To play the Game, you must (a) obtain access to the Game from YUFOOT; and (b) download the Game Client (as defined below). The YUFOOT Terms of Service are hereby incorporated by reference into and form part of this End User Licence Agreement as if such terms were fully restated in this End User Licence Agreement. This End User Licence Agreement is referred to as the "EULA" and constitutes a "Supplement" to the YUFOOT Terms of Service. The Games are provided and distributed for use by authorised end users only in accordance with the terms of this Agreement, including the YUFOOT Terms of Service. Any use, reproduction, modification or distribution of the Games not expressly authorised by the terms of this Agreement is expressly prohibited. You agree that for purposes of this Agreement (including the YUFOOT Terms of Service), the Game, the Game Client, other Game-related software, and certain content in the Game (as defined in the Terms of Service) relating to your access to, and use of, the Game, are the "Service". YUFOOT reserves any rights not granted to you under this Agreement.
You have previously agreed that YUFOOT may process your personal information in accordance with the YUFOOT Privacy Policy https://documents.bethesda.net/zh-CN/privacy-policy and you have agreed to abide by the YUFOOT Code of Conduct https://documents.bethesda.net/zh-CN/. The Code of Conduct is hereby incorporated into and forms part of this End User Licence Agreement as if fully restated in this End User Licence Agreement. All personal information collected and processed by YUFOOT in connection with this End User Licence Agreement will be collected and processed in accordance with the YUFOOT Privacy Policy.
You should print a copy of this End User Licence Agreement, the Terms of Service, the Privacy Policy and the Code of Conduct for your records and future reference.
all software programmes and any and all documentation delivered or made available to you, including any "patches", "installers", any updates and modifications made to such software programmes, and any and all copies and derivative works of such software programmes, together with the Game Client (as defined below) are collectively referred to as the "Game") are copyrighted works of YUFOOT and its affiliates. The Game is licensed, not sold, to you.
1. Limited Licence; Restrictions and Ownership
If you agree to this Agreement, you may download and install computer software ("Game Client") onto your computer for the sole purpose of playing the Game by registering for and accessing an account on the Service ("Account"). Additional terms applicable to your Account are contained in the YUFOOT TOS. Subject to all of the terms and conditions of this Agreement, YUFOOT hereby grants to you, and you hereby accept, a limited and non-transferable, non-exclusive licence to (a) install the Game Client on one or more computers owned or legally controlled by you, and (b) use the Game Client as part of the Service solely for non-commercial entertainment purposes.
The YUFOOT TOS includes terms and conditions applicable to virtual currencies (these terms are detailed in the YUFOOT TOS), including terms for a non-exclusive limited licence to you for virtual currencies. These terms and conditions apply to virtual currencies (if any) that are licensed to you for use with the Game. Creation Credits" in connection with the Game are "Virtual Currency" and are subject to these Terms and Conditions.
Subject to the Statutory Obligations (as defined in Section 1 of the TOS), this Agreement does not grant you any right to obtain a re-release or replacement version of the Game at any time, and YUFOOT is not obligated to provide software updates, upgrades, or expansions to the Game, nor is it obligated to operate or continue to support the Game indefinitely.
As further described in YUFOOT's Terms of Service, but subject to compliance with the Statutory Obligations (as defined in Section 1 of YUFOOT's Terms of Service), YUFOOT may change, modify, suspend or discontinue any aspect of the Game at any time, and YUFOOT may impose limits on certain features or restrict your access to part or all of the Game, without notice or liability to you.
In any event, the licence granted to you under this Agreement will terminate whenever this Agreement or your YUFOOT account terminates, whichever is earlier.
The YUFOOT Terms of Service include terms and conditions that apply to User-Generated Content, Downloadable Content, and other content, and you agree to abide by those terms and conditions.
2. Software Updates and Anti-Cheat and Security Tools. YUFOOT may deploy or make available patches, updates, improvements, upgrades and modifications ("Updates") for the Game, which you must install yourself in the manner described by YUFOOT in order to continue playing the Game. All such Updates are part of the Game for the purposes of this Agreement, the licence granted to you, and the licence limitations described herein. Any Updates provided by YUFOOT that replace and/or supplement the original Game will be governed by the terms of this Agreement, unless such Updates are accompanied by a separate licence agreement, in which case the terms of such licence agreement shall apply. YUFOOT has implemented tools and software designed to detect and prevent cheating and fraud ("Anti-Cheat Tools"); these technologies scan any computer or device on which you download or play the Game in order to detect or identify anyone who is trying to "cheat," gain an unfair advantage in the Game, or otherwise circumvent the Game. These technologies may scan any computer or device from which you download or play the Game to detect or identify any program or process designed to "cheat," gain an unfair advantage in the Game, or otherwise circumvent any security, anti-cheating, or fraud detection process or tool we have implemented ("Cheat Programs"). By using or downloading the Game or accepting this Agreement, you understand and expressly agree that these Anti-Cheat Tools may access your computer or device to identify or detect Cheat Programmes.
