End User License Agreement (EULA)
IMPORTANT NOTICE:
Please read this End User License Agreement (hereinafter referred to as the "Agreement") carefully. This Agreement is a legal agreement between you (the End User) and PygmaGame (hereinafter referred to as the "Developer" or "We/Us") regarding the downloading, installation, and operation of "Shore of Sky", its related software, Downloadable Content (DLC), and services.
By clicking "I Agree," "Purchase," or by actually installing or operating this Game on the Steam platform, you indicate that you have read and fully accept all terms and conditions of this Agreement.
1. License Grant
Subject to your strict compliance with this Agreement, the Developer grants you a personal, limited, non-exclusive, non-transferable, and revocable license to install and operate the Game on your personal computer for non-commercial entertainment purposes only. You are purchasing a license to use the Game, not the ownership of the Game software itself.
2. Intellectual Property Rights
All core code, narrative text (including but not limited to diary entries and dialogue branches), world-building settings (e.g., specific corporations, virus lore, character backgrounds), art assets (UI components, character sprites, CG artwork, chibi animation models), music, sound effects, and trademarks contained in this Game are the sole intellectual property of the Developer or have been lawfully licensed to the Developer.
Prohibition of Extraction: Unless expressly authorized, you are strictly prohibited from unpacking, extracting, or reverse engineering any art, music, or text assets within the Game for use in other projects.
3. User-Generated Content (UGC) & Fan-Derivative Works
We encourage a thriving player community. Regarding fan-derivative works (fan art, fan fiction, non-commercial mods) based on the story and characters of this Game:
Non-Commercial License: We permit and encourage non-commercial derivative works created for the purpose of fan communication, provided that they are clearly labeled as "Based on Shore of Sky".
Commercial Restrictions: Without the written consent of the Developer, it is strictly prohibited to use any derivative works for commercial profit (e.g., selling fan merchandise, packaging them as paid mods, or publishing them on other platforms).
Reservation of Rights: The Developer reserves the right to request the takedown of any fan works that may severely damage the IP image of the Game or constitute infringement at any time.
4. Restrictions on Use
You agree NOT to engage in the following activities:
- Creating, distributing, or using cheats, hacks, or cracked patches that disrupt the fairness of the Game or bypass Steam's verification mechanisms through memory modification, code injection, or any other means.
- Renting, leasing, or reselling the Game's activation keys or the Game itself in any form.
5. Disclaimer of Warranties
This Game is provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties of any kind (including but not limited to warranties of merchantability or error-free operation). To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, or punitive damages (including but not limited to loss of data or loss of business profits) arising from the use or inability to use this Game.
6. Governing Law & Dispute Resolution
The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China. Any dispute arising from or relating to this Agreement or its execution shall be settled through friendly negotiation between both parties. If negotiation fails, either party may file a lawsuit with the people's court with competent jurisdiction in the location of the Developer.
