End User License Agreement
This End User License Agreement (hereinafter referred to as "EULA") is a contract between you and Imochan Games, located in Japan. This license applies to the software product and all related documentation (manuals, packaging), regardless of whether they are accessed in print, file, download, or online, and applies to updates or upgrades that supplement the software unless distributed as a separate license (hereinafter collectively referred to as "Software").
This Software is not sold, but licensed. By installing or using this Software, you agree that you have read this EULA and agree to be bound by the terms and conditions defined herein. If you do not agree to the terms of this EULA, you may not install or use this Software.
This Software is protected by international treaties and domestic copyright laws related to intellectual property rights.
License
Subject to this EULA, Imochan Games grants you a non-exclusive and limited license to install and use the Software for non-commercial personal use on a single computer or other gaming device (depending on the type of operating system for which the Software is designed). Sharing, simultaneous installation on multiple computers or gaming devices, and network installation of the Software are not permitted.
Imochan Games only grants a license to use the Software and does not transfer or assign any intellectual property rights, authority, or ownership of the Software to you. Imochan Games retains all rights (including but not limited to copyrights, other intellectual property rights, and trademarks) in the Software and its components, especially those parts of the Software that may be considered separate works (e.g., themes, sounds, soundtracks, graphics, artwork, characters, descriptions, dialogues) and related materials. Any rights not expressly granted to you in this EULA are retained by Imochan Games.
This EULA will immediately become void if you attempt to circumvent any technical protection measures related to the Software.
Restrictions
The following rights are not granted: (a) using the Software for commercial purposes, i.e., to generate direct or indirect economic benefits, (b) distributing, sublicensing, lending, leasing, or transferring the Software to third parties, except as expressly provided in this agreement, (c) installing, using, or accessing the Software on a network, or installing the Software simultaneously on multiple computers or gaming devices, (d) circumventing technical protection measures used to prevent illegal use or copying of the Software, (e) reverse engineering, decompiling, disassembling, creating derivative works from, or modifying the Software, (f) removing or altering trademarks, logos, or other notices contained in the Software.
If you violate the provisions defined under "License" or "Restrictions," Imochan Games has the right to terminate this EULA after 14 days' notice and/or pursue all rights permitted by general law. If you attempt to circumvent technical protection measures related to the Software, this EULA will be terminated immediately. Upon termination of this EULA, you must permanently uninstall and delete the Software and any copies thereof.
Limited Warranty
Imochan Games guarantees that the Software is compatible with personal computers or other gaming devices that meet the minimum system requirements specified in the Software's usage instructions. While the Software has been tested, Imochan Games does not guarantee that the Software will not interfere with third-party software or drivers installed on your computer. Such interference may impede the proper operation or even the startup of the Software. If a defect is found in the Software you own, Imochan Games will enable you to download a replacement from the server. No support is provided for the Software under this license. The Software is provided "as is."
Limitation of Liability
In accordance with the "Consumer Rights" section, Imochan Games shall not be liable for any damages arising from the use or inability to use the Software, whether direct or indirect, and regardless of its nature, specialness, incidental or consequential nature. This includes, but is not limited to, lost profits, hardware or software damage, work stoppage due to malfunction or malfunction. This means that Imochan Games’ liability under this agreement is exempt to the maximum extent permitted by law, regardless of tort or other legal theories.
Consumer Rights
Depending on the laws of your region, certain consumer rights may be recognized that cannot be excluded by this EULA. If a discrepancy arises between this EULA and legally defined consumer rights, such rights shall take precedence, subject to the following limitations: You acknowledge and accept responsibility for the security of data stored on the computer used. Regularly create backup copies of your important data and avoid running multiple programs simultaneously that may lead to data loss or work disruption due to potential program interference. Imochan Games shall not be liable for any data loss arising from this.
Final Provisions
This EULA shall be governed by the laws of Japan.
This agreement contains all the mutual agreement terms between the parties and supersedes all prior agreements, whether written or oral, within the scope of this agreement.