3. Limitations and Restrictions.
Certain features of the Games are services provided by YUFOOT and may at times be available only online. If this is the case, an Internet connection (not provided by YUFOOT) is required to use these features. All costs and expenses associated with the purchase of any hardware, software (e.g., Internet browsers) or other products or services required to play the Game are your sole responsibility.
In addition to the restrictions, conditions and limitations set forth in YUFOOT's Terms of Service and YUFOOT's Code of Conduct, the licence granted to you under this End User Licence Agreement is subject to the conditions, restrictions and limitations set forth in Sections 1 and 3 of this End User Licence Agreement (collectively the "Licence Restrictions"). Any use of the Game in violation of the Licence Limitations will be considered an infringement of YUFOOT's copyrights in the Game and a breach of this Agreement. You agree that under no circumstances will you yourself, and you will not assist any other person, to:
A. distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan, or otherwise transfer the Game or the Content, in whole or in part, including, without limitation, any access keys;
B. Modify, adapt, translate, reverse engineer, attempt to derive the source code of, alter, disassemble, decompile; or create derivative works based on the Game, in whole or in part, except that you may make one (1) backup copy of the Game Client and accompanying manuals for archival purposes only, and you may install the relevant Game Client, as set out in clause 1 above, on one or more You may also install the relevant game client on one or more computers owned or legally controlled by you as described in clause 1 above;
C. remove any proprietary notices or markings from the game; or attempt to circumvent in any way any security measures designed to control access to the game or any part of it;
D. use cheating tools, automated software (autoprograms), hacking, mods or any other unauthorised third party software in an attempt to modify the game or adversely affect any other person playing the game or their gaming experience;
E. use the Game or any part thereof (including, without limitation, the Game Client) for any commercial purpose (including, without limitation, renting, leasing, or licensing the Game to others), including, without limitation, (a) collecting Virtual Currency (as defined in YUFOOT's Terms of Service), items, or resources in order to sell them outside of the Game, or (b) performing in-game services in exchange for payment outside of the Game (e.g., ghostwriting);
F. use any unauthorised third party software (including, without limitation, any software that reads the RAM area of the Game that is used to store information about a character or the Game environment) to intercept, mine, or otherwise collect information with or through the Game or the Services; provided, however, that YUFOOT may, in its sole and absolute discretion, permit the use of certain third party user interfaces and other third party software;
G. modify, or cause to be modified, any files that are part of the Game Client in any manner not expressly authorised by YUFOOT;
H. hosting, providing or developing pairing services for the Game, or intercepting, mimicking or redirecting in any way the communication protocols used by YUFOOT for any purpose, including, without limitation, the unauthorised use of the Internet, the Online Game or as part of a content aggregation network;
I. Facilitate, create or maintain any unauthorised connection to the Games or Services, including, without limitation, (a) any connection to any unauthorised server that mimics, or attempts to mimic, the Services; and (b) any connection using programs or tools not expressly approved by YUFOOT;
J. take any action or upload, post, transmit, promote or distribute any unlawful content;
K. take any action or upload, post, transmit, promote or distribute any Content that infringes or violates the rights of any third party;
L. engaging in or participating in any type of sexual solicitation of children, acts of sexual grooming, paedophilia or any form of predatory behaviour, or taking any action in relation thereto;
M. harassing, stalking, threatening, embarrassing, spamming or doing anything that makes other game users uncomfortable, such as repeatedly sending unwanted messages or making personal attacks, or making statements about race, sexual orientation, religion and heritage;
N. take any action or upload, post, transmit, distribute or communicate your or anyone else's personal information in the real world;
O. impersonate any person or entity (including, without limitation, YUFOOT, a partner of YUFOOT, or an employee of a branch office), or make false statements about your relationship with a person or entity or otherwise misrepresent such relationship;
P. take any action, organise, disseminate any content, or engage in or participate in any activity, group or association that is harmful, inappropriate, abusive, hateful (including "hate speech"), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, nude, defamatory, libellous, invasive, invasion of privacy or attribution, or encouragement of conduct that violates the law or that a reasonable person would find objectionable and/or inappropriate in YUFOOT's sole discretion;
Q. promoting, uploading, transmitting, encouraging or engaging in any activity that involves hacking, cracking, phishing, exploiting vulnerabilities or fraud and/or distributing counterfeit software and/or virtual currency or virtual goods. In order to continually improve the Game, you and other users/players are required to report to YUFOOT any vulnerabilities, fraud, hacking or other inconsistencies that you discover; or
R. take any action or upload, post, transmit, promote or distribute any content that may contain Trojan horses, viruses, worms, spyware, time bombs, delete flies, corrupted data, or other computer programs that are not owned by you or that you do not have the right to distribute freely, as these may damage, interfere with, interrupt, encroach upon or disrupt the Game.
