End-User License Agreement (EULA) for Legends of Elysium
This End-User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and DA Games OU, with its registered office at Harju maakond, Lasnamae linnaosa, Lootsa tn 5, 11415 Tallinn, Estonia ("Company" or "We"), for the use of the game Legends of Elysium ("Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement.
1. Grant of License
We grant you a non-exclusive, non-transferable, limited license to use the Game for personal, non-commercial purposes, subject to the terms and conditions of this Agreement. You may install and use one copy of the Game on your personal device. All rights not explicitly granted are reserved by the Company.
2. Restrictions
You agree to the following restrictions:
You may not distribute, sell, lease, rent, or sublicense the Game.
You may not modify, reverse engineer, decompile, or disassemble any part of the Game.
You may not use the Game to engage in unauthorized exploitation of in-game assets, including but not limited to botting, hacking, cheating, or exploiting bugs.
You may not use the Game in a way that violates the rights of others or the community guidelines of the Game.
3. Intellectual Property
The Game and all related assets, including but not limited to text, graphics, logos, and sound, are the intellectual property of the Company or its licensors. You may not reproduce, duplicate, copy, modify, or use any part of the Game or its assets without the prior written permission of the Company.
4. Termination of License
We reserve the right to terminate your license to use the Game immediately if you breach any of the terms of this Agreement. Upon termination, you must cease all use of the Game and delete all copies of the Game from your devices.
5. User Data and Privacy
By using the Game, you agree that the Company may collect and process certain information about you, including gameplay data. This data will be used in accordance with our Privacy Policy. The Company may use this data to improve the Game and for analytical purposes. We will not share your personal data with third parties without your explicit consent, except as required by law.
6. Warranty Disclaimer
The Game is provided "as is" and "as available," without any warranties of any kind, express or implied. The Company does not warrant that the Game will be error-free or uninterrupted. You assume all risk associated with the use of the Game. To the maximum extent permitted by law, the Company disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or interruption of business, arising out of or in connection with your use of or inability to use the Game.
8. Purchases and In-Game Content
All purchases made in the Game, including virtual currency and other digital assets, are final and non-refundable, except as required by law. The Company reserves the right to change or discontinue virtual currency and in-game items at any time. You acknowledge that you have no ownership rights to any virtual items, and any items obtained in the Game are licensed to you, not owned.
9. Modification of Agreement
We reserve the right to modify this Agreement at any time. Any changes will be communicated through the Game or via email. Your continued use of the Game after changes are made constitutes your acceptance of the new terms. If you do not agree to the modified terms, you must stop using the Game and delete all copies.
10. Dispute Resolution and Governing Law
This Agreement is governed by and construed in accordance with the laws of Estonia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Estonia. In the event of a dispute, we encourage you to first contact our support team at support@legendsofelysium.io or via our official Discord server to attempt to resolve the matter informally.
