This End User License Agreement ("EULA") is a legal contract between you ("User") and Patrick Aroha Velasco Borges ("Licensor") for the use of the game software "The Candy Adventure" ("Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
License Grant
Licensor grants User a limited, non-exclusive, non-transferable license to install and use the Game solely for personal, non-commercial use, in accordance with the terms of this EULA.
Ownership Rights
All rights, title, and interest in and to the Game, including, but not limited to, any copyrights, trademarks, trade secrets, patents, and other intellectual property rights, are and will remain the exclusive property of Patrick Aroha Velasco Borges and/or his licensors. User does not acquire any ownership rights to the Game except as expressly set forth in this EULA.
Restrictions
User may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game;
Remove, alter, or obscure any copyright notices or other proprietary notices included in the Game;
Distribute, sell, rent, lease, sublicense, or otherwise transfer the Game to third parties;
Use the Game for any commercial purpose without the Licensor's express written consent.
Limitation of Liability
The Game is provided "as is," without warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall Patrick Aroha Velasco Borges or Aroha Studio be liable for any indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Game, even if they have been advised of the possibility of such damages.
Indemnification
User agrees to indemnify, defend, and hold harmless Patrick Aroha Velasco Borges and Aroha Studio from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way related to User's use of the Game, User's breach of this EULA, or User's violation of any rights of another person or entity.
Termination
This EULA is effective until terminated. User may terminate this EULA at any time by uninstalling and destroying all copies of the Game in User's possession. Licensor may terminate this EULA immediately, without prior notice, if User breaches any term of this EULA. Upon termination, User must uninstall and destroy all copies of the Game.
Governing Law
This EULA shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law principles.
General Provisions
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This EULA constitutes the entire agreement between the parties regarding the use of the Game and supersedes all prior or contemporaneous agreements, whether written or oral, relating to such subject matter.
Updates and Patches
Licensor may, from time to time, provide updates, patches, and other modifications to the Game that must be installed for User to continue using the Game. User agrees that Licensor may install such updates automatically without any additional notice or consent from User.
User Generated Content (UGC)
If the Game allows User to create, upload, or share content, User grants Licensor a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, modify, publicly display, and publicly perform such content. User warrants that User has all necessary rights to grant this license.
Privacy Policy
Use of the Game is subject to Licensor's Privacy Policy, which is incorporated into this EULA by reference. The Privacy Policy explains how User information is collected, used, and disclosed.
Communications and Notices
All notices and other communications provided by Licensor to User under this EULA will be delivered electronically. Licensor may provide notices to User via email, in-game messages, or postings on the Game's official website.
Online Use and Network Connections
Licensor does not guarantee that the Game or any portion thereof will be available at all times or at any specific time. Licensor shall not be liable for any interruption of online services, loss of data, or any other damages resulting from network connection issues.
BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, USER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO ALL THE TERMS AND CONDITIONS OF THIS EULA.
