1. Agreement
This End User License Agreement ("EULA") is a legal agreement between you and Yiğit Sağlam for the use of the game software Omnicopia, which includes computer software and may include associated media, printed materials, and online or electronic documentation ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA.
2. License Grant
Yiğit Sağlam grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.
3. Restrictions
You agree not to, and you will not permit others to:
License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Software or make the Software available to any third party.
Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Software.
Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Yiğit Sağlam or its affiliates, partners, suppliers, or the licensors of the Software.
4. Intellectual Property
The Software, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights are, and shall remain, the sole and exclusive property of Yiğit Sağlam.
5. Updates and MaintenanceYiğit Sağlam may from time to time provide enhancements or improvements to the features/functionality of the Software, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may modify or delete certain features and/or functionalities of the Software. You agree that Yiğit Sağlam has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Software to you.
6. Term and Termination
This EULA shall remain in effect until terminated by you or Yiğit Sağlam. Yiğit Sağlam may, in its sole discretion, at any time and for any or no reason, suspend or terminate this EULA with or without prior notice.
7. Disclaimer of Warranties
The Software is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Yiğit Sağlam, on his own behalf and on behalf of his affiliates and his respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Software.
8. Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of Yiğit Sağlam and any of his suppliers under any provision of this EULA and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Software.
9. Governing Law
This EULA is governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. You hereby consent to the exclusive jurisdiction and venue of courts in Turkey in all disputes arising out of or relating to the use of the Software.
10. Amendments to this EULA
Yiğit Sağlam reserves the right, at his sole discretion, to modify or replace this EULA at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