Any attempt to do any of the above is a breach of this Agreement and may also infringe the intellectual property rights contained in the Game. If you violate these restrictions, you may be sued and face damages.
The Game is licensed to you as a single product. Its components may not be used separately on multiple computers. The game is licensed, not sold. Your licence does not grant you title or ownership of the Game or copies thereof.
4. Ownership of the Game.
YUFOOT and its licensors are and will continue to be the owners of all right, title and interest in and to the Game and the Services, including, without limitation, all intellectual property rights and moral rights in and to the Game and all copies thereof (including, without limitation, any titles, software programs and code, Game-related themes, characters, character names, character likenesses, stories, dialogue, catchphrases, locations, concepts, artwork, character lists, in-game structures, landscaping and other designs, animations, sounds, musical compositions and recordings, audiovisual effects, storylines, methods of operation and any related documentation). You may not take any action that violates any of these property rights or proprietary rights. The Games are protected by United States copyright laws, international treaties and conventions, and other laws. The Game may contain material licensed by third parties, and the licensors of such material may enforce their rights after any violation of this Agreement. You understand and agree that you do not have any interest, monetary or otherwise, in any of the features or content included in the Game. This paragraph will survive the termination of this Agreement.
5. Collection and Processing of Personal Information
YUFOOT will process your personal information as YUFOOT deems necessary. We will also use cookies, web beacons and other analytics technologies (collectively referred to herein as "cookies") and similar mechanisms (including those provided by third parties) to collect, store and transmit information about your use of the Services in order to operate, improve and optimise the Services and our other products, analyse usage, personalise your experience of using the Services, and process other information in accordance with the YUFOOT Privacy Policy. You expressly acknowledge that you have read and understood it:
YUFOOT reserves the right to disclose any information that YUFOOT deems necessary to (i) ensure your compliance with this Agreement; (ii) satisfy any applicable law, regulation, or legal process; and (iii) protect the rights, property, and interests of YUFOOT, its employees, other users of the Games, or the public.
6. Monitoring and Updates.
If you request any technical support from YUFOOT, YUFOOT may, with your consent, remotely access and inspect the computer on which you have loaded the Game Client in order to provide technical support and debugging. As further described in YUFOOT's Terms of Service, YUFOOT may remotely update the Game (including, without limitation, the Game Client residing on your computer), and you hereby consent to YUFOOT's deployment and application of such updates.
You understand and agree that (a) any and all game-related character data is stored and resides on YUFOOT's computers and servers; and (b) any and all communications you make within the Game (including, without limitation, messages directed solely to other players or to another group of players) will be transmitted through YUFOOT's computers and servers and may or may not be monitored by YUFOOT or YUFOOT's agents. You expressly consent to such monitoring of your sending and receiving of such communications. The YUFOOT Terms of Service and YUFOOT's Privacy Policy include additional terms and conditions that apply to accessing, monitoring, and recording activities and communications related to the Services, including but not limited to the circumstances under which YUFOOT may report incidents to law enforcement and other authorities. All personal information collected and processed by YUFOOT to fulfil the activities listed in this Section 6 will be collected and processed in accordance with the terms of this Agreement.
7. Termination.
This End User Licence Agreement is effective upon your acceptance of this End User Licence Agreement and will remain in effect until terminated. You may terminate this End User Licence Agreement at any time by: (i) permanently destroying all copies of the Game in your possession or control; and (ii) deleting the Game Client from your hard drive. YUFOOT may terminate this End User Licence Agreement at any time for any reason or for no reason at all (including at such time as YUFOOT elects to cease providing the Games), subject to compliance with its statutory obligations (as defined in Section 1 of YUFOOT's Terms of Service). If YUFOOT terminates this Agreement for any reason, all licences granted herein (including the YUFOOT Terms of Service) in relation to the Games included in this End User Licence Agreement shall immediately terminate and you must immediately perform (i) and (ii) above. YUFOOT will send you a notice of termination without cause.
8. Warranty.
If you are the original purchaser of the Game through a physical medium (e.g., a compact disc), you are covered for the duration of your use of the Game by the limited warranty contained in the manual or other packaging materials provided with your purchase.
