This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Novus Studio (the "Developer"), the developer of "Wicked Arcana" (the "Software"). By installing, copying, downloading, accessing, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
License Grant
The Developer hereby grants you a non-exclusive, non-transferable, limited license to use the Software solely for personal, non-commercial purposes on devices you own or control.
Restrictions
You may not distribute, sell, lease, rent, lend, or sublicense the Software to anyone.
You may not modify, decompile, disassemble, reverse engineer, or create derivative works based on the Software without the prior written consent of the Developer.
You may not remove any proprietary notices or labels on the Software.
Intellectual Property Rights
The Software, including but not limited to its code, documentation, appearance, structure, and organization, is the property of the Developer and is protected by copyright, trademark, and other intellectual property laws.
This Agreement does not transfer to you any rights of ownership in the Software.
Termination
This Agreement is effective until terminated. You may terminate it at any time by destroying all copies of the Software in your possession.
It will also terminate immediately if you fail to comply with any term or condition of this Agreement.
Upon termination, you must destroy all copies of the Software.
Disclaimer of Warranty
The Software is provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
In no event shall the Developer be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use or other dealings in the Software.
User Content
If the Software allows you to create, post, or share content, you grant the Developer a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such content.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of law.
Severability
If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from the Agreement and the other provisions shall remain in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between you and the Developer concerning the Software and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Software.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
