END USER LICENSE AGREEMENT

1. ACCEPTANCE OF TERMS
1.1. PLEASE READ THIS END USER LICENSE AGREEMENT (EULA) BEFORE PURCHASING, DOWNLOADING, INSTALLING, USING, OR PLAYING WINDROSE GAME (THE “GAME”). BY PURCHASING, DOWNLOADING, INSTALLING, USING, OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, PLEASE DO NOT (AND YOU ARE NOT PERMITTED TO) DOWNLOAD, INSTALL, USE OR PLAY THE GAME.
1.2. THE GAME MAY CONTAIN ERRORS, DEFECTS, OR INCOMPLETE FEATURES THAT MAY NOT BE REMEDIED. YOU USE THE GAME AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF, OR INABILITY TO USE THE GAME, EVEN IF THE PUBLISHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
1.3. Age Requirement
You must have the legal capacity to enter into a binding agreement in your country of residence in order to accept this EULA.
Due to differing age ratings assigned to the Game across platforms and regions, the minimum age required to play the Game independently corresponds to the age rating assigned to the Game on the relevant platform store and/or under applicable regional classification laws. Such ratings may vary (for example, 14+, 15+, 16+, Mature, or equivalent).
If you are under the age of majority in your jurisdiction, you may use the Game only with the involvement and consent of a parent or legal guardian, who must review and accept this EULA on your behalf and supervise your use of the Game.
Where local laws permit minors aged 13 or older (or the applicable age of digital consent) to use online services with parental authorization, such use is permitted solely with parental or guardian consent.
The Game is not directed to children under the age of 13 (or the minimum age required by applicable law), and we do not knowingly collect personal information from such children. If we become aware that personal data of a child under this age has been collected, it will be deleted in accordance with our Privacy Policy.
1.4. The Privacy Policy https://playwindrose.com/privacy-policy/ is an integral part of this EULA.

2. LICENSE GRANTED TO YOU
2.1. This EULA constitutes a binding legal agreement between you and GLHF MERIDIAN ONE INTERACTIVE LTD, a legal entity incorporated in Cyprus (the “Publisher”).
2.2. Publisher, its affiliates, and its licensors own and retain all rights, title, and interest in and to the Game and all intellectual property rights related thereto, including but not limited to: the software and source code; audio-visual elements, artwork, animations, music, and sound effects; characters, storylines, dialogue, and in-game content; trademarks, service marks, logos, trade names, game titles, and trade dress of Publisher and its licensors; patents, inventions, and patent applications; and all other copyrightable or otherwise protectable materials (collectively, the “Content”).
2.3. For the purposes of this Agreement, the Game and the Content may be referred to collectively as the “Game” where the context so requires.
2.4. Subject to your continuing compliance with this EULA, Publisher grants you a limited, non- exclusive, cancellable, non-assignable, non-sublicensable, and non-transferable license to use the Game for your personal, non-commercial use. Publisher may immediately suspend or terminate the availability the Game for any reason, in Publisher’s sole discretion, without advance notice or liability.
2.5. You, as licensee (Licensee) through your downloading, installing, copying or use of this product do not acquire any ownership rights to the Game.
2.6. To the extent that downloaded software or client software are licensed as part of the Game, we grant to you, for your non-commercial and personal use only, a limited, non-exclusive, revocable, non- transferable and non-sublicensable permission to install and use the downloaded software or client software, in object code form only, on one or more personal computing devices under your control solely to access and use the Game for your own personal, non-commercial entertainment use. Any such software is licensed and not sold.
2.7. Such permission remains in effect until and unless terminated by you or Publisher. You promise and agree that you are using the Game for your own personal, non-commercial use and that you will not engage in any conduct prohibited in this EULA.

