End User License Agreement (EULA)
Ligma Studios LLC - Be Damned!

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE INSTALLING, ACCESSING, OR USING THE VIDEO GAME "BE DAMNED!" (THE "GAME") PROVIDED BY LIGMA STUDIOS LLC ("LICENSOR"). BY INSTALLING, ACCESSING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT INSTALL, ACCESS, OR USE THE GAME.
1. License Grant
Ligma Studios LLC grants you a non-exclusive, non-transferable, revocable, limited license to install and use one copy of the Game for your personal, non-commercial use on a compatible device, subject to the terms and conditions of this EULA.
2. Ownership
The Game is licensed, not sold. Ligma Studios LLC retains all right, title, and interest in and to the Game, including all intellectual property rights. This EULA does not grant you any ownership interest in the Game.
3. Restrictions
You may not:
Copy, modify, or distribute the Game, in whole or in part.
Reverse engineer, decompile, or disassemble the Game, except as permitted by applicable law.
Remove, alter, or obscure any proprietary notices or labels on the Game.
Use the Game for any commercial purpose without the prior written consent of Ligma Studios LLC.
Use the Game in any manner that violates any applicable laws or regulations.
4. User-Generated Content
The Game may allow you to create, post, or share content ("User-Generated Content"). By creating, posting, or sharing User-Generated Content, you grant Ligma Studios LLC a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, distribute, and display your User-Generated Content in connection with the Game.
5. Updates and Patches
Ligma Studios LLC may provide updates, patches, and other modifications to the Game that must be installed for you to continue using the Game. Ligma Studios LLC may update, patch, or modify the Game remotely and access the Game installed on your device for such purposes.
6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Game and uninstall all copies of the Game.
7. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIGMA STUDIOS LLC DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIGMA STUDIOS LLC BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF LIGMA STUDIOS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Ligma Studios LLC is located, without regard to its conflict of laws principles.
10. Severability
If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions of this EULA will remain in full force and effect.
11. Entire Agreement
This EULA constitutes the entire agreement between you and Ligma Studios LLC regarding the Game and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Game.
