End-User License Agreement
1. Agreement to Terms
This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "you," or "your") and Mossy Pebble Interactive ("Developer," "we," "us," or "our") for the use of the video game Butterfly Chase (the "Game"), including all related documentation, updates, and supplemental materials.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE GAME. If you obtained the Game through Steam, your use of Steam is also subject to the Steam Subscriber Agreement.
BY INSTALLING THE GAME YOU:
(A) ACKNOWLEDGE THAT YOU HAVE READ THIS EULA
(B) AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS
(C) ARE AUTHORIZED AND ABLE TO ACCEPT THIS EULA.
2. License Grant
Subject to your compliance with this Agreement, Mossy Pebble Interactive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
• Download and install one copy of the Game on a device you own or control;
• Access and play the Game for your personal, non-commercial entertainment purposes;
• Make one backup copy of the Game for archival purposes only.
This license does not transfer any ownership of the Game or any intellectual property rights. All rights not expressly granted are reserved by Mossy Pebble Interactive.
3. Restrictions on Use
You agree that you will NOT:
• Copy, reproduce, or distribute the Game itself (i.e., the installable game files) without prior written consent;
• Sell, rent, lease, lend, sublicense, or otherwise transfer the Game or your rights under this Agreement to any third party;
• Reverse engineer, decompile, or disassemble the Game's source code or underlying systems, except to the extent expressly permitted by applicable law;
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in or on the Game;
• Use cheat software, exploits, hacks, or any unauthorized third-party programs that interact with or modify the Game in ways not sanctioned by this Agreement;
• Use the Game in any manner that violates any applicable local, state, national, or international law or regulation.
3.1 Permitted Activities — Streaming and Video Content
Mossy Pebble Interactive expressly permits you to create and publish videos, live streams, Let's Plays, reviews, tutorials, and other video content featuring gameplay from Butterfly Chase, including on platforms such as YouTube, Twitch, and similar services. This permission includes monetization of such content through platform advertising programs (e.g., YouTube Partner Program, Twitch subscriptions), provided that:
• The content is your own original commentary, reaction, or creative work and is not simply a full reproduction of the Game's story or cutscenes presented as a substitute for playing the Game;
• You do not claim ownership of the Game, its assets, or its intellectual property;
• You credit the Game as "Butterfly Chase by Mossy Pebble Interactive" in a visible or accessible location (e.g., video description).
Mossy Pebble Interactive reserves the right to withdraw this permission for specific channels or content at its sole discretion if content is found to be harmful, defamatory, or misrepresentative of the Game or the Developer.
3.2 Permitted Activities — Modifications (Mods)
Mossy Pebble Interactive permits you to create modifications ("Mods") to your personal copy of Butterfly Chase, subject to the following conditions:
• Mods may be shared freely with other players for free, provided they are distributed as standalone modification files and not as a repackaged or standalone version of the Game itself;
• Mods must not include copyrighted assets owned by third parties (including but not limited to music, artwork, or code) without proper authorization from those rights holders;
• Mods must not be sold or distributed commercially without prior written permission from Mossy Pebble Interactive;
• You must clearly label your Mod as unofficial and not endorsed by Mossy Pebble Interactive;
• Mossy Pebble Interactive is not responsible for any damage, instability, data loss, or issues caused by the use of Mods;
• Mossy Pebble Interactive reserves the right to update the Game in ways that may break compatibility with existing Mods, and has no obligation to maintain such compatibility.
Any Mod you create remains your own creative work; however, to the extent your Mod incorporates or is derived from the Game's original assets, Mossy Pebble Interactive retains all rights to those underlying elements.
4. Intellectual Property
Butterfly Chase as a compiled work — including its original code, game design, character concepts, storylines, dialogue, level design, and other original creative elements — is the property of Mossy Pebble Interactive and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
Certain assets incorporated into the Game, including artwork, graphics, music, and audio, may have been created by third-party artists and musicians and licensed to Mossy Pebble Interactive for use in the Game. These assets remain the intellectual property of their respective original creators and are used by Mossy Pebble Interactive under license. Where required by the applicable license, credit is provided to the original creators within the Game or its accompanying materials. Nothing in this Agreement transfers ownership of those third-party assets to Mossy Pebble Interactive or to you.