3. LICENSEE’S RULES OF CONDUCT
3.1. You agree to use the Game only as intended, in accordance with this EULA, all applicable laws, and the legitimate interests of Publisher and other players.
Without limiting the foregoing, you agree that you will not, directly or indirectly:
a. Unauthorized Software & Interference
Use, create, distribute, or provide any unauthorized third-party software or services that intercept, emulate, modify, redirect, or otherwise interfere with communications between the Game and its services, including cheats, hacks, bots, trainers, automation tools, or similar programs.
b. Hosting, Emulation & Ancillary Services
Host, provide, or develop matchmaking services, server emulators, mirroring services, tunneling services, or any other unauthorized infrastructure or ancillary offerings related to the Game.
c. Exploits & Unfair Advantage
Exploit bugs, design flaws, or undocumented features of the Game to gain an unfair advantage or to disrupt gameplay.
d. Unauthorized Copying & Distribution
Copy, reproduce, distribute, publicly display, frame, mirror, or otherwise use the Game or any Content except as expressly authorized in this EULA.
e. Virtual Goods & Secondary Markets
Sell, trade, rent, lease, sublicense, or otherwise transfer the Game, accounts, virtual goods, or in-game currency (of applicable), including participation in so-called “secondary markets,” unless expressly authorized.
f. Reverse Engineering
Reverse engineer, derive source code from, modify, adapt, translate, decompile, disassemble, or create derivative works based on the Game or any Content, except where such restrictions are prohibited by applicable law.
g. Circumvention of Protections
Remove, disable, circumvent, or modify any technological protection measures implemented to safeguard the Game or its intellectual property.
h. Security Violations
Probe, scan, test vulnerabilities, breach security or authentication measures, or access non-public areas of the Game or related systems.
i. Disruption of Services
Interfere with or disrupt the Game or its networks, including through viruses, denial-of-service attacks, flooding, spamming, or other harmful activities.
j. Data Collection
Collect, scrape, harvest, or store personal information or data of other users without their express consent.
k. Geographic & Access Circumvention
Use IP proxying, VPN routing, or other methods to disguise your location to circumvent regional restrictions or platform rules.
l. Account Misuse & Impersonation
Impersonate any person or entity, misrepresent your affiliation, or engage in fraud, social engineering, or scams.
m. Harmful or Prohibited Conduct Engage in conduct that:
violates any applicable law or regulation; is fraudulent, misleading, or deceptive;
is defamatory, obscene, pornographic, or offensive; promotes discrimination, harassment, hate, or violence; promotes illegal or harmful activities or substances.
n. Community & Gameplay Integrity
Engage in behavior that disrupts cooperative gameplay or negatively impacts other players’ experience, including harassment, abusive language, griefing, intentional sabotage, game abandonment, or spamming.
Enforcement
3.2. Publisher reserves the right, acting reasonably and proportionately, to investigate violations of these Rules of Conduct and to take appropriate enforcement measures, including warnings, suspension, restriction of features, removal of virtual goods, or termination of access to the Game, in accordance with this EULA and applicable law.

4. FEEDBACK
4.1. We welcome your feedback, comments, and suggestions for improvements to the Game (“Feedback”).
4.2. If you provide us with any Feedback, you hereby grant us the following license: a non-exclusive, transferable, worldwide, perpetual, irrevocable, fully-paid, royalty-free license, with the right to sublicense, under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon, distribute copies of, publicly perform, publicly display and otherwise exploit the Feedback for any purpose and in any country. This license does not lapse or expire even if we do not exercise our rights under this license within a period of one year.
4.3. If you have rights in the Feedback that cannot be licensed to us under applicable law (such as moral and other personal rights), you hereby waive and agree not to assert those rights. You understand and agree that you are freely giving your Feedback, that we don’t have to use it, and that you will not be compensated in any way for your Feedback.
4.4. You represent and warrant that you have rights in any Feedback that you provide to us sufficient to grant us and other affected parties the rights described above, including, without limitation, intellectual property rights or rights of publicity or privacy.
4.5. In posting such Feedback, you warrant that your feedback is in compliance with this EULA, and you will not use obscene or offensive language or submit any material that is, or may potentially be, defamatory, abusive or hateful, an invasion of anyone's privacy, harmful to other users, or in breach of any applicable law.