The YUFOOT Terms of Service contain disclaimer provisions regarding representations, warranties, and guarantees (subject to the Statutory Obligations (as defined in Section 1 of the YUFOOT Terms of Service)) and are hereby incorporated into this End User Licence Agreement by reference and made a part of this End User Licence Agreement as if such provisions had been restated in full in this End User Licence Agreement. This Section 9 will survive termination of this Agreement.
with respect to software permitted to be used on or through the internet, you acknowledge that yufoot is not responsible for the internet, nor for whether the internet should continue in its current form, nor for whether governments or governmental agencies, foreign or domestic, control, regulate or prohibit the internet. the risks associated with the use of the internet are yours alone.
9. limitation of liability, indemnity.
to the maximum extent permitted by applicable law and in compliance with statutory obligations (as defined in section 1 of the terms of service), neither yufoot nor any licensor will be liable for (i) special, incidental, consequential, punitive, exemplary or other indirect damages, (ii) third party claims, or (iii) loss of, or damage to, any system, hardware or software, records, or data, even if it has been advised or informed of the occurrence of any such damages. been advised or informed of the possibility of any such loss or damage and that the limited remedies of this Agreement fail of their essential purpose.
some jurisdictions do not allow the imposition of limitations of liability or the exclusion of liability. accordingly, the above sections may not apply to you.
the yufoot terms of service contain additional provisions on limitation of liability and remedies (subject to Statutory Obligations (as defined in section 1 of the yufoot terms of service)), which are hereby incorporated by reference into this end user licence agreement and made a part of this end user licence agreement as if such provisions were fully and completely restated in this end user licence agreement.
You agree to reimburse YUFOOT and its subsidiaries and other participants in the Service for all such liabilities, damages, losses, costs and expenses (including, but not limited to, attorneys' fees and court costs) if (i) you misuse the Game Service or breach this Agreement, or (ii) any of your contributions to, or acts or omissions in relation to, the use of the Game Service result in YUFOOT being liable for any such liabilities, damages, losses, costs and expenses. . If a third party sues YUFOOT in connection with either or both of subparagraphs (i) or (ii) above, YUFOOT reserves the right to control the defence and settlement of such third-party litigation, and you agree to reimburse YUFOOT for the costs of such defence, including, but not limited to, reasonable attorneys' fees, as documented.
This Section 10 will survive the termination of this Agreement.
10. Changes to the Agreement. As the game and the law continue to evolve, YUFOOT may replace this End User Licence Agreement with new versions (each, a "New EULA"). This End User Licence Agreement will terminate immediately upon adoption of the New EULA, and you will have the opportunity to review the New EULA in accordance with the changes set forth in YUFOOT's Terms of Service, which will not retroactively apply to prior versions. Your continued use of the Software and the Games after the EULA changes will be deemed to be your acceptance of all terms and conditions as modified.
11. U.S. Government Restricted Rights. The Games are a commercial project developed entirely at private expense, which includes "Commercial Computer Software" and "Commercial Computer Software Documentation," as those terms are defined in the applicable procurement regulations, including but not limited to the Federal Acquisition Regulation ("FAR") at 48 C.F.R. 2.101. R.2.101 ("FAR"). As described in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) (for Private Agencies), 48 C.F.R. 227.7202-3, and 48 C.F.R. 227.7202-4, the Game has been licensed to U.S. Government end users pursuant to the terms of this Agreement in accordance with 48 C.F.R. 227.7202 (for DoD entities). the end user of the Game. Solely with respect to the U.S. Government's rights in the Game, this U.S. Government Licence Rights clause supersedes or replaces any other clause or provision of any other FAR, DFARS, or contract under which the Game was acquired. The manufacturer of the Game is YUFOOT.
12.Governing Law.
For residents of North America, this Agreement and all Disputes (as defined in detail in the Dispute Provisions) shall be governed by the laws of the State of Maryland, U.S.A., excluding conflict of laws rules and principles that would cause the laws of any other state or country to apply to this Agreement or any Dispute.
If you reside outside of North America, this Agreement and all Disputes shall be governed by the laws of the United Kingdom, excluding conflict of laws rules and principles that would cause the laws of another country to apply to this Agreement or any Dispute. However, mandatory local laws may apply.
Notwithstanding the Disputes provision, you agree that YUFOOT shall be entitled to injunctive relief, specific performance, and equitable relief for a breach of this Section 1 or Section 3 of this Agreement, and shall also be entitled to such other remedies as YUFOOT may have under applicable law.
This Section 12 shall survive the termination of this Agreement.
