End User License Agreement

Before installing the game 'Caliber', applications, software, or any updates, changes, or DLCs, please read this End User License Agreement carefully.
This End User License Agreement ("EULA") is a public offer (official offer) for individuals/end users and specifies the use of the game "Caliber", applications, software, any updates, changes, or DLCs ("Game") provided or to be provided by Licensor 1C-777 Limited and/or its affiliates (including companies belonging to the same group) ("Administrator").
This End User License Agreement is a binding legal agreement between the Administrator and the customer or user ("you"/"user") of the game, granting the user limited, non exclusive, non transferable, and non sublicensable rights to use the game under the terms of this End User License Agreement.
By receiving, opening file packages, installing and/or using games containing this software, you agree to comply with all intellectual property laws and the terms of this End User License Agreement, and

Users have the right to create an account - a user account created by the user and owned by the administrator. Under the conditions specified in the end-user license agreement, the administrator grants users the right to use the game.
The licensor/administrator does not transfer the name rights of the game to you, and the license granted to you under the end-user license agreement does not constitute a sale.

1. Accept the End User License Agreement
1.1 The act of installing and using the game shall be deemed as a complete and unconditional acceptance of this end-user license agreement, the game's code of conduct, and the privacy policy, and shall be deemed as an individual who has established a contractual relationship with the administrator. 2. Content of the End User License Agreement
2.1 The administrator grants the user a limited, non exclusive, non transferable, and non sublicensable license to install and/or use the game for personal use until the user or administrator terminates this end-user license agreement.
2.2 Users shall not directly or indirectly: (i) copy, sell, rent, lease, license, distribute, or use the game or any part thereof for commercial purposes; And (ii) conducting reverse engineering, decompilation, adaptation, modification, or creating derivative works based on the game; (iii) Delete, alter, disable, or modify copyright and trademark information or other author and source information, notices, or labels contained in the game.
2.3 Unless otherwise specified in the End User License Agreement, all rights not granted to users in this End User License Agreement are expressly reserved by the administrator. The game and all related rights still belong to the administrator. The administrator reserves ownership, exclusive rights, and benefits of the game and all related intellectual property.
2.4 The administrator has the right to unilaterally, without prior notice to the user, restrict, expand, modify or otherwise alter the game, any elements and parts thereof, and key files at any time.
Modifications to the game and its elements can be achieved by creating and applying new software parts (patches). The purpose of these modifications may include improving gameplay, adding new data and instructions to the game (functionality), which may result in users losing the right to use certain game elements and the right to unused data and instructions. The user understands and accepts that these behaviors are an inherent part of game development and ongoing operation, and agrees that the administrator may perform these behaviors without prior warning to the user.
2.5 In order to continue using the game on specific hardware, updates, upgrades, patches, and modifications may be necessary.
This End User License Agreement does not grant any rights or ownership of the game and cannot be construed as a transfer of any intellectual property rights to the game.
2.6 This game is for personal use only and cannot be sold.
2.7 When using the game, the user promises to comply with all applicable laws, rules, and regulations, and not to use the game for any illegal purposes.
2.8 Each licensed game copy can only be used by one user on one device. Using a game means that you have downloaded, installed, or run the game on a computer or similar device. If you install the game on a multiplayer platform, server, or network, individual users of each game must obtain separate licenses.
2.9 The administrator will notify users on the website about the installation of the next version of the game. The user agrees that participating in the game after installing the next version of the game may require accepting a new end-user license agreement and other mandatory documents, which will be published on the website. The user agrees that installing updates, patches, and fixes may result in the inability to use the game and premium account services, and will not receive any compensation during the installation process.

