End User License Agreement (EULA)
This End User License Agreement (hereinafter referred to as "EULA") is a contract between you and an independent creator based in Japan, "KANIRA" (hereinafter referred to as "KANIRA"). This license applies to the software product and all related documents (manuals, packages) regardless of whether they are in printed form, files, downloads, or accessed online. It also applies to updates or upgrades that supplement or enhance the software unless distributed as a separate license (hereinafter collectively referred to as the "Software").
The Software is licensed, not sold. By installing or using the Software, you agree that you have read and accept the terms and conditions defined in this EULA. If you do not agree to the terms of this EULA, you may not install or use the Software.
The Software is protected by international treaties on intellectual property rights and Japanese copyright law.
License
Under this EULA, KANIRA grants you a non-exclusive and limited license to install and use the Software solely for non-commercial personal use on a single computer or other gaming device (according to the type of operating system the Software is designed for). Sharing the Software, installing it on multiple computers or gaming devices simultaneously, or installing it on a network is not permitted.
KANIRA only provides a usage license for the Software and does not transfer or assign any intellectual property rights, authority, or ownership of the Software to you. KANIRA retains all rights to the Software and its components, especially elements that may be considered separate creative works (such as themes, sounds, soundtracks, graphics, artwork, characters, descriptions, and dialogues) as well as any related materials, including but not limited to copyrights, trademarks, and other intellectual property rights. Any rights not explicitly granted to you under this EULA remain with KANIRA.
If you attempt to circumvent any technical protection measures related to the Software, this EULA will be immediately terminated.
Restrictions
The following activities are prohibited:
(a) Using the Software for commercial purposes, i.e., to generate direct or indirect financial profit.
(b) Distributing, sublicensing, lending, leasing, or transferring the Software to a third party except as explicitly stated in this Agreement.
(c) Installing, using, or allowing access to the Software on a network or installing it on multiple computers or gaming devices simultaneously.
(d) Circumventing any technical protection measures designed to prevent illegal use or duplication of the Software.
(e) Reverse engineering, decompiling, disassembling, creating derivative works, or modifying the Software.
(f) Removing or altering any trademarks, logos, or other notices included in the Software.
If you violate the provisions defined under "License" or "Restrictions," KANIRA reserves the right to terminate this EULA 14 days after notification and/or pursue any applicable rights under general legal regulations. If you attempt to circumvent any technical protection measures related to the Software, this EULA will be immediately terminated. Upon termination of this EULA, you must permanently uninstall and delete the Software and all copies thereof.
Limited Warranty
KANIRA guarantees that the Software is compatible with a personal computer or gaming device that meets the minimum system requirements specified in the software documentation. While the Software has been tested, KANIRA does not guarantee that the Software will not interfere with third-party software or drivers installed on your computer. Such interference may prevent the Software from functioning correctly or even launching.
If defects are found in your copy of the Software, KANIRA will allow you to download a replacement copy from the server. No software support is provided under this license. The Software is provided "as is."
Limitation of Liability
Subject to the "Consumer Rights" section, KANIRA shall not be liable for any damages resulting from the use or inability to use the Software, whether direct or indirect, incidental, special, or consequential, including but not limited to lost profits, hardware or software damage, system failures, or work interruptions. This specifically means that KANIRA's liability under this Agreement is, to the maximum extent permitted by law, exempt from any claims arising under tort, contract, or any other legal theory.
Consumer Rights
Depending on your jurisdiction, certain consumer rights may be granted under applicable laws, which cannot be excluded under this EULA. If any inconsistency arises between this EULA and such legal consumer rights, the latter shall take precedence, subject to the following limitations:
You acknowledge and accept that you are responsible for the security of data stored on the computer where the Software is installed.
You agree to create regular backup copies of important data and avoid running multiple programs simultaneously if there is a risk of software interference leading to data loss or work disruption.
KANIRA shall not be liable for any data loss resulting from such situations.
Final Provisions
This EULA is governed by the laws of Japan. This Agreement constitutes the entire understanding between both parties and supersedes any prior agreements, whether written or oral, within the scope of this Agreement.
