END-USER LICENSE AGREEMENT (EULA)

for "You Can't See Ghosts!" by SimplyPassionGames

Effective Date: 2025-04-11

This End-User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Donatas K., operating as SimplyPassionGames ("Licensor"), for the software product You Can't See Ghosts! ("Game").

By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement.

1. License Grant
The Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use one copy of the Game on a personal computer for non-commercial entertainment purposes.

2. Ownership
The Game is licensed, not sold. The Licensor retains all right, title, and interest in and to the Game, including all intellectual property rights.

3. Permitted Use
You may:
- Install and play the Game for personal use.
- Create and distribute mods, provided they are non-commercial and do not include any original assets from the Game.
- Record and share gameplay videos or streams for non-commercial or monetized content on platforms like YouTube and Twitch.

4. Restrictions
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code.
- Modify, adapt, translate, or create derivative works of the Game other than mods as permitted above.
- Sell, sublicense, rent, lease, or distribute the Game or any part of it to third parties.
- Use the Game for any commercial purpose without explicit written permission from the Licensor.

5. Termination
This Agreement is effective until terminated. The Licensor may terminate this Agreement at any time if you fail to comply with its terms. Upon termination, you must destroy all copies of the Game in your possession.

6. Disclaimer of Warranty
The Game is provided "as is" without warranty of any kind, express or implied. The Licensor does not guarantee that the Game will operate without interruption or be error-free.

7. Limitation of Liability
In no event shall the Licensor be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Game.

8. Updates and Modifications
The Game may be updated or modified at the Licensor’s discretion. These updates may change or remove certain features or content. Your continued use of the Game constitutes acceptance of such changes.

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Lithuania and applicable European Union regulations, without regard to conflict of laws principles.

10. Beta Version Clause
If you are using a beta, pre-release, or private testing version of the Game ("Beta Version"), you acknowledge that the Game is in development, may contain bugs or incomplete features, and is provided "as is" without any warranties. You agree not to share, record, distribute, or disclose any content, feedback, or gameplay from the Beta Version to the public unless explicitly authorized by the Licensor. Access to the Beta Version is granted at the Licensor’s discretion and may be revoked at any time. The Licensor is under no obligation to provide support or updates for Beta Versions.

11. Entire Agreement
This Agreement constitutes the entire agreement between you and the Licensor regarding the Game and supersedes all prior agreements.