3. Ownership of the game

4. Game usage

By purchasing inactive data and commands, users gain the right to use the game's extended features. The administrator unilaterally determines the type and content of inactive data and commands. As part of the game, the usage period of the premium account is calculated from the moment the corresponding entry is created in the account and is valid until the expiration of the premium account's validity period set by the administrator. Users make payments by transferring funds to the administrator, and the payment method is supported by the administrator. The list of available payment methods is determined unilaterally by the administrator and indicated in the store or other means.
4.3 The administrator has the right to decide on their own the geographical scope of granting game usage rights under this end-user license agreement.
4.4 Users have the right to use the game in accordance with the instructions provided in the Game Code of Conduct.
4.5 The user promises not to use third-party software or other means to modify game files and/or gameplay in order to gain an advantage over other participants.
4.6 The user promises not to sell, distribute, transfer, sublicense or rent the game to any third party, and promises to provide relevant information when creating the account, and not transfer the account or access rights to others.
4.7 Users may irrevocably transfer all their rights under the End User License Agreement to the assignee, provided that the assignee agrees to the terms of the End User License Agreement and the user removes the game from their device. In this case, the user also undertakes to transfer all components and documents related to the game to the assignee.
4.8 The user agrees that the game may contain sound and video effects, which in some cases may exacerbate epilepsy and other neurological disorders in susceptible populations, and confirms that the user does not suffer from these diseases, otherwise they will not use the game.
4.9 The user understands and agrees that prolonged use of personal computers or other technological devices may lead to various health disorders, including visual impairment, scoliosis, various neurosis, etc. The user guarantees to use the game within a reasonable time frame, and to take timely breaks and prevent health disorders.
4.10 The user understands and agrees that the user is fully responsible for any materials or other information provided to other users or made public to the public in the game, website, chat, or other ways.
4.11 The user agrees that this game is not an opportunity game, profit game, competition, or gambling. The right to purchase inactive data and instructions is the voluntary and desired realization of the user.
4.12 According to the set technical requirements, users can only use the game in an interactive (online) mode, so users must have an Internet connection to use the game.
4.13 The user has the right to request a refund of the deposited funds within 14 (fourteen) days after purchasing non activated data and instructions, provided that these purchased non activated data and instructions have not been used by the user and are fully saved as purchased. Once the refund is approved, the purchased amount will be fully refunded to the user within 10 (ten) days and refunded through the payment method used by the user at the time of purchase.
5. Termination of License
5.1 This End User License Agreement shall come into effect from the moment the user first installs or uses the game.
5.2 If the user violates the terms of this End User License Agreement, the administrator may automatically terminate this Agreement without prior notice to the user. In this case, the user must immediately uninstall the game and delete the game and any part thereof from the user's device.
5.3 Users may terminate the End User License Agreement at any time by completely deleting the game.
6. Guarantee
Administrators will provide technical support for the game.
7. Guarantee Restrictions
7.1 The game is provided in an "as is" and "as available" manner. The administrator explicitly denies any kind of warranty, whether express or implied, regarding the game, except for the warranty specified in Article 6 of the End User License Agreement.
7.2 The user explicitly acknowledges that they shall bear the risks of using the game on their own.
7.3 The user shall be responsible for any costs incurred in repairing and/or correcting the game.
7.4 The administrator does not guarantee that the game will be uninterrupted or error free, that defects will be fixed, or that the game will not contain viruses or other harmful components.
7.5 Within the scope permitted by law, the administrator expressly denies any warranties regarding the market value of the game, user satisfaction, or the ability of users to use it in a specific way.
7.6 Users are responsible for all risks related to profit loss, data loss, errors, and loss of business or other information resulting from ownership or use of the game.
7.7 Due to certain jurisdictions not allowing the limitations of the above guarantees, they may not apply to users in that jurisdiction.
8. Limitation of Liability
8.1 Under no circumstances (including but not limited to negligence) shall the administrator, its employees, agents, or distributors be liable for any direct, indirect, incidental, special, incidental, or other damages, whether due to the use or inability to use the game, or due to the possession or malfunction of the game, even if the administrator has been informed of the possibility of such damages.
Specifically, the administrator shall not be held responsible for playing the game in violation of the usage precautions specified in the game user manual.
Due to certain jurisdictions not allowing exemption from liability for direct or incidental damages, the above exemption clauses may not apply to users in that jurisdiction.
8.2 The full responsibility of the administrator, in any case, is limited to the user refunding the purchase price of the game in exchange for the game, all copies, registration documents and manuals, and all materials constituting the return of the license from the user to the administrator.
8.3 According to the laws and regulations of the user's country, this End User License Agreement grants the user specific rights to use the game, and the user may enjoy other rights, depending on the laws and regulations of their country.
9. Other terms
9.1 This End User License Agreement and any disputes, claims, or obligations arising from or related to it (whether contractual or non contractual) shall be governed by the laws of the Republic of Cyprus, unless otherwise provided by the laws of the user's country of residence.
9.2 The user hereby confirms that they have read and understood this End User License Agreement and agree to be bound by the terms of this End User License Agreement by installing and using the game. The user also acknowledges and agrees that this End User License Agreement is a complete and exclusive agreement statement between the administrator and the user.
9.3 The administrator has the right to unilaterally modify this End User License Agreement. The modification will take effect from the time it is published on the website. If the user does not agree to the modification of the end-user license agreement, the user has no right to use the game. In this case, the user may unilaterally terminate the End User License Agreement within ten (10) calendar days after the modification of the End User License Agreement is published on the game website and/or notified via email. If the user decides to terminate the end-user license agreement, the user is obligated to send a notice of termination of the end-user license agreement to the administrator via email. If the user does not express their intention to terminate the End User License Agreement within the aforementioned ten (10) calendar days, it shall be deemed that the user has accepted the terms of this End User License Agreement, including any modifications made therein.10. Termination
Any failure to comply with the terms and conditions of this End User License Agreement shall result in the automatic and immediate termination of this End User License Agreement. Upon termination of this End User License Agreement for any reason, you agree to immediately cease use of the game and destroy all copies of the game provided under this End User License Agreement. Your financial obligations shall remain in effect after the expiration or termination of this End User License Agreement.
11. Validity Period of End User License Agreement
This End User License Agreement shall come into effect upon the user's acceptance of its terms and shall be valid for twelve (12) months. The validity period of this End User License Agreement will be automatically extended for each subsequent six (6) months, unless terminated by either party by giving written notice to the other party at least thirty (30) calendar days prior to the expiration of the current End User License Agreement. After terminating the end-user license agreement according to the specified termination method, the administrator will not refund any amount or provide any form of compensation, including any losses.
12. Privacy Policy
This privacy policy applies to all information directly or indirectly related to specific or identifiable individuals (personal data subjects), including personal data as defined by applicable laws (hereinafter referred to as "personal information"), that 1C-777 Limited and/or its affiliates, including companies within the same group (hereinafter referred to as "administrators"), may collect information about you during the use of the game.

