End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Charred Games ("Company," "we," or "us") for the use of the game "Cluminati" ("Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
1. License Grant
Charred Games grants you a limited, non-exclusive, non-transferable, revocable license to install, access, and use the Game for your personal, non-commercial use on a device owned or controlled by you, subject to the terms and conditions set forth in this Agreement.
2. Restrictions
You agree not to, and will not permit others to:
a. Copy, modify, or create derivative works based on the Game.
b. Distribute, transfer, sublicense, lease, lend, or rent the Game to any third party.
c. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game, except and only to the extent that such activity is expressly permitted by applicable law.
d. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on or in the Game.
e. Use the Game for any commercial purpose without the prior written consent of Charred Games.
3. Ownership
The Game is licensed, not sold. Charred Games retains all right, title, and interest in and to the Game, including all copyrights, trademarks, and other intellectual property rights. All rights not expressly granted to you in this Agreement are reserved by Charred Games.
4. Updates and Patches
Charred Games may, from time to time, provide updates, patches, or other modifications to the Game ("Updates"). These Updates may be automatically installed without providing any additional notice or receiving any additional consent. You consent to this automatic updating and agree that this Agreement will apply to all such Updates.
5. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Charred Games if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Game and destroy all copies of the Game in your possession or control.
6. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Game is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Charred Games does not warrant that the Game will be uninterrupted or error-free, that defects will be corrected, or that the Game is free of viruses or other harmful components.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Charred Games be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, or any other pecuniary loss) arising out of the use of or inability to use the Game, even if Charred Games has been advised of the possibility of such damages.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Charred Games is located, without regard to its conflict of law principles.
9. Miscellaneous
a. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
b. This Agreement constitutes the entire agreement between you and Charred Games regarding the use of the Game and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
c. No failure or delay by Charred Games in exercising any right under this Agreement will operate as a waiver of such right, nor will any single or partial exercise of any right preclude any further exercise of that right.
