1. Agreement
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and FOOYA Games for the use of the software product, I Come In Peace, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software Product").
By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software Product.
2. License Grant
FOOYA Games grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software Product solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.
3. Restrictions
You agree not to, and you will not permit others to:
License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Software Product or make the Software Product available to any third party.
Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Software Product.
Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of FOOYA Games or its affiliates, partners, suppliers, or the licensors of the Software Product.
4. Intellectual Property
The Software Product, including all intellectual property rights therein, is and shall remain the property of FOOYA Games. This EULA does not transfer any intellectual property rights to you. You are granted a limited license to use the game under the terms of this EULA.
5. User-Generated Content
If the Software Product allows for user-generated content (UGC), you grant FOOYA Games a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the UGC in connection with the Software Product. You agree not to upload any content that is illegal, offensive, or infringes on intellectual property rights.
6. Privacy and Data Collection
The collection and use of personal data are governed by our Privacy Policy, which you can review here. By using the Software Product, you consent to the terms of the Privacy Policy.
7. Online Features and Services
FOOYA Games does not guarantee the availability of online features or services. We may modify or discontinue online services at any time without notice and without liability to you. Refunds for the base game due to the discontinuation of online services will not be provided.
8. Downloadable Content (DLC)
This EULA covers any downloadable content (DLC) provided by FOOYA Games. Sales of DLC are subject to applicable consumer protection laws.
9. Modding and Editing Tools
If the Software Product includes modding tools, you are granted a license to create non-commercial mods. Commercial use of mods or distribution of mods for a fee is prohibited.
10. Updates
FOOYA Games may from time to time provide enhancements or improvements to the features/functionality of the Software Product, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates will be deemed to constitute an integral part of the Software Product and are subject to the terms of this EULA.
11. Termination
This EULA is effective until terminated by you or FOOYA Games. Your rights under this EULA will terminate automatically without notice from FOOYA Games if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software Product and uninstall it from your device.
12. Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of FOOYA Games and any of its suppliers under any provision of this EULA and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Software Product. In no event shall FOOYA Games or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.
13. Governing Law and Dispute Resolution
This EULA shall be governed by and construed in accordance with the laws of Israel. Any disputes arising under or in connection with this EULA shall be resolved through mediation or arbitration, as determined by FOOYA Games.
14. Entire Agreement
This EULA constitutes the entire agreement between you and FOOYA Games regarding your use of the Software Product and supersedes all prior and contemporaneous written or oral agreements between you and FOOYA Games. If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