3. Ownership of the game
The user acknowledges that the game and its components (especially the name, source code, theme, characters, character names, storyline, dialogue, location, concepts, images, photos, animations, videos, music, and text in the game), as well as trademark rights and copyrights related to the game, are the property of the administrator and are protected by the laws and regulations of the Republic of Cyprus, as well as international laws, treaties, international law, and intellectual property agreements.

As part of the game, the usage period of the premium account is calculated from the moment the corresponding entry is created in the account and is valid until the expiration of the premium account's validity period set by the administrator. Users make payments by transferring funds to the administrator, and the payment method is supported by the administrator. The list of available payment methods is determined unilaterally by the administrator and indicated in the store or other means.
4.3 The administrator has the right to decide on their own the geographical scope of granting game usage rights under this end-user license agreement.
4.4 Users have the right to use the game in accordance with the instructions provided in the Game Code of Conduct.
4.5 The user promises not to use third-party software or other means to modify game files and/or gameplay in order to gain an advantage over other participants.
4.6 The user promises not to sell, distribute, transfer, sublicense or rent the game to any third party, and promises to provide relevant information when creating the account, and not transfer the account or access rights to others.
4.7 Users may irrevocably transfer all their rights under the End User License Agreement to the assignee, provided that the assignee agrees to the terms of the End User License Agreement and the user removes the game from their device. 4.11 The user agrees that this game is not an opportunity game, profit game, competition, or gambling. The right to purchase inactive data and instructions is the voluntary and desired realization of the user.

4.13 The user has the right to request a refund of the deposited funds within 14 (fourteen) days after purchasing non activated data and instructions, provided that these purchased non activated data and instructions have not been used by the user and are fully saved as purchased. 5. Termination of License
5.1 This End User License Agreement shall come into effect from the moment the user first installs or uses the game.
5.2 If the user violates the terms of this End User License Agreement, the administrator may automatically terminate this Agreement without prior notice to the user. In this case, the user must immediately uninstall the game and delete the game and any part thereof from the user's device.
5.3 Users may terminate the End User License Agreement at any time by completely deleting the game.
6. Guarantee

7. Guarantee Restrictions
7.1 The game is provided in an "as is" and "as available" manner. The administrator explicitly denies any kind of warranty, whether express or implied, regarding the game, except for the warranty specified in Article 6 of the End User License Agreement.
7.2 The user explicitly acknowledges that they shall bear the risks of using the game on their own.
7.3 The user shall be responsible for any costs incurred in repairing and/or correcting the game.
7.4 The administrator does not guarantee that the game will be uninterrupted or error free, that defects will be fixed, or that the game will not contain viruses or other harmful components.
7.5 Within the scope permitted by law, the administrator expressly denies any warranties regarding the market value of the game, user satisfaction, or the ability of users to use it in a specific way.
7.6 Users are responsible for all risks related to profit loss, data loss, errors, and loss of business or other information resulting from ownership or use of the game.

8. Limitation of Liability

9. Other terms
9.1 This End User License Agreement and any disputes, claims, or obligations arising from or related to it (whether contractual or non contractual) shall be governed by the laws of the Republic of Cyprus, unless otherwise provided by the laws of the user's country of residence.
9.2 The user hereby confirms that they have read and understood this End User License Agreement and agree to be bound by the terms of this End User License Agreement by installing and using the game. 9.3 The administrator has the right to unilaterally modify this End User License Agreement. The modification will take effect from the time it is published on the website. 11. Validity Period of End User License Agreement

The validity period of this End User License Agreement will be automatically extended for each subsequent six (6) months, unless terminated by either party by giving written notice to the other party at least thirty (30) calendar days prior to the expiration of the current End User License Agreement.
