END USER LICENSE AGREEMENT (EULA) FOR DEEP IN ENEMY TERRITORY

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and CowDogGames ("Developer," "We," "Us," or "Our") governing your use of the video game Deep in Enemy Territory ("Game") distributed through the Steam platform. By installing, accessing, or playing the Game, You agree to be bound by the terms of this EULA and the Steam Subscriber Agreement (available at store.steampowered.com/subscriber_agreement/). If You do not agree to these terms, do not install, access, or use the Game.
1. GRANT OF LICENSE
Subject to Your compliance with this EULA and the Steam Subscriber Agreement, Developer grants You a limited, non-exclusive, non-transferable, revocable license to install and use the Game for personal, non-commercial purposes on a device You own or control. The Game is licensed, not sold. All rights not expressly granted are reserved by Developer.
2. STEAM INTEGRATION
Your use of the Game is subject to the terms and conditions of the Steam Subscriber Agreement and any other terms set forth by Valve Corporation ("Valve") in relation to the Steam service. You acknowledge that:
The Game may require a Steam account and an active internet connection for authentication, updates, or online features.
Valve may update the Game automatically via Steam, and system requirements may change over time.
Any disputes related to Steam’s services are governed by Valve’s terms, not this EULA.
3. OWNERSHIP AND INTELLECTUAL PROPERTY
The Game, including all software, graphics, audio, text, and other materials, is owned by Developer or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works from the Game except as permitted by applicable law or expressly allowed by Developer.
4. GAME CONTENT AND HISTORICAL CONTEXT
4.1 Setting and Inspiration: Deep in Enemy Territory is a fictional video game set during the Vietnam War. It is inspired by historical events and locations but is not a factual representation. All events, scenarios, and depictions are created for entertainment purposes and should not be interpreted as historical documentation.
4.2 No Representation of Real Persons: All characters in the Game are fictional and not intended to depict real persons, living or deceased. Any resemblance to actual individuals is purely coincidental and unintentional. Where historical or public figures are referenced, such references are intended solely for parody or satire, as permitted under applicable law, and not as factual portrayals.
4.3 Content Disclaimer: The Game may contain themes of war, violence, and historical conflict, which may be sensitive to some Users. By accessing the Game, You acknowledge that such content is fictional and assume all risks associated with its use.
5. HEALTH AND SAFETY WARNINGS AND LIMITATION OF LIABILITY
5.1 Physical and Mental Health Risks: The Game contains intense, frightening, realistic, gory, sexually explicit, or violent content, including graphic depictions of combat, disturbing imagery, or mature themes. Such content may cause physical reactions (e.g., epileptic seizures, heart palpitations, or other medical conditions) or mental health effects (e.g., anxiety, distress, or trauma) in some Users. Specifically:
The Game includes flashing lights, rapid imagery, or other stimuli that could trigger seizures or other adverse reactions in individuals with photosensitive epilepsy or similar conditions.
The Game’s violent or sexually explicit scenes may trigger post-traumatic stress disorder (PTSD) or exacerbate existing mental health conditions, particularly for individuals with a history of trauma related to war, violence, or sexual content.
You are responsible for assessing Your physical and mental health before playing and for taking appropriate precautions, such as consulting a medical professional if You have a history of seizures, heart conditions, PTSD, or other mental health concerns.
5.2 No Liability for Health Impacts: To the fullest extent permitted by law, Developer shall not be liable for any physical injuries (including but not limited to epileptic seizures, heart attacks, or other medical conditions) or mental health effects (including but not limited to emotional distress, anxiety, psychological trauma, or triggering of PTSD) arising from Your use of the Game, whether due to its frightening, realistic, gory, sexually explicit, or violent content or any other feature.
5.3 Content Liability: Developer shall not be liable for any claims, damages, or legal actions arising from the Game’s content, including but not limited to claims of defamation, emotional distress, or offense related to its depiction of historical events, fictional characters, or themes. You acknowledge that the Game is a work of fiction and that Developer does not endorse or condone any actions depicted therein.
5.4 General Limitation: Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from Your use of the Game, even if advised of the possibility of such damages. Developer’s total liability to You shall not exceed the amount You paid for the Game via Steam, if any.
5.5 Steam-Related Limitations: Developer is not responsible for interruptions, delays, or issues caused by Steam’s platform, internet connectivity, or third-party services integrated with the Game.
6. USER CONDUCT
You agree not to:
Use the Game for unlawful purposes or in violation of this EULA or Steam’s terms.
Modify, hack, or exploit the Game, or distribute harmful content (e.g., viruses).
Engage in behavior that disrupts other Users’ experiences, as governed by Steam’s community guidelines.
7. TERMINATION
This EULA is effective until terminated. You may terminate it by uninstalling the Game and destroying all copies. Developer or Valve may terminate this EULA if You breach its terms or Steam’s terms. Upon termination, You must cease all use of the Game and delete all copies in Your possession.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Developer, its affiliates, licensors, and Valve from any claims, losses, or damages, including legal fees, arising from Your use of the Game or violation of this EULA.
9. NO WARRANTY
The Game is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Developer does not guarantee that the Game will be error-free, secure, or uninterrupted.
10. GOVERNING LAW
This EULA shall be governed by the laws of Ontario, Canada, excluding its conflict of law principles. Any disputes arising under this EULA shall be resolved in the courts located in Ontario, Canada. You acknowledge that Valve’s Steam Subscriber Agreement may specify different governing law for Steam-related disputes.
11. AMENDMENTS
Developer may amend this EULA at its discretion, with changes communicated via Steam. Continued use of the Game after such changes constitutes Your acceptance of the updated terms.
12. AGE RESTRICTION
You represent that You are at least 19 years of age. The Game is intended for mature audiences and contains content unsuitable for individuals under 19.
13. MISCELLANEOUS
13.1 Entire Agreement: This EULA, together with the Steam Subscriber Agreement, constitutes the entire agreement between You and Developer regarding the Game.
13.2 Severability: If any provision of this EULA is found invalid or unenforceable, the remaining provisions shall remain in effect.
13.3 No Waiver: Developer’s failure to enforce any right under this EULA shall not constitute a waiver of that right.
