This End User License Agreement ("EULA") is an agreement between you ("User") and D.D.I. Medina ("Owner") regarding your use of the video game Be Quick: Rise of Fraya, including the software, characters, story, artwork, videos, audio, music, designs, code, logos, names, documentation, updates, and any related content (collectively, the "Game").
By installing, running, accessing, or using the Game, you accept this EULA. If you do not accept these terms, you must not install, run, or use the Game.
1. Limited license
The Owner grants you a limited, personal, revocable, non-exclusive, non-transferable, non-commercial license to install and use a legitimate copy of the Game solely for personal entertainment.
The Game is licensed, not sold. This EULA does not transfer any ownership rights in the Game, Fraya, its characters, world, story, visual or audio assets, code, or any related materials.
2. Intellectual property
The Owner retains all rights, title, and interest in and to the Game and its contents, including copyrights, trademarks, designs, characters, names, logos, audiovisual materials, music, sounds, text, scripts, images, animations, files, code, and any other protected material.
Nothing in the Game may be interpreted as an assignment, sale, or general authorization to use the Owner's intellectual property beyond the rights expressly granted in this EULA.
3. Prohibited uses
You may not, directly or indirectly:
Copy, sell, rent, lend, sublicense, distribute, publish, share, or make available the Game or any part of the Game without the Owner's written authorization.
Pirate, crack, bypass protections, alter license files, modify executables, or facilitate unauthorized access to the Game.
Extract, reuse, republish, sell, or distribute Game assets, including images, videos, music, sounds, models, text, code, characters, names, logos, or designs.
Reverse engineer, decompile, disassemble, derive source code from, modify, or create unauthorized versions of the Game, except where expressly permitted by applicable law.
Use the Game or its contents for commercial purposes without the Owner's written authorization.
Use the Game, Fraya, its characters, designs, voices, story, world, artwork, names, or related materials to create, train, publish, sell, distribute, or promote sexual, pornographic, explicit, degrading, humiliating, abusive, exploitative, or unauthorized content.
Use the Game or its contents in any way that infringes the Owner's rights, third-party rights, applicable laws, platform rules, Steam rules, or this EULA.
Present your own content as official, authorized, sponsored, or approved by the Owner when it is not.
4. User-generated content
If the Game, a community, a platform, a forum, Steam Workshop, or another service allows user-generated content, you are responsible for ensuring that such content complies with this EULA and applicable law.
The Owner may request removal of content that uses the Game or its elements without authorization, including content that infringes intellectual property, unauthorized sexual or explicit content, unauthorized commercial content, misleading content, or content that harms the image of the Game or its characters.
The Owner does not approve or authorize user-generated content unless there is express written authorization.
5. Enforcement
If the Owner detects or receives notice of unauthorized use of the Game or its contents, the Owner may take reasonable measures to protect its rights. These measures may include:
Requesting removal of infringing content.
Reporting the infringement to Steam, social networks, stores, hosting providers, payment processors, or other platforms.
Sending a formal Cease and Desist notice.
Revoking the license granted under this EULA.
Taking legal action or claiming damages where permitted by applicable law.
The Owner's failure to act immediately against an infringement does not mean the Owner waives any rights.
6. Updates and changes
The Owner may release updates, fixes, improvements, or changes to the Game. Some updates may be required to maintain the Game's functionality, security, or compatibility.
The Owner may also update this EULA. If you continue using the Game after an updated version is published, you will be deemed to accept the updated terms, to the extent permitted by applicable law.
7. Third-party services and platforms
Use of the Game on Steam or other platforms may also be subject to the terms, rules, and policies of those platforms. You must comply with those terms in addition to this EULA.
Steam and the Steam logo are trademarks and/or registered trademarks of Valve Corporation in the U.S. and/or other countries.
8. Warranties
To the extent permitted by applicable law, the Game is provided "as is" and "as available," without warranties of uninterrupted operation, absence of errors, compatibility with all devices, or fitness for a particular purpose.
Nothing in this EULA limits any non-waivable legal rights you may have as a consumer under applicable law.
9. Limitation of liability
To the extent permitted by applicable law, the Owner will not be liable for indirect, incidental, special, consequential damages, data loss, lost profits, business interruption, or damages arising from the use of or inability to use the Game.
10. Termination
This EULA will terminate automatically if you violate its terms. Upon termination, you must stop using the Game and delete any unauthorized copies or extracted Game materials in your possession or control.
The sections regarding intellectual property, prohibited uses, enforcement, limitation of liability, and any other provisions that by their nature should survive will remain in effect after termination.