You acknowledge that no title to or ownership of any intellectual property in the Game is transferred to you under this Agreement. Any feedback, suggestions, or ideas you provide regarding the Game may be used by Mossy Pebble Interactive without any obligation to you.
5. Distribution via Steam
The Game is distributed through the Steam platform operated by Valve Corporation. Your access to and purchase of the Game through Steam is also governed by the Steam Subscriber Agreement and Steam's refund policies. Mossy Pebble Interactive is not responsible for any issues arising from Steam's platform, services, or policies.
Steam may impose additional terms, conditions, or restrictions on your use of the Game. In the event of a conflict between this Agreement and Steam's terms regarding the Game, the terms most protective of Mossy Pebble Interactive's intellectual property rights shall apply.
6. Voluntary Donations
Mossy Pebble Interactive may provide an optional mechanism through which you may make a voluntary financial donation to support the development of Butterfly Chase and future projects. You acknowledge and agree to all of the following:
• All donations are entirely voluntary and are not required to access any feature, content, or functionality of the Game;
• Donations do not entitle you to any additional rights, content, services, compensation, or refunds beyond those available to all users;
• Donations are non-refundable once processed, except as required by applicable law;
• Donations are not purchases of goods or services and carry no warranty or guarantee of any kind;
• Mossy Pebble Interactive retains full discretion over how donated funds are used;
• No donation creates any employment, partnership, or ownership relationship between you and Mossy Pebble Interactive.
7. Updates and Changes to the Game
Mossy Pebble Interactive reserves the right to update, modify, patch, or discontinue the Game or any feature thereof at any time, with or without notice to you. Updates may be automatically applied through Steam. Continued use of the Game after any update constitutes your acceptance of any changes made.
We are under no obligation to provide updates, patches, bug fixes, or new content. We may discontinue support for the Game at any time without liability.
8. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSSY PEBBLE INTERACTIVE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
• Any warranty that the Game will be uninterrupted, error-free, or free of viruses or other harmful components;
• Any warranty that defects in the Game will be corrected;
• Any warranty regarding the accuracy, reliability, or completeness of any content within the Game.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not fully apply to you.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOSSY PEBBLE INTERACTIVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE GAME, EVEN IF MOSSY PEBBLE INTERACTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL MOSSY PEBBLE INTERACTIVE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE GAME EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE GAME OR (B) TEN UNITED STATES DOLLARS (USD $10.00).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not fully apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Mossy Pebble Interactive from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to the Game; (b) your violation of any term of this Agreement; or (c) your violation of any third-party right, including any intellectual property or privacy right.
11. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and destroy all copies in your possession or control.
Mossy Pebble Interactive may also terminate this Agreement at any time for any reason by providing notice to you. Sections 4, 8, 9, 10, 12, 13, and 14 of this Agreement shall survive any termination.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the United States and the state in which Mossy Pebble Interactive is located, without regard to its conflict of law principles.
Any dispute arising out of or relating to this Agreement or the Game that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA). The arbitration shall take place in the state where Mossy Pebble Interactive is located. You waive any right to a jury trial or to participate in a class action lawsuit with respect to any claim arising under this Agreement.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
13. Changes to This Agreement
Mossy Pebble Interactive reserves the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement within the Game, on our Steam store page, or through other reasonable means. Your continued use of the Game after any such modification constitutes your acceptance of the updated Agreement. If you do not agree to the modified terms, you must stop using the Game.
14. General Provisions
Entire Agreement. This Agreement constitutes the entire agreement between you and Mossy Pebble Interactive regarding the Game and supersedes all prior understandings and agreements.
Severability. If any provision of this Agreement is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No Waiver. Failure by Mossy Pebble Interactive to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that provision.
Assignment. You may not assign or transfer this Agreement or any of your rights or obligations hereunder without the prior written consent of Mossy Pebble Interactive. Mossy Pebble Interactive may freely assign this Agreement.

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING EULA AND AGREE THAT BY INSTALLING, DOWNLOADING, ACCESSING, OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND CONDITIONS OF THIS EULA.