13. Miscellaneous. This End User Licence Agreement, together with the YUFOOT Terms of Service and the YUFOOT Code of Conduct, constitutes and contains the entire agreement between you and YUFOOT with respect to the subject matter hereof, and supersedes any prior agreements, whether oral or written. This End User Licence Agreement shall coexist with and not supersede the YUFOOT Terms of Service. In the event of a conflict between the provisions of this End User Licence Agreement and the provisions of the YUFOOT Terms of Service, the conflicting provisions of this End User Licence Agreement shall prevail and be binding unless otherwise expressly stated herein. Except as specifically provided in the Dispute Provisions, if any portion of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intent of that portion, and the remainder of this Agreement shall remain in full force and effect. YUFOOT's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. No waiver of any provision of this Agreement shall be effective unless approved in writing and signed by YUFOOT. You agree that this Agreement and YUFOOT's performance of this Agreement are not intended to, and do not, confer any rights or remedies on anyone other than you and YUFOOT. This Section 13 shall survive the termination of this Agreement for any reason.

all software programmes and any and all documentation delivered or made available to you, including any "patches", "installers", any updates and modifications made to such software programmes, and any and all copies and derivative works of such software programmes, together with the Game Client (as defined below) are collectively referred to as the "Game") are copyrighted works of YUFOOT and its affiliates. The Game is licensed, not sold, to you.
1. Limited Licence; Restrictions and Ownership
If you agree to this Agreement, you may download and install computer software ("Game Client") onto your computer for the sole purpose of playing the Game by registering for and accessing an account on the Service ("Account"). Additional terms applicable to your Account are contained in the YUFOOT TOS. Subject to all of the terms and conditions of this Agreement, YUFOOT hereby grants to you, and you hereby accept, a limited and non-transferable, non-exclusive licence to (a) install the Game Client on one or more computers owned or legally controlled by you, and (b) use the Game Client as part of the Service solely for non-commercial entertainment purposes.
The YUFOOT TOS includes terms and conditions applicable to virtual currencies (these terms are detailed in the YUFOOT TOS), including terms for a non-exclusive limited licence to you for virtual currencies. These terms and conditions apply to virtual currencies (if any) that are licensed to you for use with the Game. Creation Credits" in connection with the Game are "Virtual Currency" and are subject to these Terms and Conditions.
Subject to the Statutory Obligations (as defined in Section 1 of the TOS), this Agreement does not grant you any right to obtain a re-release or replacement version of the Game at any time, and YUFOOT is not obligated to provide software updates, upgrades, or expansions to the Game, nor is it obligated to operate or continue to support the Game indefinitely.
As further described in YUFOOT's Terms of Service, but subject to compliance with the Statutory Obligations (as defined in Section 1 of YUFOOT's Terms of Service), YUFOOT may change, modify, suspend or discontinue any aspect of the Game at any time, and YUFOOT may impose limits on certain features or restrict your access to part or all of the Game, without notice or liability to you.
In any event, the licence granted to you under this Agreement will terminate whenever this Agreement or your YUFOOT account terminates, whichever is earlier.
The YUFOOT Terms of Service include terms and conditions that apply to User-Generated Content, Downloadable Content, and other content, and you agree to abide by those terms and conditions.
2. Software Updates and Anti-Cheat and Security Tools. YUFOOT may deploy or make available patches, updates, improvements, upgrades and modifications ("Updates") for the Game, which you must install yourself in the manner described by YUFOOT in order to continue playing the Game. All such Updates are part of the Game for the purposes of this Agreement, the licence granted to you, and the licence limitations described herein. Any Updates provided by YUFOOT that replace and/or supplement the original Game will be governed by the terms of this Agreement, unless such Updates are accompanied by a separate licence agreement, in which case the terms of such licence agreement shall apply. YUFOOT has implemented tools and software designed to detect and prevent cheating and fraud ("Anti-Cheat Tools"); these technologies scan any computer or device on which you download or play the Game in order to detect or identify anyone who is trying to "cheat," gain an unfair advantage in the Game, or otherwise circumvent the Game. These technologies may scan any computer or device from which you download or play the Game to detect or identify any program or process designed to "cheat," gain an unfair advantage in the Game, or otherwise circumvent any security, anti-cheating, or fraud detection process or tool we have implemented ("Cheat Programs"). By using or downloading the Game or accepting this Agreement, you understand and expressly agree that these Anti-Cheat Tools may access your computer or device to identify or detect Cheat Programmes.
3. Limitations and Restrictions.
Certain features of the Games are services provided by YUFOOT and may at times be available only online. If this is the case, an Internet connection (not provided by YUFOOT) is required to use these features. All costs and expenses associated with the purchase of any hardware, software (e.g., Internet browsers) or other products or services required to play the Game are your sole responsibility.
