**END USER LICENSE AGREEMENT (EULA) FOR "SEEING RED"**
**IMPORTANT**: PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE INSTALLING, ACCESSING, OR USING THE "SEEING RED" VIDEO GAME AND ANY RELATED CONTENT OR ARTWORK ("SOFTWARE"). BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL, ACCESS, OR USE THE SOFTWARE.
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Lyterian Games ("Licensor" or "We") regarding your use of the video game "Seeing Red" and all related content, art, software, updates, and accompanying documentation ("Software").
**1. GRANT OF LICENSE**
Subject to the terms of this Agreement, Licensor grants you a non-exclusive, non-transferable, limited, and revocable license to install, access, and use the Software solely for your personal, non-commercial use on devices that you own or control.
**2. LICENSE RESTRICTIONS**
You agree not to:
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software, except as expressly permitted by applicable law.
- Rent, lease, loan, sell, distribute, or sublicense the Software or any of its components.
- Use the Software for any commercial purpose without prior written consent from Lyterian Games.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
- Use the Software to infringe upon or violate the rights of any third party, including intellectual property rights.
**3. OWNERSHIP AND INTELLECTUAL PROPERTY**
All rights, title, and interest in and to the Software, including all content, art, graphics, characters, designs, sounds, and other components, are owned by Lyterian Games or its licensors and are protected by intellectual property laws and treaties. This Agreement does not grant you any ownership rights in the Software, and all rights not expressly granted herein are reserved by Lyterian Games.
**4. USER-GENERATED CONTENT**
If the Software allows you to create, upload, or share content ("User-Generated Content"), you hereby grant Lyterian Games a worldwide, non-exclusive, royalty-free, transferable license to use, modify, distribute, and display such User-Generated Content in connection with the Software. You represent and warrant that you have the rights to grant this license and that your User-Generated Content does not infringe the rights of any third party.
**5. UPDATES AND PATCHES**
Lyterian Games may, from time to time, provide updates, patches, or new versions of the Software. These updates may be provided automatically or manually and are subject to the terms of this Agreement. Lyterian Games reserves the right to modify or discontinue the Software or any features at any time without notice.
**6. TERMINATION**
This Agreement is effective until terminated. Lyterian Games may terminate this Agreement at any time if you breach any of the terms herein. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession or control.
**7. DISCLAIMER OF WARRANTIES**
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. LYTERIAN GAMES DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
**8. LIMITATION OF LIABILITY**
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYTERIAN GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER DIRECT OR INDIRECT, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF THE SOFTWARE, EVEN IF LYTERIAN GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
**9. GOVERNING LAW AND DISPUTE RESOLUTION**
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement or the Software shall be resolved exclusively in the federal or state courts located in San Diego, California, and you consent to the jurisdiction of such courts.
**10. SEVERABILITY**
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
**11. ENTIRE AGREEMENT**
This Agreement constitutes the entire agreement between you and Lyterian Games concerning the subject matter herein and supersedes all prior agreements, understandings, or representations.
**12. AMENDMENTS**
Lyterian Games reserves the right to modify this Agreement at any time. Any such modifications will be effective upon posting on the official website or within the Software. Your continued use of the Software following the posting of any changes constitutes your acceptance of those changes.

14.1 Seizure Warning:
Some individuals may experience seizures or other adverse health effects when exposed to certain visual stimuli, including flashing lights or patterns, while playing video games. These seizures may occur even if the individual has no prior history of epilepsy or seizures. If you, or anyone in your household, have an epileptic condition, consult your physician before using this product.
14.2 Health Risks:
The game may contain bright lights, rapidly changing or flashing images, and other visual effects that could trigger seizures, dizziness, eye strain, headaches, or other physical or mental discomfort. If you experience any of these symptoms while playing, stop using the game immediately and consult a doctor if the symptoms persist.
14.3 Precautionary Measures:
To reduce the risk of health problems, it is recommended to take regular breaks, avoid prolonged use, and play in a well-lit room. If you or a family member experience any unusual physical symptoms, stop playing and consult a doctor.
14.4 Limitation of Liability:
By using this product, you agree that the developers, publishers, and any affiliated parties are not responsible for any seizures, health complications, or related issues that may arise from the use of this game. The user assumes all risks associated with playing the game, and any physical or mental health issues that occur as a result of use are at the user's sole responsibility.
