Evil Dark End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you”) and the developer and publisher of Evil Dark (“Developer,” “we,” “us,” or “our”), an independent, unincorporated studio operating under a studio name ("Jinnworks") and owned and operated by an individual developer. By downloading, installing, accessing, or using Evil Dark (the “Game”), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not install, access, or use the Game.
License Grant
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game for your personal, non-commercial entertainment purposes only, in accordance with Steam’s applicable terms and conditions.
You do not acquire ownership of the Game or any intellectual property rights therein. All rights not expressly granted are reserved by the Developer.
Ownership and Intellectual Property
The Game, including but not limited to all original software, code, artwork, music, sound effects, dialogue, storylines, characters, designs, and other original content, is owned by the Developer and protected by applicable copyright, trademark, and intellectual property laws. Certain third-party assets and materials may be included in the Game under license, and all such assets remain the property of their respective owners.
Nothing in this Agreement grants you any right to use, extract, copy, or redistribute any third-party assets included in the Game outside of the Game itself.
“Evil Dark” and all associated branding remain the exclusive property of the Developer.
Restrictions
You agree that you will not, and will not attempt to:
(a) reverse engineer, decompile, disassemble, or derive source code from the Game;
(b) modify, tamper with, or create derivative works of the Game except as expressly permitted for mods under Section 7;
(c) circumvent, disable, or interfere with security, DRM, or protection mechanisms;
(d) use cheats, exploits, hacks, or unauthorized third-party software;
(e) use the Game for commercial purposes without express written permission; or
(f) distribute, sell, sublicense, rent, lease, or transfer the Game except as allowed by Steam.
Any violation of this section may result in termination of your license.
Streaming, Videos, and Media Use
You are permitted to capture, stream, record, and monetize gameplay footage, screenshots, and videos of the Game, provided that you clearly identify the Game as Evil Dark. Do not claim ownership of the Game or its intellectual property, and do not falsely imply endorsement or affiliation beyond use of the Game itself.
The Developer reserves the right to revoke this permission in cases of misuse, misrepresentation, or legal necessity.
Updates and Changes
The Developer may, at their discretion and without obligation, provide patches, updates, bug fixes, feature changes, balance adjustments, or content modifications.
The Developer does not guarantee that updates will maintain compatibility with prior versions, save files, mods, or hardware configurations. The Game is provided “as is” and “as available”.
Online Features (Present and Future)
At present, the Game may be fully playable offline. The Developer reserves the right to add online features in the future, including but not limited to multiplayer functionality, online services, or data synchronization.
The Developer makes no guarantees regarding uptime, availability, or continued support of any online features.
Mods and User-Generated Content
Mods are permitted and encouraged but are entirely unsupported.
By creating or using mods, you acknowledge that mods are created at your own risk, mods may cause instability, crashes, data loss, or incompatibility, and the Developer is not responsible for mods or their effects.
Mod creators retain ownership of their mods. However, by distributing or using a mod with the Game, you grant the Developer the right to restrict, disable, remove, or prohibit any mod at their sole discretion, for any reason, including legal, technical, or content-related concerns.
Save Data and Progress
Use of the Game is entirely at your own risk.
The Developer is not responsible for lost or corrupted save data, progress loss, mod-related failures, or hardware or software conflicts. You are solely responsible for backing up your data where possible.
Age Requirement
The Game is not intended for children under the age of 16.
By accessing or using the Game, you affirm that you meet the applicable age requirement. If you are under 16, you may only use the Game with parental or legal guardian consent.
Content Warning and Mental Health Disclaimer
The Game contains violence, horror, psychological distress, and sensitive themes including suicide. All content is fictional and intended for entertainment purposes only. The Game does not constitute medical, psychological, or professional advice.
If you experience distress or discomfort, you should stop playing immediately and seek appropriate professional assistance.
Termination
The Developer reserves the right to suspend or terminate your license, without refund, if you violate this Agreement or engage in conduct deemed harmful, unlawful, or disruptive. Upon termination, you must cease all use of the Game.
Refunds
All refunds are governed exclusively by Steam’s refund policies.
The Developer does not provide independent refund guarantees.
Disclaimer of Warranties
To the maximum extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, consequential, emotional, psychological, or special damages, including but not limited to lost data, lost progress, lost profits, or emotional distress. In all cases, the Developer’s total liability shall not exceed the amount you paid for the Game.
Force Majeure
The Developer shall not be liable for failure or delay in performance due to events beyond reasonable control, including acts of God, natural disasters, war, or any other acts that are not within the control of The Developer.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Language
This Agreement is written in English. In the event of any translation, the English version shall control.

Entire Agreement

You agree that any claims arising out of or relating to this Agreement or the Game shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
