END USER LICENSE AGREEMENT
This End User License Agreement (hereinafter referred to as the “EULA”) is a legal agreement between you and the creator Omado, located in Japan. This license applies to the software product and all associated documentation (including manuals and packaging), whether provided in printed form, as files, via download, or accessed online, as well as to any updates or upgrades to the software, unless such updates or upgrades are accompanied by a separate license agreement (collectively referred to as the “Software”).
The Software is licensed, not sold. By installing or using the Software, you acknowledge that you have read this EULA and agree to be bound by the terms and conditions set forth herein. If you do not agree to the terms of this EULA, you may not install or use the Software.
The Software is protected by international copyright treaties and applicable domestic copyright laws.
License
Subject to the terms of this EULA, Omado grants you a non-exclusive, limited license to install and use the Software solely for personal, non-commercial use. **You may install the Software on multiple computers or other gaming devices appropriate to the operating system for which the Software was designed. However, you may not run or use the Software simultaneously on more than one device at the same time.** Sharing the Software or making it available for simultaneous use by third parties over a network is not permitted.
Omado grants only a license to use the Software. No intellectual property rights, ownership rights, or title in or to the Software are transferred or assigned to you. Omado retains all rights, including copyright and other intellectual property rights, in and to the Software and any part thereof, including but not limited to components that may be considered separate works, such as themes, sounds, soundtracks, graphics, artwork, characters, descriptions, and dialogue, as well as related materials. All rights not expressly granted to you under this EULA are reserved by Omado.
If you attempt to circumvent any technical protection measures used in connection with the Software, this EULA shall immediately terminate.
Restrictions
You are not permitted to:
(a) use the Software for commercial purposes, including any use intended to generate direct or indirect economic benefit;
(b) distribute, sublicense, lend, lease, or transfer the Software to any third party, except as expressly permitted by this EULA;
(c) install, use, or allow access to the Software over a network for simultaneous use by multiple users;
(d) circumvent any technical protection measures used to prevent unlawful use or copying of the Software or its functionality;
(e) reverse engineer, decompile, disassemble, create derivative works of, or modify the Software;
(f) remove or alter any trademarks, logos, or other proprietary notices contained in the Software;
(g) use, create, or distribute mods, modifications, add-ons, or other user-generated content for the Software. The Software does not officially support mods, and any modification or extension of the Software without the explicit permission of the developer is prohibited.
Permission for Streaming and Video Content
Personal gameplay streaming, live broadcasting, video creation, and use of platform monetization features based on gameplay footage are permitted. However, redistribution of extracted assets, standalone distribution of Software materials, or distribution that substitutes for the Software itself is prohibited.
If you violate any provision defined under “License” or “Restrictions,” Omado reserves the right to terminate this EULA upon fourteen (14) days’ notice and/or pursue any rights available under applicable law. If you attempt to circumvent any technical protection measures used in connection with the Software, this EULA shall terminate immediately. Upon termination, you must permanently uninstall and delete the Software and all copies thereof.
Limited Warranty
Omado warrants that the Software is compatible with personal computers or other gaming devices that meet the minimum system requirements described in the Software documentation. While the Software has been tested, Omado does not warrant that the Software will not interfere with third-party software or drivers installed on your computer. Such interference may prevent normal operation or even the launching of the Software.
If defects are found in the Software you own, Omado may provide a replacement by allowing you to download the Software from a server. No support services are provided for this license. The Software is provided “as is.”
Limitation of Liability
Subject to the section titled “Consumer Rights,” Omado shall not be liable for any damages arising from the use of or inability to use the Software, whether direct, indirect, special, incidental, or consequential, including but not limited to lost profits, damage to hardware or software, or work stoppage due to system failure or malfunction. This limitation applies regardless of the legal theory under which liability is asserted, to the maximum extent permitted by law.
Consumer Rights
Some jurisdictions may provide certain consumer rights that cannot be excluded by this EULA. In the event of any conflict between this EULA and applicable consumer protection laws, such laws shall prevail to the extent required. You acknowledge and accept responsibility for the security of data stored on your computer, the regular creation of backup copies of important data, and avoiding the simultaneous operation of multiple programs that could lead to data loss or work interruption. Omado shall not be liable for any data loss resulting from such circumstances.
Final Provisions
This EULA shall be governed by and construed in accordance with the laws of Japan. This agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, whether written or oral, relating to the subject matter hereof.
