This End User License Agreement ("EULA") is a legal agreement between you and Hennessey Gaming LLC for the use of the game "High Up."
1. License Grant
Subject to the terms of this Agreement, Hennessey Gaming LLC grants you a non-exclusive, perpetual license to download, install, and use one copy of "High Up" on any device that supports Steam, solely for your personal or commercial use. This license does not permit you to resell, distribute, or sublicense the game.

The game "High Up" and all intellectual property rights related thereto are owned by Hennessey Gaming LLC. The logos and trademarks of Unreal Engine are used under license and remain the property of their respective owners.
4. Termination
Hennessey Gaming LLC may terminate this Agreement if you fail to comply with any term or condition of this EULA. Upon termination, all rights granted to you under this Agreement will cease, and you must cease all use of the game and delete all copies of the game from your devices.
5. Disclaimers and Limitation of Liability
Disclaimers: The game "High Up" is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and noninfringement. Hennessey Gaming LLC does not warrant that the game will be uninterrupted or error-free, that defects will be corrected, or that the game or the servers that make it available are free of viruses or other harmful components.
Limitation of Liability: In no event shall Hennessey Gaming LLC be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption, however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of the game, even if advised of the possibility of such damage.
6. Governing Law and Dispute Resolution
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or validity thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The place of arbitration shall be in Palm Bay, Florida, United States. The language of the arbitration shall be English.
By installing, downloading, copying, or otherwise using "High Up," you agree to be bound by the terms of this EULA.
