Game are transferred to you under this Agreement.
3. RESTRICTIONS
You agree not to:
Copy, modify, or distribute the Game, in whole or in part, except as expressly allowed by this Agreement.
Reverse engineer, decompile, or disassemble the Game or any of its components.
Create derivative works based on the Game.
Use the Game for any commercial purpose without the express written consent of Lifeblood Games.
Circumvent any technological measures designed to protect the Game.
4. USER GENERATED CONTENT
The Game may allow you to create, upload, or share content ("User Content"). By submitting User Content, you grant Lifeblood Games a worldwide, perpetual, royalty-free license to use, modify, distribute, and display such content in connection with the Game. You represent that your User Content does not violate any third-party rights or applicable laws.
5. TERMINATION
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must immediately cease all use of the Game and delete all copies of the Game in your possession or control.
6. LIMITED WARRANTY
The Game is provided "AS IS" without any warranties, express or implied. Lifeblood Games does not guarantee that the Game will be error-free or that it will function without interruption. To the extent permitted by law, Lifeblood Games disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. LIABILITY LIMITATION
In no event shall Lifeblood Games be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Game, even if Lifeblood Games has been advised of the possibility of such damages. Lifeblood Games’ total liability shall not exceed the amount paid by you for the Game.
8. GOVERNING LAW
This Agreement is governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. You agree that any legal action arising from this Agreement will be filed in the courts of [Your Country], and you consent to the exclusive jurisdiction of such courts.
9. AMENDMENTS
Lifeblood Games reserves the right to modify this Agreement at any time. Any changes will be effective upon posting on the Company’s website or within the Game. Your continued use of the Game following any changes constitutes acceptance of the updated Agreement.