5. DATA PROTECTION
5.1. The Publisher ensures protection of personal data.
5.2. The Publisher is the controller of personal data and has the right to engage third parties (joint controllers / processors / co-processors) and entrust processing of personal data to legal entities in jurisdictions other than the Publisher’s place of registration for the purpose of compliance with legal requirements.
5.3. Most of the data collected is limited to non-personalized information; however, certain data may uniquely identify the User’s device when accessing the Game’s website or playing the Game. For example, the Publisher may collect log information related to the User’s gameplay, including Platform ID, in- game user ID (generated by the Publisher), server ID, invite codes (generated by the Publisher), device ID, device type, utilized features, access and session times, and IP address. Additionally, the Publisher may collect gameplay log files and information submitted through bug reports. In the event of a game crash, the Publisher may also collect relevant diagnostic data such as crash dumps, device specifications, and game logs.

6. COOPERATIVE PLAY AND DIRECT CONNECTION
6.1. To play in cooperative mode with other players, your device must establish a direct connection with another player’s device or a game server. Our proprietary microservice (the “Service”) facilitates this process by acting as an intermediary.
6.2. How it works:
Session Creation.
A player who creates a game session (the “Host”) via the Service automatically generates an invitation code and shares the technical data necessary to establish the connection.
Discovery and Connection.
Another player (the “Guest”) enters the invitation code within the Game. The Service assists the players’ devices in discovering each other and attempting to establish a direct peer-to-peer connection.
Fallback Routing.
If a direct connection cannot be established, the Service may automatically and temporarily relay gameplay traffic between the Host and the Guest in order to enable cooperative play.

7. PHOTOSENSITIVE SEIZURE WARNING
7.1. A very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights, including some of the visual effects that appear in certain video games. Symptoms may even be experienced by individuals with no history of epilepsy or photosensitivity. If you or anyone in your family have an epileptic or photosensitivity condition, please consult your physician before playing the Game.
7.2. If you experience any of the following symptoms while playing any of the Game, immediately discontinue use and consult your physician before resuming play: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.

8. LIMITATION OF LIABILITY
8.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW THE PUBLISHER PARTIES WILL NOT BE LIABLE IN ANY WAY FOR ANY:
(a) LOSS OF PROFITS,
(b) LOST REVENUE,
(c) LOST SAVINGS,
(d) LOSS OF DATA, OR
(e) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE GAME, OR THE DELAY OR INABILITY TO USE OR LACK OF FUNCTIONALITY OF THE GAME, EVEN IN THE EVENT OF ONE OF A COMPANY PARTY’S FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, INDEMNITY, PRODUCT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY, OR OTHERWISE AND EVEN IF THAT PUBLISHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF THE COMPANY PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE GAME WILL NOT EXCEED: (A) THE TOTAL AMOUNTS YOU HAVE PAID (IF ANY) OR ARE PAYABLE BY YOU TO US FOR THE GAME DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENTS GIVING RISE TO SUCH LIABILITY; OR (B) IF (A) DOES NOT APPLY, FIFTY DOLLARS ($50 USD). THESE LIMITATIONS AND EXCLUSIONS REGARDING DAMAGES APPLY EVEN IF ANY REMEDY FAILS TO PROVIDE ADEQUATE COMPENSATION AND ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.
8.2. Notwithstanding the foregoing, some countries, states, provinces, or other jurisdictions do not allow the exclusion of certain warranties or the limitation of liability as stated above, so the above terms may not apply to you. Instead, in such jurisdictions, the foregoing exclusions and limitations will apply to the maximum extent permitted by the laws of such jurisdictions. Also, you may have additional legal rights in your jurisdiction, and nothing in this EULA will prejudice such rights that you may have as a consumer of the Game.