In addition to the restrictions, conditions and limitations set forth in YUFOOT's Terms of Service and YUFOOT's Code of Conduct, the licence granted to you under this End User Licence Agreement is subject to the conditions, restrictions and limitations set forth in Sections 1 and 3 of this End User Licence Agreement (collectively the "Licence Restrictions"). Any use of the Game in violation of the Licence Limitations will be considered an infringement of YUFOOT's copyrights in the Game and a breach of this Agreement. You agree that under no circumstances will you yourself, and you will not assist any other person, to:
A. distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan, or otherwise transfer the Game or the Content, in whole or in part, including, without limitation, any access keys;
B. Modify, adapt, translate, reverse engineer, attempt to derive the source code of, alter, disassemble, decompile; or create derivative works based on the Game, in whole or in part, except that you may make one (1) backup copy of the Game Client and accompanying manuals for archival purposes only, and you may install the relevant Game Client, as set out in clause 1 above, on one or more You may also install the relevant game client on one or more computers owned or legally controlled by you as described in clause 1 above;
C. remove any proprietary notices or markings from the game; or attempt to circumvent in any way any security measures designed to control access to the game or any part of it;
D. use cheating tools, automated software (autoprograms), hacking, mods or any other unauthorised third party software in an attempt to modify the game or adversely affect any other person playing the game or their gaming experience;
E. use the Game or any part thereof (including, without limitation, the Game Client) for any commercial purpose (including, without limitation, renting, leasing, or licensing the Game to others), including, without limitation, (a) collecting Virtual Currency (as defined in YUFOOT's Terms of Service), items, or resources in order to sell them outside of the Game, or (b) performing in-game services in exchange for payment outside of the Game (e.g., ghostwriting);
F. use any unauthorised third party software (including, without limitation, any software that reads the RAM area of the Game that is used to store information about a character or the Game environment) to intercept, mine, or otherwise collect information with or through the Game or the Services; provided, however, that YUFOOT may, in its sole and absolute discretion, permit the use of certain third party user interfaces and other third party software;
G. modify, or cause to be modified, any files that are part of the Game Client in any manner not expressly authorised by YUFOOT;
H. hosting, providing or developing pairing services for the Game, or intercepting, mimicking or redirecting in any way the communication protocols used by YUFOOT for any purpose, including, without limitation, the unauthorised use of the Internet, the Online Game or as part of a content aggregation network;
I. Facilitate, create or maintain any unauthorised connection to the Games or Services, including, without limitation, (a) any connection to any unauthorised server that mimics, or attempts to mimic, the Services; and (b) any connection using programs or tools not expressly approved by YUFOOT;
J. take any action or upload, post, transmit, promote or distribute any unlawful content;
K. take any action or upload, post, transmit, promote or distribute any Content that infringes or violates the rights of any third party;
L. engaging in or participating in any type of sexual solicitation of children, acts of sexual grooming, paedophilia or any form of predatory behaviour, or taking any action in relation thereto;
M. harassing, stalking, threatening, embarrassing, spamming or doing anything that makes other game users uncomfortable, such as repeatedly sending unwanted messages or making personal attacks, or making statements about race, sexual orientation, religion and heritage;
N. take any action or upload, post, transmit, distribute or communicate your or anyone else's personal information in the real world;
O. impersonate any person or entity (including, without limitation, YUFOOT, a partner of YUFOOT, or an employee of a branch office), or make false statements about your relationship with a person or entity or otherwise misrepresent such relationship;
P. take any action, organise, disseminate any content, or engage in or participate in any activity, group or association that is harmful, inappropriate, abusive, hateful (including "hate speech"), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, nude, defamatory, libellous, invasive, invasion of privacy or attribution, or encouragement of conduct that violates the law or that a reasonable person would find objectionable and/or inappropriate in YUFOOT's sole discretion;
Q. promoting, uploading, transmitting, encouraging or engaging in any activity that involves hacking, cracking, phishing, exploiting vulnerabilities or fraud and/or distributing counterfeit software and/or virtual currency or virtual goods. In order to continually improve the Game, you and other users/players are required to report to YUFOOT any vulnerabilities, fraud, hacking or other inconsistencies that you discover; or
R. take any action or upload, post, transmit, promote or distribute any content that may contain Trojan horses, viruses, worms, spyware, time bombs, delete flies, corrupted data, or other computer programs that are not owned by you or that you do not have the right to distribute freely, as these may damage, interfere with, interrupt, encroach upon or disrupt the Game.
Any attempt to do any of the above is a breach of this Agreement and may also infringe the intellectual property rights contained in the Game. If you violate these restrictions, you may be sued and face damages.
The Game is licensed to you as a single product. Its components may not be used separately on multiple computers. The game is licensed, not sold. Your licence does not grant you title or ownership of the Game or copies thereof.
