END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Digital DiLeo ("Licensor") for the use of "Banana Next Gen" ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.
1. License Grant
Licensor grants you a limited, non-exclusive, non-transferable, and revocable license to use one copy of the Software for your personal, non-commercial use, subject to the terms and conditions of this Agreement.
2. Ownership
The Software is licensed, not sold. Licensor retains all ownership, rights, title, and interest in and to the Software and all associated intellectual property rights.
3. Restrictions
You may not:
a) Modify, adapt, translate, or create derivative works of the Software.
b) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software, except as permitted by applicable law.
c) Redistribute, sublicense, or lease the Software or use it for any commercial purpose.
d) Remove or alter any proprietary notices or labels on the Software.
4. Updates
Licensor may provide updates or patches to the Software. Any updates provided will be subject to the terms of this Agreement.
5. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with its terms. Upon termination, you must cease all use of the Software and destroy all copies of it.
6. Disclaimer of Warranties
The Software is provided "AS IS" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Licensor shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Software, even if advised of the possibility of such damages.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles.
9. Severability
If any provision of this Agreement is found to be unenforceable or invalid, it shall be modified to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and Licensor regarding the use of the Software and supersedes all prior or contemporaneous understandings.