9. INDEMNITY
9.1. You agree to indemnify (in other words, compensate for all and any losses incurred), pay the defense costs of, and hold the Publisher Parties and their employees, officers, directors, agents, contractors, and other representatives harmless from all claims, demands, actions, losses, liabilities, costs and expenses (including, without limitation, attorneys’ fees, costs, and expert witnesses’ fees) that arise out of or in any way are connected with: (a) your access to or use of the Game; or (b) any claim that, if true, would constitute a breach by you of this EULA. You agree to reimburse us for any payments made or loss suffered by us, whether in a court judgment or settlement, based on any matter covered by this section.

10. DISPUTE RESOLUTION AND ARBITRATION
10.1. In the event of any dispute, controversy, or claim arising out of or relating to this End User License Agreement, including its interpretation, performance, or termination (a “Dispute”), the aggrieved party shall provide the other party with written notice of the Dispute. Such notice shall include the name, address, and contact information of the notifying party, a brief description of the Dispute, and a proposed resolution.
10.2. Notices of Disputes must be sent to Publisher: legal@meridianone.gg.
10.3. For a period of sixty (60) days from the date of receipt of the notice, the parties shall use good- faith efforts to resolve the Dispute through informal negotiations. If the parties are unable to resolve the Dispute within this sixty (60) day period, the Dispute shall be finally resolved by binding arbitration, subject to applicable consumer protection laws.
10.4. Disputes shall be resolved by arbitration seated in Nicosia, Republic of Cyprus, administered by the Cyprus Arbitration and Mediation Centre (CAMC), regardless of whether the Publisher is located in Cyprus or another jurisdiction at the time the Dispute arises.
10.5. The arbitration shall be conducted in the English language and governed by the laws of the Republic of Cyprus.
10.6. Nothing in this clause shall limit or deprive Users of any mandatory consumer protection rights granted under the laws of their country of residence.

11. GAME AND EULA MODIFICATIONS
11.1. When we update this EULA, you need to agree to the updated version to keep using the Game. We also need the freedom to update any part of the Game whenever we see fit, so we are letting you know we can do so at any time.
11.2. We may (but don’t have to) update this EULA at any time whenever we think there is a need. Subject to applicable law, if we do so, you will be prompted to agree to the updated EULA upon your next access to the Game or when the updated EULA is otherwise communicated to you. You must agree to these updates to continue using the Game.
11.3. We may provide patches, updates, or upgrades to the Game that must be installed for you to continue to use the Game. We may update the Game remotely without notifying you, and you hereby consent to us applying such patches, updates, and upgrades. If your device can prevent automatic updates, you may not be able to access the Game until you manually update the Game yourself on your device. We may modify, suspend, discontinue, substitute, replace, or limit your access to any aspect of the Game at any time. Subject to applicable law, you acknowledge that any character data, game progress, game customization or other data related to your use of Game and other elements unique to the Game may cease to be available to you at any time without notice from us, including, without limitation, after a patch, update, or upgrade is applied by us. You agree that we do not have any maintenance or support obligations with respect to the Game.

12. THIRD-PARTY SERVICES AND TECHNOLOGY
12.1. Platform-Specific Terms
Your use of the Game through the Steam platform is subject to Valve Corporation’s Steam Subscriber Agreement (available at https://store.steampowered.com/subscriber_agreement/), which is a separate and binding agreement between you and Valve. You must have a valid Steam account to access the Game via Steam.
Similarly, your use of the Game through the Epic Games Store platform is subject to Epic Games, Inc.’s End User License Agreement for the Epic Games Store (available at https://store.epicgames.com/eula), which is a separate and binding agreement between you and Epic. You must have a valid Epic Games account to access the Game via the Epic Games Store.

The Game uses the Unreal® Engine technology from Epic Games, Inc. ("Epic").