4. Ownership of the Game.
YUFOOT and its licensors are and will continue to be the owners of all right, title and interest in and to the Game and the Services, including, without limitation, all intellectual property rights and moral rights in and to the Game and all copies thereof (including, without limitation, any titles, software programs and code, Game-related themes, characters, character names, character likenesses, stories, dialogue, catchphrases, locations, concepts, artwork, character lists, in-game structures, landscaping and other designs, animations, sounds, musical compositions and recordings, audiovisual effects, storylines, methods of operation and any related documentation). You may not take any action that violates any of these property rights or proprietary rights. The Games are protected by United States copyright laws, international treaties and conventions, and other laws. The Game may contain material licensed by third parties, and the licensors of such material may enforce their rights after any violation of this Agreement. You understand and agree that you do not have any interest, monetary or otherwise, in any of the features or content included in the Game. This paragraph will survive the termination of this Agreement.
5. Collection and Processing of Personal Information
YUFOOT will process your personal information as YUFOOT deems necessary. We will also use cookies, web beacons and other analytics technologies (collectively referred to herein as "cookies") and similar mechanisms (including those provided by third parties) to collect, store and transmit information about your use of the Services in order to operate, improve and optimise the Services and our other products, analyse usage, personalise your experience of using the Services, and process other information in accordance with the YUFOOT Privacy Policy. You expressly acknowledge that you have read and understood it:
YUFOOT reserves the right to disclose any information that YUFOOT deems necessary to (i) ensure your compliance with this Agreement; (ii) satisfy any applicable law, regulation, or legal process; and (iii) protect the rights, property, and interests of YUFOOT, its employees, other users of the Games, or the public.
6. Monitoring and Updates.
If you request any technical support from YUFOOT, YUFOOT may, with your consent, remotely access and inspect the computer on which you have loaded the Game Client in order to provide technical support and debugging. As further described in YUFOOT's Terms of Service, YUFOOT may remotely update the Game (including, without limitation, the Game Client residing on your computer), and you hereby consent to YUFOOT's deployment and application of such updates.
You understand and agree that (a) any and all game-related character data is stored and resides on YUFOOT's computers and servers; and (b) any and all communications you make within the Game (including, without limitation, messages directed solely to other players or to another group of players) will be transmitted through YUFOOT's computers and servers and may or may not be monitored by YUFOOT or YUFOOT's agents. You expressly consent to such monitoring of your sending and receiving of such communications. The YUFOOT Terms of Service and YUFOOT's Privacy Policy include additional terms and conditions that apply to accessing, monitoring, and recording activities and communications related to the Services, including but not limited to the circumstances under which YUFOOT may report incidents to law enforcement and other authorities. All personal information collected and processed by YUFOOT to fulfil the activities listed in this Section 6 will be collected and processed in accordance with the terms of this Agreement.
7. Termination.
This End User Licence Agreement is effective upon your acceptance of this End User Licence Agreement and will remain in effect until terminated. You may terminate this End User Licence Agreement at any time by: (i) permanently destroying all copies of the Game in your possession or control; and (ii) deleting the Game Client from your hard drive. YUFOOT may terminate this End User Licence Agreement at any time for any reason or for no reason at all (including at such time as YUFOOT elects to cease providing the Games), subject to compliance with its statutory obligations (as defined in Section 1 of YUFOOT's Terms of Service). If YUFOOT terminates this Agreement for any reason, all licences granted herein (including the YUFOOT Terms of Service) in relation to the Games included in this End User Licence Agreement shall immediately terminate and you must immediately perform (i) and (ii) above. YUFOOT will send you a notice of termination without cause.
8. Warranty.
If you are the original purchaser of the Game through a physical medium (e.g., a compact disc), you are covered for the duration of your use of the Game by the limited warranty contained in the manual or other packaging materials provided with your purchase.
The YUFOOT Terms of Service contain disclaimer provisions regarding representations, warranties, and guarantees (subject to the Statutory Obligations (as defined in Section 1 of the YUFOOT Terms of Service)) and are hereby incorporated into this End User Licence Agreement by reference and made a part of this End User Licence Agreement as if such provisions had been restated in full in this End User Licence Agreement. This Section 9 will survive termination of this Agreement.
with respect to software permitted to be used on or through the internet, you acknowledge that yufoot is not responsible for the internet, nor for whether the internet should continue in its current form, nor for whether governments or governmental agencies, foreign or domestic, control, regulate or prohibit the internet. the risks associated with the use of the internet are yours alone.
9. limitation of liability, indemnity.
to the maximum extent permitted by applicable law and in compliance with statutory obligations (as defined in section 1 of the terms of service), neither yufoot nor any licensor will be liable for (i) special, incidental, consequential, punitive, exemplary or other indirect damages, (ii) third party claims, or (iii) loss of, or damage to, any system, hardware or software, records, or data, even if it has been advised or informed of the occurrence of any such damages. been advised or informed of the possibility of any such loss or damage and that the limited remedies of this Agreement fail of their essential purpose.
some jurisdictions do not allow the imposition of limitations of liability or the exclusion of liability. accordingly, the above sections may not apply to you.
the yufoot terms of service contain additional provisions on limitation of liability and remedies (subject to Statutory Obligations (as defined in section 1 of the yufoot terms of service)), which are hereby incorporated by reference into this end user licence agreement and made a part of this end user licence agreement as if such provisions were fully and completely restated in this end user licence agreement.
You agree to reimburse YUFOOT and its subsidiaries and other participants in the Service for all such liabilities, damages, losses, costs and expenses (including, but not limited to, attorneys' fees and court costs) if (i) you misuse the Game Service or breach this Agreement, or (ii) any of your contributions to, or acts or omissions in relation to, the use of the Game Service result in YUFOOT being liable for any such liabilities, damages, losses, costs and expenses. . If a third party sues YUFOOT in connection with either or both of subparagraphs (i) or (ii) above, YUFOOT reserves the right to control the defence and settlement of such third-party litigation, and you agree to reimburse YUFOOT for the costs of such defence, including, but not limited to, reasonable attorneys' fees, as documented.
This Section 10 will survive the termination of this Agreement.
10. Changes to the Agreement. As the game and the law continue to evolve, YUFOOT may replace this End User Licence Agreement with new versions (each, a "New EULA"). This End User Licence Agreement will terminate immediately upon adoption of the New EULA, and you will have the opportunity to review the New EULA in accordance with the changes set forth in YUFOOT's Terms of Service, which will not retroactively apply to prior versions. Your continued use of the Software and the Games after the EULA changes will be deemed to be your acceptance of all terms and conditions as modified.
11. U.S. Government Restricted Rights. The Games are a commercial project developed entirely at private expense, which includes "Commercial Computer Software" and "Commercial Computer Software Documentation," as those terms are defined in the applicable procurement regulations, including but not limited to the Federal Acquisition Regulation ("FAR") at 48 C.F.R. 2.101. R.2.101 ("FAR"). As described in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) (for Private Agencies), 48 C.F.R. 227.7202-3, and 48 C.F.R. 227.7202-4, the Game has been licensed to U.S. Government end users pursuant to the terms of this Agreement in accordance with 48 C.F.R. 227.7202 (for DoD entities). the end user of the Game. Solely with respect to the U.S. Government's rights in the Game, this U.S. Government Licence Rights clause supersedes or replaces any other clause or provision of any other FAR, DFARS, or contract under which the Game was acquired. The manufacturer of the Game is YUFOOT.
12.Governing Law.
For residents of North America, this Agreement and all Disputes (as defined in detail in the Dispute Provisions) shall be governed by the laws of the State of Maryland, U.S.A., excluding conflict of laws rules and principles that would cause the laws of any other state or country to apply to this Agreement or any Dispute.
If you reside outside of North America, this Agreement and all Disputes shall be governed by the laws of the United Kingdom, excluding conflict of laws rules and principles that would cause the laws of another country to apply to this Agreement or any Dispute. However, mandatory local laws may apply.
Notwithstanding the Disputes provision, you agree that YUFOOT shall be entitled to injunctive relief, specific performance, and equitable relief for a breach of this Section 1 or Section 3 of this Agreement, and shall also be entitled to such other remedies as YUFOOT may have under applicable law.
This Section 12 shall survive the termination of this Agreement.
13. Miscellaneous. This End User Licence Agreement, together with the YUFOOT Terms of Service and the YUFOOT Code of Conduct, constitutes and contains the entire agreement between you and YUFOOT with respect to the subject matter hereof, and supersedes any prior agreements, whether oral or written. This End User Licence Agreement shall coexist with and not supersede the YUFOOT Terms of Service. In the event of a conflict between the provisions of this End User Licence Agreement and the provisions of the YUFOOT Terms of Service, the conflicting provisions of this End User Licence Agreement shall prevail and be binding unless otherwise expressly stated herein. Except as specifically provided in the Dispute Provisions, if any portion of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intent of that portion, and the remainder of this Agreement shall remain in full force and effect. YUFOOT's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. No waiver of any provision of this Agreement shall be effective unless approved in writing and signed by YUFOOT. You agree that this Agreement and YUFOOT's performance of this Agreement are not intended to, and do not, confer any rights or remedies on anyone other than you and YUFOOT. This Section 13 shall survive the termination of this Agreement for any reason.

By clicking "Agree" at ****, **I understand and agree to be bound by all of the terms and conditions of this Agreement, including my express consent to YUFOOT's use of the Anti-Cheat Tool described herein.
